Estes Termos de Serviço de Pagamentos para Utilizadores Europeus ("Termos de Pagamento") constituem um acordo vinculativo entre o Utilizador e a Airbnb Payments que regulam os Serviços de Pagamento (definidos abaixo) realizados através ou em ligação com a Plataforma Airbnb. Quando estes Termos de Pagamento mencionam "Airbnb Payments", "nós", "nos" ou "nosso(a)", referem-se a:
Estes Termos de Pagamento e os documentos, políticas e padrões neles referidos constituem um contrato legal vinculativo entre si e a Airbnb Payments que regulam os Serviços de Pagamento (definidos abaixo) realizados através ou em ligação com a Plataforma Airbnb.

Por conveniência, definimos acima vários termos e políticas referidos nestes Termos de Pagamento. No entanto, é importante salientar que existem outras políticas e termos complementares disponíveis na nossa página de Termos Legais Adicionais que se aplicam à sua utilização da Plataforma Airbnb e estão incorporados por referência, fazendo também parte do acordo jurídico vinculativo entre si e a Airbnb.
Os nossos termos e políticas estão organizados com base nos tópicos a que se referem, de forma a facilitar a localização do termo ou política relevantes para a sua consulta ou evento.
A Airbnb Payments fornece serviços de pagamento aos Membros que publicam, oferecem e reservam Alojamentos, Serviços, Experiências ou outros Serviços de Anfitriões, incluindo serviços relacionados com a Airbnb.org e outros serviços atuais e futuros disponibilizados através da Plataforma Airbnb. Estes serviços de pagamento são fornecidos em benefício dos Anfitriões e podem incluir (se disponíveis) o seguinte (coletivamente, os "Serviços de Pagamento"):
A Airbnb Payments fornece Serviços de Pagamento regulados exclusivamente aos Anfitriões, atuando como agente de cobrança de pagamentos limitado, ao aceitar e processar fundos pagos pelos Hóspedes que adquiram os Serviços dos Anfitriões.
Para utilizar os Serviços de Pagamento, deve ter pelo menos 18 anos de idade, ter uma conta Airbnb em situação regular, de acordo com os Termos de Serviço da Airbnb ("Termos"), manter os seus dados pessoais e de pagamento atualizados e completos e fornecer-nos a sua identidade e outras informações por nós solicitadas.
Se alterar o seu país de residência, a empresa da Airbnb quem contrata e a versão aplicável dos Termos de Pagamento, serão determinadas pelo seu novo país de residência a partir da data de alteração. Ao continuar a utilizar os Serviços de Pagamento depois desta alteração, concorda com esta mudança de parte contratante e dos termos respetivos. No entanto, note que a empresa Airbnb Payments com quem contratou permanecerá a mesma para todas as reservas efetuadas antes da alteração de residência.
Os Termos regulam separadamente a sua utilização da Plataforma Airbnb. Se encontrar um termo não definido nestes Termos de Pagamento, este terá o mesmo significado queTermos.
A utilização dos Serviços de Pagamento implica o cumprimento dos presentes Termos de Pagamento. A Airbnb Payments pode limitar ou suspender temporariamente o seu acesso ou utilização dos Serviços de Pagamento, ou das suas funcionalidades, para levar a cabo medidas de manutenção que garantam o funcionamento correto dos Serviços de Pagamento.
Os Serviços de Pagamento podem conter ligações para sites ou ferramentas de terceiros ("Serviços de Terceiros"). Tais Serviços de Terceiros encontram-se sujeitos a diferentes termos de serviço e políticas de privacidade que devem ser analisadas pelos Membros. A Airbnb Payments não é responsável pela utilização desses Serviços de Terceiros. As ligações a estes Serviços de Terceiros não significam que a Airbnb Payments aprove esses Serviços de Terceiros.
A Airbnb Payments pode disponibilizar funcionalidades que permitem autorizar outros Membros ou terceiros a tomar determinadas ações que afetem a sua a conta Airbnb. Poderá autorizar um terceiro a utilizar a sua conta Airbnb a um terceiro caso essa funcionalidade esteja ativada na sua conta Airbnb. Reconhece e concorda que qualquer pessoa que autorize a utilizar a sua conta Airbnb poderá utilizar os Serviços de Pagamento em seu nome, e que será responsável por quaisquer pagamentos efetuados por essa pessoa.
Autoriza a Airbnb Payments, diretamente ou através de terceiros, à realização de quaisquer inquéritos que consideremos necessários para verificar a sua identidade e as informações que fornecer e, se aplicável, verificar a identidade dos representantes e dos beneficiários efetivos. Isto pode incluir (i) a sua verificação e, se aplicável, a dos seus representantes e beneficiários efetivos em bases de dados de terceiros ou outras fontes, (ii) o pedido de relatórios a prestadores de serviços, (iii) o pedido para apresentar, e se aplicável, que os seus representantes apresentem, uma forma de identificação oficial (por exemplo, carta de condução ou passaporte), para verificar o seu nome, local e data de nascimento, a sua morada, nacionalidade e/ou outras informações que consideremos necessárias ao abrigo da legislação aplicável; ou (iv) exigir-lhe que tome medidas para confirmar a titularidade do seu endereço de e-mail, Métodos de Pagamento ou Métodos de Pagamentos a Anfitriões. A Airbnb Payments reserva-se o direito de terminar, suspender ou limitar o acesso aos Serviços de Pagamento caso não consiga obter ou verificar esta informação.
O seu acesso ou utilização de determinados Serviços de Pagamento podem estar sujeitos a, ou exigir que aceite, termos e condições adicionais. Caso exista um conflito entre estes Termos de Pagamentos e os termos e condições aplicáveis a um Serviço de Pagamento específico, os termos e condições adicionais terão prevalência em relação ao seu acesso ou utilização desse Serviço de Pagamento, salvo indicação em contrário.
Ao adicionar um Método de Pagamento à Conta Airbnb, ser-lhe-á pedido que preste as informações habituais para efeitos de faturação, como o nome, morada de faturação e informações relativa a instrumentos financeiros, quer à Airbnb Payments quer às respetivas entidades terceiras prestadoras de serviços de pagamento. Autoriza a Airbnb Payments e os respetivos prestadores de pagamento a recolher e armazenar as informações do seu Método de Pagamento de acordo com a política de privacidade da Airbnb.
Quando adiciona ou utiliza um Método de Pagamento, a Airbnb Payments pode verificar o Método de Pagamento através de (i) autorização do seu Método de Pagamento para um ou dois valores nominais através de um prestador de serviços de pagamento, solicitando que confirme esses valores, ou (ii) exigindo que carregue um extrato de faturação. Reservamo-nos o direito de iniciar reembolsos desses valores a partir do seu Método de Pagamento. Quando adicionar um Método de Pagamento durante o check-out, iremos associar automaticamente este Método de Pagamento à sua conta Airbnb, para poder ser utilizado em transações futuras. Não poderá remover o Método de Pagamento associado a uma reserva, durante o período que começa na data da sua reserva e termina catorze (14) dias após a data do seu check-out, nem durante qualquer período adicional necessário para resolver qualquer Relatório de Danos pendente associado à referida reserva.
Autoriza a Airbnb Payments a debitar o seu Método de Pagamento (incluindo a debitar mais de um método de pagamento), direta ou indiretamente, por todas as taxas e outros montantes devidos (incluindo quaisquer impostos aplicáveis) em relação à sua conta Airbnb, incluindo montantes do Relatório de Danos de acordo com os Termos e com as Secções 5 e 6.
Se as informações do seu método de pagamento se alterarem (por exemplo, número da conta ou do cartão, número de roteamento, data de validade ou número CVV ou CVC) como resultado de uma reemissão ou por outro motivo, poderemos obter essas informações através dos nossos parceiros de serviços financeiros ou do seu banco e tentar atualizar automaticamente o seu método de pagamento registado.
A Airbnb Payments geralmente cobra o Preço Total devido depois de o Anfitrião aceitar o seu pedido de reserva. No entanto, se pagar com um Método de Pagamento de emissão imediata (como o Sofort), a Airbnb Payments irá cobrar o Preço Total devido no momento do seu pedido de reserva ou após o Anfitrião aceitar o seu pedido de reserva. A Airbnb pode oferecer opções alternativas para os prazos e a forma de pagamento. Quaisquer taxas adicionais pelo uso dessas opções de pagamento alternativas serão exibidas através da Plataforma Airbnb e incluídas no Preço Total, e ao selecionar a opção de pagamento concorda em pagar essas taxas. Termos e condições adicionais podem ser aplicáveis ao uso de uma opção de pagamento alternativa. Se a Airbnb Payments não conseguir cobrar o Preço Total devido, como previsto, a Airbnb Payments cobrará o Preço Total devido posteriormente, em conformidade com a Secção 5.3. Assim que o pagamento da reserva solicitada for concluído com êxito, receberá um e-mail de confirmação.
As moedas disponíveis para realizar pagamentos podem ser limitadas por razões regulamentares ou operacionais com base em determinados fatores, tais como o Método de Pagamento selecionado, o país de residência e/ou a(s) entidade(s) contratual(is) da Airbnb Payments. Quaisquer limitações serão comunicadas através da Plataforma Airbnb, e, caso a moeda desejada não esteja disponível, será solicitado que selecione uma moeda diferente ou um Método de Pagamento alternativo.
Note que, se o país onde está localizada a entidade contratual da Airbnb Payments for diferente do país do prestador do seu Método de Pagamento, ou se a moeda selecionada for diferente da moeda de faturação do seu Método de Pagamento, o seu pagamento poderá ser processado fora do seu país de residência. Como resultado, o prestador do seu Método de Pagamento poderá aplicar certas taxas, e o valor indicado no extrato do seu Método de Pagamento poderá ser diferente do valor exibido no checkout. Por exemplo, se ao efetuar uma reserva com um cartão emitido nos EUA escolher o Euro como moeda, o pagamento pode ser processado fora dos EUA e os bancos e empresas de cartões de crédito podem aplicar comissões sobre as transações internacionais e taxas de câmbio. Além disso, ao optar por pagar com uma moeda diferente da moeda de faturação do Método de Pagamento, o banco ou empresa de cartão de crédito pode converter o montante de pagamento na moeda de faturação associada ao Método de Pagamento, com base numa taxa de câmbio e montante de taxa determinados exclusivamente pelo banco. A Airbnb Payments não é responsável por tais taxas. Em caso de dúvidas sobre estas taxas ou sobre qualquer taxa de câmbio imposta pelo seu fornecedor do Método de Pagamento, contacte o referido fornecedor.
Se uma reserva solicitada for recusada por não ser aceite pelo Anfitrião, se cancelar o pedido de reserva antes de este ser aceite pelo Anfitrião ou se a Airbnb cancelar a reserva, quaisquer montantes cobrados pela Airbnb Payments e que lhe sejam devidos de acordo com as políticas descritas na Secção 5.5 serão reembolsados e qualquer pré-autorização do seu Método de Pagamento será cancelada (se aplicável) de acordo com a Secção 5.5.2.
A Airbnb Payments reserva-se o direito de recusar ou limitar pagamentos que considere que (i) poderem violar as políticas ou procedimentos de gestão de riscos da Airbnb Payments, (ii) poderem infringir estes Termos de Pagamentos ou os Termos, (iii) serem não autorizados, fraudulentos ou ilegais; ou (iv) exporem o utilizador, a Airbnb, a Airbnb Payments ou terceiros a riscos inaceitáveis para a Airbnb Payments.
Os Métodos de Pagamento podem envolver a utilização de entidades terceiras prestadoras de serviços de pagamento. Estas entidades prestadoras de serviços de pagamento podem cobrar taxas adicionais ao processar pagamentos relacionados com os Serviços de Pagamento, não sendo a Airbnb Payments responsável por tais taxas e renunciando a qualquer responsabilidade a este respeito. O seu Método de Pagamento também pode estar sujeito a termos de utilização adicionais. É aconselhável a consulta dos mesmos antes da utilização do Método de Pagamento.
A Airbnb Payments não é responsável por qualquer perda que venha a sofrer como resultado de informações incorretas sobre o Método de Pagamento que apresentou. A Airbnb Payments não lhe disponibiliza quaisquer Serviços de Pagamento regulamentados.
2.11.1.1
A Airbnb pode disponibilizar aos Hóspedes a opção de solicitar que uma parte do Preço Total da reserva seja devida e paga no momento da reserva, e o restante numa data posterior antes do check-in ("Pagar Parte Agora, Parte Depois"). A disponibilidade desta opção pode depender do Anúncio e/ou do Método de Pagamento. Não serão cobradas quaisquer taxas adicionais por utilizar a opção Pagar Parte Agora, Parte Depois. Note que a falha no pagamento de cada parcela dentro da data de vencimento correspondente pode resultar no cancelamento da sua reserva.
2.11.1.2
Se optar pela opção "Pagar Parte Agora, Parte Depois", a Plataforma Airbnb irá notificá-lo durante o checkout sobre o valor, a moeda e o cronograma de quando cada parcela do Preço Total é devida e paga. Créditos Airbnb, cupões ou cartões de oferta serão aplicados primeiro, antes do cálculo do valor de cada parcela. Na data de vencimento correspondente, a Airbnb Payments cobrará automaticamente o Método de Pagamento original que utilizou para efetuar a reserva.
2.11.1.3
Se alterar uma reserva feita com a opção "Pagar Parte Agora, Parte Depois, a Airbnb irá notificá-lo sobre as datas revistas em que as parcelas do Preço Total serão devidas e pagas, conforme aplicável, e a Airbnb Payments irá cobrar automaticamente o Método de Pagamento original que utilizou para efetuar a reserva nas novas datas de vencimento. Caso a modificação aumente o Preço Total, poderá ser necessário pagar uma parcela adicional do novo Preço Total no momento da modificação.
2.11.1.4
Concorda que, ao selecionar a opção "Pagar Parte Agora, Parte Depois", poderá não conseguir pagar pela reserva com um Método de Pagamento diferente ou efetuar o pagamento das suas parcelas em datas distintas.
2.11.1.5
Se a Airbnb Payments não conseguir cobrar o seu pagamento, será notificado sobre o pagamento recusado e terá de completar o pagamento da parcela relevante utilizando um Método de Pagamento alternativo dentro de 72 horas após a notificação. Caso não pague uma parcela do Preço Total na data de vencimento, autoriza a Airbnb a cancelar a reserva em seu nome. A política de cancelamento dos anfitriões determinará o montante do seu reembolso, se for caso disso, caso a sua reserva seja cancelada.
2.11.2.1
A Airbnb pode disponibilizar aos hóspedes a opção de reservar um alojamento e solicitar que o preço total devido seja pago numa data posterior, antes do check-in ("Reservar Agora, Pagar Mais Tarde"). Se a sua reserva reunir os requisitos para a opção "Reservar agora, Pagar Mais Tarde", a Plataforma da Airbnb disponibiliza-lhe esta opção no check-out. Não lhe são cobradas taxas adicionais por utilizar a opção "Reservar agora, Pagar Mais Tarde". Tenha em atenção que o não pagamento do Preço Total até à respetiva data de vencimento pode resultar no cancelamento da sua reserva.
2.11.2.2
Se escolher "Reservar Agora, Pagar Mais Tarde", a Plataforma da Airbnb irá notificá-lo durante o checkout sobre o valor, a moeda e a data em que o pagamento do Preço Total será devido e pagável. Na data de vencimento correspondente, a Airbnb Payments cobrará automaticamente o Método de Pagamento original que utilizou para efetuar a reserva. Caso decida alterar o seu método de pagamento antes do vencimento do pagamento, poderá fazê-lo acedendo a "Histórico de Pagamentos" e atualizando o Método de Pagamento original utilizado para a reserva.
2.11.2.3
Autoriza e concede à Airbnb Payments um mandato para cobrar todos os montantes devidos e pagáveis por si, nos termos da Secção 2.11.2, mediante o débito no Método de Pagamento utilizado para efetuar a reserva ou de outra forma, conforme permitido nos presentes Termos de Pagamentos.
2.11.2.4
Se fizer uma alteração a uma reserva feita com a opção "Reservar Agora, Pagar Mais Tarde" e a alteração aumentar o seu Preço Total, a Airbnb pode pedir-lhe que pague uma parte adicional do novo Preço Total no momento da alteração.
2.11.2.5
Se a Airbnb Payments não conseguir cobrar o seu pagamento, emite-lhe uma notificação a comunicar que esse pagamento foi recusado e a pedir-lhe que o conclua utilizando um Método de Pagamento alternativo no prazo de 72 horas após a notificação. Se não concluir o pagamento, autoriza a Airbnb a cancelar a reserva em seu nome. A política de cancelamento dos anfitriões determinará o montante do seu reembolso, se for caso disso, caso a sua reserva seja cancelada.
2.11.3.1
Para determinadas reservas (tais como reservas de alojamentos de vinte e oito (28) noites ou mais), a Airbnb Payments pode exigir que os Hóspedes façam pagamentos recorrentes e progressivos até atingir o Preço Total devido ("Pagamentos Recorrentes"). Mais informações sobre Pagamentos Recorrentes (incluindo o montante e a frequência dos pagamentos) estarão disponíveis através da Plataforma Airbnb, caso aplicável à reserva.
2.11.3.2
Se os Pagamentos Recorrentes se aplicarem a uma reserva confirmada, os Hóspedes autorizam a Airbnb Payments a cobrar o Preço Total devido.
2.11.3.3
Os Hóspedes podem interromper um Pagamento Recorrente notificando a Airbnb Payments verbalmente ou por escrito, no prazo mínimo de três (3) dias úteis antes da data prevista para o pagamento. A Airbnb Payments pode exigir a confirmação escrita de uma ordem de cancelamento de pagamento no prazo de catorze (14) dias após uma notificação verbal. Se não apresentar uma confirmação por escrito dentro desses catorze (14) dias, a Airbnb Payments não é obrigada a aceitar o seu pedido para cancelar quaisquer Pagamentos Recorrentes futuros. Em caso de dúvidas sobre os Pagamentos Recorrentes, basta contactar a Airbnb Payments.
Os Hóspedes poderão, ocasionalmente, ter a possibilidade de pagar uma Reserva de Alojamento a crédito ou através de outras opções de pagamento parcelado, permitindo pagar ao longo do tempo ("comprar agora, pagar depois"). Esses Métodos de Pagamento serão fornecidos pelo Klarna Bank AB (ou sua afiliada), e não pela Airbnb, sendo o Klarna o seu credor para o pagamento, sujeito a termos de uso adicionais apresentados durante o checkout. Dependendo do Método de Pagamento, isto também criará uma relação separada entre si, como mutuário, e o Klarna, como credor. Consulte os termos adicionais aplicáveis antes de utilizar esses Métodos de Pagamento.
A Airbnb Payments geralmente cobra o Preço Total de uma reserva no momento em que o pedido de reserva do Hóspede é aceito pelo Anfitrião, salvo indicação em contrário.
Para receber um pagamento, é necessário ter um Método de Pagamento válido vinculado à sua conta Airbnb. Ao adicionar um Método de Pagamento à sua conta Airbnb, pode ser solicitado que forneça informações adicionais, tais como o nome, o documento de identificação, o número de identificação fiscal, a morada de faturação e informações sobre instrumentos financeiros, pela Airbnb Payments ou pelos processadores de pagamento externos. Dependendo do Método de Pagamento escolhido, podem ser necessárias informações adicionais, tais como: morada, nome da conta, tipo de conta, número de identificação bancária, número de conta, endereço de correio eletrónico, moeda de pagamento, número de identificação e informações de conta associadas a uma determinada entidade responsável pelo pagamento. O fornecimento das informações solicitadas é obrigatório para que um Método de Pagamento seja considerado válido. As informações exigidas pela Airbnb Payments para que um Método de Pagamento seja válido podem mudar, e a Airbnb Payments poderá solicitar informações adicionais a qualquer momento; caso as informações solicitadas não sejam fornecidas, a Airbnb Payments poderá colocar temporariamente uma retenção, suspender ou cancelar qualquer pagamento até que as informações sejam fornecidas e, se necessário, validadas.
Autoriza a Airbnb Payments a recolher e armazenar as informações do seu Método de Pagamento de acordo com a Política de Privacidade da Airbnb. A Airbnb Payments também pode partilhar as suas informações com as autoridades governamentais, em conformidade com a legislação aplicável.
Salvo se for um Anfitrião abrangido pela Secção 3.3.3 (caso em que essa Secção se aplica a si), e sujeito ao recebimento bem-sucedido dos pagamentos associados do Hóspede, a Airbnb Payments iniciará os pagamentos ao Método de Pagamento selecionado: (i) para Alojamentos, até ao final do dia útil seguinte à data de check-in agendada pelo Hóspede; (ii) para Serviços e Experiências, até ao final do dia útil seguinte ao início do Serviço ou Experiência; e (iii) para todos os outros Serviços do Anfitrião, incluindo, mas não se limitando a Serviços de Fotografia ou Experiências, no momento especificado através da Plataforma Airbnb. Para reservas de Alojamento com duração de vinte e oito (28) noites ou mais, a Airbnb Payments iniciará, geralmente, o primeiro pagamento até ao final do dia útil seguinte à data de check-in agendada pelo Hóspede, e iniciará pagamentos futuros mensalmente após o primeiro pagamento, durante a duração da reserva.
A Airbnb Payments pode oferecer prazos de Pagamentos ou um mecanismo distintos para o pagamento através da Plataforma Airbnb. O período que decorre até ao recebimento dos Pagamentos depois de disponibilizados pela Airbnb Payments pode depender do método de pagamento que selecionar.
Para Alojamentos, nos seguintes casos:
sujeito e condicionado ao recebimento bem-sucedido dos pagamentos associados do Hóspede, a Airbnb Payments iniciará os pagamentos ao Método de Pagamento selecionado até ao fim do dia útil após a data de check-out agendada pelo Hóspede. Se a reserva do Alojamento for de vinte e oito (28) noites ou mais, a Airbnb Payments processa o primeiro e o segundo Pagamentos em conjunto, 28 dias após a data de check-in agendada dos Hóspedes. Os Pagamentos subsequentes são processados mensalmente durante o período da reserva.
O calendário de pagamentos será apresentado no seu painel de rendimentos.
O pagamento relativo a uma reserva será o Preço Total menos as taxas aplicáveis, como as taxas de serviço da Airbnb e os impostos aplicáveis, bem como quaisquer montantes que aceite atribuir a um coanfitrião, ao(s) proprietário(s) do alojamento, a uma associação de proprietários e/ou ao respetivo representante (como um operador de edifício ou uma empresa de gestão de propriedades). No caso de cancelamento de uma reserva confirmada, a Airbnb Payments transferirá o montante que lhe seja devido (se aplicável), conforme estabelecido nos Termos e na política de cancelamento aplicável.
A Airbnb Payments pode, temporariamente, reter, suspender ou cancelar qualquer pagamento com o objetivo de prevenir atividades ilegais ou fraudulentas, realizar avaliação de risco, assegurar segurança ou concluir uma investigação; ou caso não seja possível verificar a sua identidade ou, se aplicável, a identidade dos seus representantes ou proprietários beneficiários, ou obter ou validar as informações solicitadas. Além disso, a Airbnb Payments pode, temporariamente, reter, suspender ou atrasar a iniciação ou o processamento de qualquer pagamento devido nos termos dos Termos como resultado de cancelamentos ou modificações massivos decorrentes de um Evento de Força Maior (conforme definido abaixo).
A Airbnb Payments processa os Pagamentos na moeda aplicável ao Método de Pagamento selecionado. As moedas disponíveis podem ser limitadas por motivos regulamentares ou operacionais com base em fatores como o Método de Pagamentos selecionado, o país de residência e/ou as entidades contratantes da Airbnb. Tais limitações serão comunicadas através da Plataforma Airbnb e ser-lhe-á pedido que selecione uma moeda ou um Método de Pagamentos diferente. É importante salientar que os prestadores de serviços de pagamento podem impor taxas de transação, de conversão de moeda ou outras taxas com base na moeda ou no Método de Pagamentos que selecionar. A Airbnb Payments não é responsável por essas taxas e rejeita qualquer responsabilidade a este respeito.
Por razões de conformidade ou operacionais, a Airbnb Payments pode limitar o montante de Pagamentos a Anfitriões. Se lhe for devido um montante acima desse limite, a Airbnb Payments poderá efetuar uma série de Pagamentos (potencialmente ao longo de vários dias) para remeter o montante total desses Pagamentos.
Os Métodos de Pagamentos podem envolver a utilização de entidades externas prestadoras de serviços de pagamento. Estas entidades prestadoras de serviços podem cobrar taxas adicionais pelo processamento de Pagamentos relacionados com os Serviços de Pagamentos (incluindo a dedução de taxas do montante dos Pagamentos). A Airbnb Payments não é responsável por tais taxas e rejeita qualquer responsabilidade a este respeito. O seu Método de Pagamentos também pode estar sujeito a termos de utilização adicionais dessas entidades prestadoras de serviços de pagamento externas. É aconselhável a consulta antes da utilização do Método de Pagamento.
Sujeito às secções 17 ou 18, a Airbnb Payments não é responsável por qualquer perda que venha a sofrer em resultado das informações incorretas sobre o Método de Pagamentos que forneceu.
Se fornecer Serviços de Anfitrião conjuntamente com outros Anfitriões como parte de uma equipa, empresa ou outra organização ("Equipa de Anfitriões"), a Airbnb pode disponibilizar aos Anfitriões a opção de alocar entre os membros da Equipa de Anfitriões o pagamento total devido ao Anfitrião por uma reserva. A Airbnb Payments executará esses pagamentos sob instrução de um ou mais membros da Equipa de Anfitriões, e os Anfitriões são responsáveis pela precisão das suas instruções.
Se um Hóspede na Alemanha optar por pagar a Reserva de Alojamento utilizando a opção comprar agora, pagar depois do Klarna (exceto pela opção de pagar em três parcelas), aplicam-se estes Termos Adicionais para Anfitriões.
Cada Anfitrião, incluindo cada membro da Equipa de Anfitriões, designa a Airbnb Payments como agente de cobrança de pagamentos do Anfitrião, exclusivamente para o propósito limitado de aceitar e processar fundos provenientes de Hóspedes que adquiram Serviços do Anfitrião em nome do Anfitrião.
Cada Anfitrião, incluindo cada membro da Equipa de Anfitriões, concorda que o pagamento efetuado por um Hóspede através da Airbnb Payments será considerado equivalente a um pagamento feito diretamente ao Anfitrião, e o Anfitrião fornecerá o Serviço de Anfitrião reservado pelo Hóspede na forma acordada, como se o Anfitrião tivesse recebido o pagamento diretamente do Hóspede. Cada Anfitrião concorda que a Airbnb Payments poderá reembolsar o Hóspede de acordo com osTermos. Cada Anfitrião compreende que a obrigação da Airbnb Payments de pagar ao Anfitrião está sujeita e condicionada ao recebimento bem-sucedido dos pagamentos associados provenientes do Hóspede. A Airbnb Payments garante os pagamentos ao(s) Anfitrião(ões) apenas para os montantes que foram recebidos com sucesso pela Airbnb Payments de Hóspedes, sujeito e em conformidade com estes Termos de Pagamentos. Ao aceitar a nomeação como agente limitado de cobrança de pagamentos do Anfitrião, as responsabilidades da Airbnb Payments estão limitadas às estabelecidas nesta Secção 4.2, não sendo responsável nem poderá ser responsabilizada por quaisquer atos ou omissões do Anfitrião. Sujeito à Secção 11, a Airbnb Payments continuará responsável por quaisquer atos resultantes da sua própria negligência e por violações dos seus direitos como consumidor ao abrigo da legislação aplicável.
Cada Hóspede reconhece e concorda que, apesar de a Airbnb Payments não ser parte do acordo entre o Hóspede e o(s) Anfitrião(ões), incluindo cada membro da Equipa de Anfitriões, a Airbnb Payments atua como agente de cobrança de pagamentos de cada Anfitrião, com o propósito limitado de aceitar pagamentos efetuados pelo Hóspede em nome do(s) Anfitrião(ões). Após o pagamento dos fundos pelo Hóspede à Airbnb Payments, a obrigação de pagamento do Hóspede ao(s) Anfitrião(ões) pelo montante acordado é extinta, sendo a Airbnb Payments responsável por transferir os fundos recebidos com sucesso pela Airbnb Payments ao(s) Anfitrião(ões) na forma descrita nestes Termos de Pagamentos. Caso a Airbnb Payments não transfira qualquer desses montantes, o(s) Anfitrião(ões) terá(ão) recurso apenas contra a Airbnb Payments e não diretamente contra o Hóspede.
A Airbnb Payments pode cobrar taxas pela utilização de certos Serviços de Pagamento e informará sobre quaisquer taxas aplicáveis nos Termos ou através da Plataforma Airbnb.
Autoriza a Airbnb Payments a cobrar-lhe os montantes devidos de acordo com estes Termos de Pagamento e/ou os Termos quer (i) através da cobrança pelo Método de Pagamento associado à respetiva reserva, ou qualquer outro Método de Pagamento autorizado e arquivado na sua conta Airbnb (a menos que tenha previamente retirado a autorização para cobrar através desses Métodos de Pagamento); ou (ii) pela retenção do montante de futuros pagamentos a anfitriões. Especificamente, autoriza que a Airbnb Payments lhe cobre:
Se ficar a dever um montante em qualquer altura após uma reserva, tal como com as cobranças relativas a Pagar uma Parte Agora, o Resto Mais Tarde ou Pagamentos Recorrentes, Modificações de Reserva, pagamentos do Centro de Resoluções ou Relatórios de Danos ("Montantes Adicionais"), autoriza e concede à Airbnb Payments autorização para cobrar os pagamentos desses Montantes Adicionais mediante a cobrança do seu Método de Pagamento associado à respetiva reserva, sem qualquer outra ação necessária da sua parte. A Airbnb Payments enviará uma notificação por escrito antes de serem cobrados quaisquer Montantes Adicionais nesse Método de Pagamento.
Se o Método de Pagamento associado à respetiva reserva estiver expirado, for inválido ou não puder ser cobrado por qualquer razão (tal como insuficiência de fundos), permanece responsável por quaisquer montantes não cobrados, e a Airbnb Payments poderá cobrar novamente o Método de Pagamento relacionado com a reserva ou utilizar qualquer outro Método de Pagamento em arquivo associado à sua conta Airbnb, se disponível, para cobrar tais Montantes Adicionais. Qualquer montante não cobrado por qualquer motivo estará sujeito a quaisquer soluções disponíveis, incluindo, mas não se limitando, ao encaminhamento para uma agência de cobranças ou à instauração de ações ou reclamações contra si.
Se a Airbnb acreditar razoavelmente que, enquanto Anfitrião, participou em atividades fraudulentas, como esquemas de pagamento em excesso, fraude em reservas ou outro tipo de fraude, e a Airbnb Payments já tiver iniciado o Pagamento para si relativamente a essa estadia, a Airbnb Payments pode recuperar esse montante reduzindo, compensando ou debitando o valor de quaisquer Pagamentos futuros que lhe sejam devidos.
Para além de qualquer montante devido conforme descrito acima, se existirem montantes que nos deve mas que não foram pagos, ou estornos associados ao seu Método de Pagamento, poderá ser-lhe cobrada uma taxa relativa à cobrança desses montantes e estornos por parte da Airbnb Payments. Essas taxas ou encargos podem incluir taxas de cobrança, taxas de conveniência ou outros encargos de terceiro.
Se a Airbnb Payments não conseguir cobrar quaisquer montantes que deva, enquanto Hóspede ou Anfitrião, ao abrigo dos Termos e destes Termos de Pagamento, a Airbnb Payments pode recorrer a esforços de cobrança para recuperar esses montantes junto de si.
A Airbnb Payments considerará qualquer montante em dívida como estando em atraso quando: (a) no caso de cobranças autorizadas, tiverem decorrido cento e vinte (120) dias após a primeira tentativa da Airbnb Payments de debitar o seu Método de Pagamento de Hóspede ou após os serviços associados terem sido prestados, consoante o que ocorrer mais tarde; e (b) no caso de retenções de Pagamentos futuros de um Anfitrião, tiverem decorrido duzentos e setenta (270) dias após o ajuste ser efetuado na conta Airbnb do Anfitrião ou após os serviços associados terem sido prestados, consoante o que ocorrer mais tarde.
A Airbnb Payments considerará qualquer montante em atraso que não tenha sido cobrado como estando em incumprimento quando tiverem decorrido trezentos e sessenta e cinco (365) dias: (a) no caso de cobranças autorizadas ao seu Método de Pagamento relativamente a uma transação de Hóspede, após a primeira tentativa da Airbnb Payments de debitar o seu Método de Pagamento ou após os serviços associados terem sido prestados, consoante o que ocorrer mais tarde; e (b) no caso de retenções de Pagamentos futuros de um Anfitrião, após o ajuste ser efetuado na conta Airbnb do Anfitrião ou após os serviços associados terem sido prestados, consoante o que ocorrer mais tarde.
Declara expressamente que todas as comunicações relativas a montantes em dívida serão efetuadas por correio eletrónico ou por telefone, conforme fornecido por si à Airbnb e/ou à Airbnb Payments. Essas comunicações podem ser efetuadas pela Airbnb, pela Airbnb Payments ou por qualquer pessoa em seu nome, incluindo, mas não se limitando, a um agente de cobrança externo.
A Airbnb Payments tomará as medidas necessárias para retificar quaisquer erros de processamento de pagamentos de que tenha conhecimento. Estas medidas podem incluir creditar ou debitar (consoante o caso) o mesmo Método de Pagamentos utilizado ou escolhido por si, para que possa receber ou pagar o montante correto. Isto poderá ser executado pela Airbnb Payments ou por um terceiro, como a sua instituição financeira. Também podemos tomar medidas para recuperar os fundos que lhe sejam enviados por engano, (incluindo, nomeada mas não exclusivamente, casos de pagamentos duplicados feitos a si devido a um erro de processamento). No caso dos Anfitriões, isto pode incluir a redução, compensação e/ou débito do montante de tais fundos de quaisquer Pagamentos futuros que lhe sejam devidos.
Se receber quaisquer fundos por engano, compromete-se a devolvê-los imediatamente à Airbnb Payments.
Quaisquer reembolsos ou créditos devidos a um Membro conforme disposto nos Termos, na Política de Cancelamento por Eventos Extraordinários, na Política de Alteração de Reserva e Reembolso para Alojamentos e na Política de Reembolso para Serviços e Experiências serão iniciados e remetidos pela Airbnb Payments conforme descrito nos presentes Termos de Pagamento.
Sujeito ao disposto na Secção 5.5.2, a Airbnb Payments iniciará o processo de reembolso de forma célere. No caso de um cancelamento por parte do Anfitrião, a Airbnb Payments reterá os fundos em nome do Anfitrião por um período máximo de 72 horas, até que o Hóspede seja reembolsado ou os fundos sejam utilizados para uma nova reserva com outro Anfitrião. Em momento algum a Airbnb Payments detém os fundos em nome do Hóspede ou presta ao Hóspede um serviço de pagamento. Em determinadas situações, o processo de reembolso pode incluir a opção de receber crédito em vez de um reembolso em dinheiro; caso esta opção lhe seja disponibilizada, o prazo para o seu reembolso será comunicado através da Plataforma Airbnb. No entanto, o tempo necessário para receber qualquer reembolso em dinheiro ou para que qualquer pré-autorização do seu Método de Pagamento seja libertada variará consoante o Método de Pagamento e as regras do sistema de pagamentos aplicável (por exemplo, Visa, Mastercard, etc.). No caso de um Evento de Força Maior que possa afetar o processamento e liquidação de reembolsos, a Airbnb Payments iniciará e processará o reembolso logo que seja praticável.
Se for responsável por montantes relativos a Relatórios de Danos nos termos da Secção 15 dos Termos, a Airbnb, através da Airbnb Payments, pode debitar o Método de Pagamento utilizado para efetuar a reserva ou qualquer outro Método de Pagamento associado à sua conta Airbnb no momento do Relatório de Danos ou dentro de um prazo razoável após esse momento, a fim de cobrar os montantes relativos ao Relatório de Danos, até ao montante máximo definido na Secção 15 dos Termos. Para facilitar esta cobrança, ao reservar um Anúncio, está a concordar que a Airbnb, através da Airbnb Payments, pode debitar o Método de Pagamento utilizado para reservar o Anúncio para cobrar os montantes relativos ao Relatório de Danos.
Concorda que a Airbnb Payments pode procurar recuperar de si ao abrigo de quaisquer apólices de seguro que mantenha e que a Airbnb Payments pode também recorrer a quaisquer meios de que disponha para obter o pagamento, incluindo, mas não se limitando a, encaminhamento para uma agência de cobranças ou instauração de ações judiciais ou reclamações contra si, incluindo no que diz respeito a qualquer Relatório de Danos ou pedidos de pagamento efetuados por Anfitriões ao abrigo da Proteção Contra Danos para Anfitriões.
Se a Airbnb Payments detiver fundos que lhe são devidos e não tiver conseguido efetuar-lhe o pagamento desses fundos ("Propriedade Abandonada") de acordo com a Secção 7.2, podemos, sujeito à legislação aplicável e ao prazo de prescrição relevante, reter a Propriedade Abandonada que, de outra forma, lhe seria devida, deixando de ter direito a reclamar esses fundos.
Nos termos da legislação aplicável, os fundos detidos em seu nome pela Airbnb Payments serão considerados Propriedade Abandonada se se verificar qualquer uma das seguintes situações:
É da sua exclusiva responsabilidade o cumprimento de todas e quaisquer leis, regras, regulamentos e obrigações fiscais que possam aplicar-se à sua utilização dos Serviços de Pagamento. No âmbito da sua utilização dos Serviços de Pagamento, não pode, e concorda que não irá, nem ajudará ou permitirá que outros:
Somos obrigados a atuar em conformidade com as nossas políticas internas e com as leis de várias jurisdições relativas à prevenção do branqueamento de capitais e à implementação de sanções, incluindo: (i) sanções económicas ou financeiras ou embargos comerciais impostos, administrados ou aplicados periodicamente pelo governo dos EUA, incluindo aqueles administrados pelo Office of Foreign Asset Control ou pelo Departamento de Estado dos EUA; ou (ii) pelo Conselho de Segurança das Nações Unidas, pela União Europeia ou pelo Tesouro de Sua Majestade do Reino Unido. Deve cumprir quaisquer sanções financeiras relevantes e quaisquer leis de controlo de exportação relevantes que lhe sejam aplicáveis e à sua jurisdição local.
A Airbnb Payments não será responsável por qualquer atraso ou incumprimento de qualquer obrigação ao abrigo destes Termos de Pagamento resultante de circunstâncias anormais ou imprevisíveis fora do controlo razoável da Airbnb ou da Airbnb Payments, cujas consequências não poderiam ter sido evitadas apesar de todos os esforços em sentido contrário, incluindo, mas não se limitando a, casos de força maior, desastres naturais, guerra, terrorismo, motins, embargos, atos de autoridades civis ou militares, incêndios, inundações, acidentes, pandemias, epidemias ou doenças, greves ou escassez de meios de transporte, combustível, energia, mão de obra ou materiais ("Evento de Força Maior").
Se optar por utilizar os Serviços de Pagamento, fá-lo voluntariamente e por sua conta e risco.
Não obstante a nomeação da Airbnb Payments como agente limitado de cobrança de pagamentos dos Anfitriões, nos termos da Secção 4 e sujeito à Secção 11, a Airbnb Payments rejeita explicitamente toda e qualquer responsabilidade por qualquer ato ou omissão da sua parte, de qualquer Membro ou de terceiros. A Airbnb Payments não tem quaisquer deveres ou obrigações enquanto agente de cada Anfitrião, exceto na medida expressamente prevista nestes Termos de Pagamento, sendo que quaisquer deveres ou obrigações adicionais que possam ser implicados por lei são, na máxima extensão permitida pela legislação aplicável, expressamente excluídos.
Se optarmos por, ou formos obrigados a, realizar a verificação de identidade de qualquer Membro, na medida permitida pela legislação aplicável, rejeitamos quaisquer garantias de qualquer tipo, expressas ou implícitas, de que tais verificações identificarão condutas impróprias anteriores de um Membro ou garantirão que um Membro não venha a envolver-se em condutas impróprias no futuro. Não somos responsáveis por condutas impróprias anteriores de um Membro caso tais condutas nos fossem desconhecidas.
As isenções de responsabilidade acima referidas aplicam-se na máxima extensão permitida por lei. Poderá ter outros direitos ou garantias legais que não possam ser legalmente excluídos. No entanto, a duração de quaisquer garantias exigidas por lei será limitada à extensão máxima (se aplicável) permitida por lei.
Sujeito às secções infra e na máxima extensão permitida pela legislação aplicável, a responsabilidade da Airbnb Payments será limitada e todo o risco decorrente do seu acesso e utilização dos Serviços de Pagamento permanece consigo. Se permitir ou autorizar outra pessoa a utilizar a sua conta Airbnb de qualquer forma, é responsável pelas ações tomadas por essa pessoa.
A Airbnb Payments não será responsável por quaisquer perdas quando estas resultem do cumprimento, por parte da Airbnb Payments, das obrigações que lhe são impostas pela legislação aplicável. A Airbnb Payments também não será responsável por quaisquer perdas resultantes de atos ou omissões seus ou de outros Membros, incluindo, mas não se limitando a qualquer violação destes Termos de Pagamento ou da legislação aplicável ou se tiver agido (ou um dos Membros) de forma fraudulenta ou negligente.
Nada nestes Termos de Pagamento limita a responsabilidade da Airbnb Payments por: (i) morte ou danos pessoais resultantes de ato, omissão ou negligência da Airbnb Payments; (ii) fraude ou deturpação fraudulenta; (iii) conduta dolosa ou negligência grave; (iv) perdas causadas diretamente por violação destes Termos de Pagamento pela Airbnb Payments; ou (v) qualquer outra responsabilidade que não possa ser excluída ou limitada ao abrigo da legislação aplicável (incluindo, por exemplo, violação de direitos legais do consumidor ou de direitos legais ao abrigo de leis e regulamentos de pagamentos).
A Airbnb Payments não será, em circunstância alguma, responsável perante si por qualquer perda de negócio, perda de reputação, perda de oportunidade ou perda de lucros.
Na medida em que a responsabilidade da Airbnb Payments esteja excluída ou limitada, tal exclusão ou limitação aplica-se igualmente à responsabilidade pessoal dos seus representantes legais, colaboradores e outros agentes.
Na máxima extensão permitida pela lei aplicável, o Utilizador concorda em renunciar, defender (a critério da Airbnb Payments), indemnizar e isentar a Airbnb Payments e as suas afiliadas e subsidiárias, bem como os seus funcionários, diretores, trabalhadores e agentes, de e contra quaisquer reclamações, responsabilidades, danos, perdas e despesas, incluindo, sem limitação, honorários legais e contabilísticos razoáveis, decorrentes de (i) violação dos presentes Termos de Pagamentos; (ii) da sua utilização indevida dos Serviços de Pagamento; (iii) da sua falha, ou da nossa falha sob a sua direção, em comunicar, cobrar ou remeter impostos com precisão; ou (iv) da sua violação de quaisquer leis, regulamentos ou direitos de terceiros. A obrigação de indemnizar só se aplica se e na medida em que as reclamações, responsabilidades, danos, perdas e despesas tenham sido causados por negligência sua ou em virtude de violação de uma obrigação contratual.
Podemos alterar os presentes Termos de Pagamento a qualquer momento desde que lhe enviemos um aviso prévio com uma antecedência mínima de dois (2) meses antes de tais alterações entrarem em vigor. Vamos enviar-lhe um aviso sobre as alterações propostas através de notificações por e-mail, através da Plataforma Airbnb, serviço de mensagens ou qualquer outro método de contacto disponibilizado por nós e selecionado por si, e também ao publicar os Termos de Pagamento revistos numa ligação na Plataforma Airbnb. Pode ver os Termos de Pagamento revistos acedendo à ligação na Plataforma Airbnb e pode guardá-los e imprimi-los, se assim o desejar. Por favor compreenda que as alterações que fizermos a estes Termos de Pagamento serão consideradas como tendo sido aceites por si, a menos que faça cessar os presentes Termos de Pagamento ou encerre a sua conta Airbnb (sem penalização) antes de findo o período de aviso prévio de dois (2) meses e antes de as alterações entrarem em vigor. Se optar por rescindir os presentes Termos de Pagamento ou encerrar a sua conta Airbnb, continuará a ter de cumprir todas as suas obrigações pendentes ao abrigo dos Termos, incluindo as relativas a reservas futuras ou à prestação de Serviços de Anfitriões.
O presente acordo entre si e a Airbnb Payments entra em vigor (i) caso seja um Hóspede, a partir do momento em que fizer a primeira reserva; ou (ii) caso seja um Anfitrião, a partir do momento em que um Hóspede reservar pela primeira vez um Anúncio disponibilizado por si e utilizar os Serviços de Pagamento, sendo que este acordo permanecerá em vigor até que a respectiva cessação seja promovida por si ou por nós, conforme disposto na Secção 13.3.
Pode fazer cessar o presente acordo a qualquer momento se nos enviar um e-mail ou eliminar a sua conta Airbnb. Sem prejuízo dos direitos especificados abaixo, a Airbnb Payments Luxembourg pode fazer cessar este acordo consoante a sua conveniência mediante aviso prévio de dois (2) meses, e a Airbnb Payments UK pode fazer cessar este acordo consoante a sua conveniência mediante aviso prévio de noventa (90) dias. A Airbnb Payments também pode fazer cessar este acordo imediatamente sem aviso prévio se (i) tiver gravemente incumprido as suas obrigações ao abrigo deste acordo; (ii) tiver fornecido informações imprecisas, fraudulentas, desatualizadas ou incompletas; (iii) tiver infringido leis, regulamentos ou direitos de terceiros aplicáveis; ou (iv) a Airbnb Payments acreditar, de boa-fé, que tal ação é razoavelmente necessária para proteger outros Membros, a Airbnb, a Airbnb Payments ou terceiros. Em caso de cessação deste contrato por si ou pela Airbnb Payments, a sua conta Airbnb também será eliminada de acordo com os Termos.
A Airbnb Payments pode limitar ou suspender temporária ou permanentemente a sua utilização ou o seu acesso aos Serviços de Pagamento nas seguintes situações: (i) para cumprir a legislação aplicável ou uma ordem ou exigência judicial, de uma autoridade judiciária ou de outra entidade administrativa ou órgão governamental; (ii) caso tenha infringido os presentes Termos de Pagamento, os Termos, as leis, os regulamentos ou direitos de terceiros aplicáveis; (iii) se tiver facultado informação incorreta, fraudulenta, desatualizada ou incompleta no que diz respeito a um Método de Pagamento ou a um Método de Pagamentos a Anfitriões; (iv) se tiver montantes devidos ao abrigo dos presentes Termos de Pagamento que estejam em atraso ou tenham vencido; ou (v) caso a Airbnb Payments acredite, de boa-fé, que esta medida é razoavelmente necessária para proteger a segurança ou o património da Airbnb, dos seus Membros, da Airbnb Payments ou de terceiros, ou para prevenir fraudes ou outras atividades ilegais. Além disso, em caso de pagamentos não-realizados devido à caducidade do cartão, insuficiência de fundos, ou quaisquer outros motivos, podemos suspender temporariamente o seu acesso aos Serviços de Pagamento até que possamos cobrar um Método de Pagamento válido.
Se a Airbnb Payments adotar qualquer uma das medidas descritas nas secções 13.3 e 13.4, poderá contactar o nosso serviço de atendimento ao cliente para recorrer de tal decisão.
Se cancelar a sua conta de Anfitrião na Airbnb ou se a Airbnb Payments tomar qualquer uma das medidas acima descritas, a Airbnb Payments pode emitir um reembolso total aos Hóspedes com reservas confirmadas e você não terá direito a nenhuma compensação pelas reservas pendentes ou confirmadas que tenham sido canceladas. Se cancelar a sua conta Airbnb na qualidade de Hóspede, a Airbnb Payments iniciará um reembolso para quaisquer reservas confirmadas com base na política de cancelamento do Anúncio. Caso tenhamos suspendido ou limitado o seu acesso ou utilização dos Serviços de Pagamento ou na eventualidade de termos cessado o presente acordo, não poderá registar uma nova conta Airbnb ou tentar aceder e utilizar os Serviços de Pagamento através de uma conta Airbnb de outro Membro.
As secções 5 a 20 dos presentes Termos de Pagamento subsistirão a qualquer causa de cessação do presente acordo.
Se estiver a celebrar um contrato com a Airbnb Payments UK, estes Termos de Pagamento serão interpretados segundo a lei inglesa. Se estiver a atuar como consumidor e as normas legais obrigatórias de proteção dos consumidores no seu país de residência contiverem disposições mais vantajosas, essas disposições aplicar-se-ão independentemente da escolha da lei inglesa. Enquanto consumidor, apenas pode intentar ações relativas aos presentes Termos de Pagamento no tribunal competente do seu lugar de residência ou num tribunal de Inglaterra. Se a Airbnb pretender invocar qualquer direito contra si enquanto consumidor/a, apenas o poderemos fazer nos tribunais da jurisdição na qual você reside. Caso esteja a agir na qualidade de empresa, aceita submeter-se à jurisdição exclusiva dos tribunais ingleses.
Se estiver a celebrar um contrato com a Airbnb Payments Luxembourg, os presentes Termos de Pagamento serão interpretados segundo a lei do Luxemburgo. Se estiver a atuar na qualidade de consumidor e as normas legais obrigatórias de proteção do consumidor no seu país de residência contiverem disposições mais vantajosas, essas disposições aplicar-se-ão independentemente da escolha da lei luxemburguesa. Enquanto consumidor, apenas pode intentar ações relativas aos presentes Termos de Pagamento no tribunal competente do vosso local de residência ou num tribunal do Luxemburgo. Se a Airbnb pretender invocar qualquer direito contra si enquanto consumidor/a, apenas o poderemos fazer nos tribunais da jurisdição na qual você reside. Se estiver a agir na qualidade de empresa, aceita submeter-se à jurisdição exclusiva dos tribunais luxemburgueses.
LEIA ATENTAMENTE OS PARÁGRAFOS SEGUINTES, UMA VEZ QUE ESTES ESTIPULAM QUE O/A UTILIZADOR/A E A AIRBNB PAYMENTS CONCORDAM EM RESOLVER TODOS OS LITÍGIOS ENTRE SI MEDIANTE ARBITRAGEM INDIVIDUAL VINCULATIVA E INCLUEM UMA RENÚNCIA A AÇÕES COLETIVAS E A JULGAMENTOS EM TRIBUNAL DE JÚRI. Esta Convenção de Arbitragem substitui todas as suas versões anteriores.
Esta Convenção de Arbitragem só se aplica a si se tiver celebrado um contrato com a Airbnb Payment US. Se não estiver a celebrar um contrato com a Airbnb Payments US e, no entanto, tentar intentar uma ação judicial contra a Airbnb Payments nos Estados Unidos, esta Convenção de Arbitragem será aplicável para determinar se esta Secção 15 se aplica a si, e todas as outras determinações, incluindo residência, arbitragem, foro e lei aplicável.
A Airbnb Payments está empenhada em participar num processo de resolução de litígios favorável aos consumidores. Para este efeito, estes Termos preveem um processo em duas partes para as pessoas a quem esta Secção 15 se destina: (1) uma negociação informal diretamente com a equipa do serviço de Atendimento ao Cliente da Airbnb (descrita na Secção 15.3) e, se necessário, (2) uma arbitragem vinculativa de acordo com os termos deste Acordo de Arbitragem. Os Utilizadores e a Airbnb Payments mantêm o direito de procurar a resolução do litígio num tribunal de primeira instância como alternativa à arbitragem.
Pelo menos 30 dias antes de iniciar uma arbitragem, concorda, juntamente com a Airbnb Payments, em enviar à outra parte uma notificação individualizada do litígio por escrito ("Notificação Pré-Litígio") e tentar, de boa-fé, negociar uma resolução informal para a sua reclamação individual. A sua Notificação Pré-Litígio deve ser remetida para a Airbnb Payments através de envio para o agente da Airbnb de serviço: CSC Lawyers Incorporating Service, 2710 Gateway Oaks Drive, Suite 150N, Sacramento, Califórnia 95833. A Airbnb Payments enviará a Notificação Pré-Litígio para o endereço de e-mail associado à sua conta Airbnb. Uma Notificação Pré-Litígio tem de incluir: a data, o nome, a morada postal, o nome de utilizador da Airbnb, o endereço de e-mail que utilizou para criar a conta Airbnb, a assinatura, uma breve descrição do litígio e a compensação pedida. Se as partes não conseguirem resolver o litígio no período de 30 dias, só então qualquer uma delas poderá dar início à arbitragem, apresentando um pedido, por escrito, para tal à entidade de arbitragem designada nos termos da Secção 15.6, abaixo. A exigência de uma Pré-Notificação de Litígio do/a requerente é um pré-requisito para qualquer arbitragem e deve ser anexada uma cópia, além da prova de que foi enviada, a qualquer pedido de arbitragem, conforme exigido por esta Secção.
Concorda mutuamente com a Airbnb que qualquer disputa, reclamação ou controvérsia decorrente ou relacionada com estes Termos de Pagamento ou a sua aplicabilidade, incumprimento, cessação, validade, execução ou interpretação, ou qualquer utilização dos Serviços de Pagamento (coletivamente, "Litígios") será resolvida através de arbitragem vinculativa numa base individual (a "Convenção de Arbitragem"). As partes acordam que, em caso de disputa sobre a aplicabilidade ou execução desta Convenção de Arbitragem ao Litígio em questão, competirá ao árbitro decidir sobre esta questão. Para evitar dúvidas, as partes acordam que qualquer questão relativa à arbitrabilidade e à formação, execução, validade, âmbito ou interpretação da totalidade ou parte desta Cláusula 15, incluindo qualquer disputa sobre o cumprimento do requisito de Notificação Pré-Litígio e a responsabilidade de uma parte pelo pagamento das custas de arbitragem, será decidida por um árbitro.
Ambas as Partes concordam que as seguintes ações e/ou pretensões constituem exceções à Convenção de Arbitragem e deverão ser apresentadas no âmbito de um processo judicial perante um tribunal da jurisdição competente (conforme disposto na Secção 15): (i) qualquer reclamação ou ação em que se solicite a atribuição de uma medida cautelar de emergência com base em circunstâncias urgentes (por exemplo, perigo iminente ou prática de um crime, pirataria informática, ciberataque); (ii) pedido de atribuição de uma medida cautelar pública; (iii) qualquer reivindicação ou ação relacionada com um litígio vexatório; ou (iv) qualquer reivindicação individual de agressão sexual ou assédio sexual decorrente da sua utilização da Plataforma Airbnb ou dos Serviços de Hospedagem. Concorda, juntamente com a Airbnb Payments, que qualquer pedido de medida cautelar pública prosseguirá após a arbitragem de todas as reclamações, recursos ou causas de ação arbitráveis, e será suspenso enquanto se aguarda o resultado da arbitragem nos termos da secção 3 da Lei Federal de Arbitragem. ("Federal Arbitration Act").
Esta Convenção de Arbitragem prova que existe uma transação no comércio interestatal; é a Lei Federal de Arbitragem que regula toda a interpretação substantiva e processual e a aplicação desta Convenção de Arbitragem, e não a lei estatal. A arbitragem será administrada pela ADR Services, Inc. ("ADR") (www.adrservices.com) de acordo com a Regras 1, 6–7, 8–9, e 11–12, 45, 54, e 56 das Regras Federais de Processo Civil ("Regras Federais Selecionadas") (https://www.uscourts.gov/rules-policies/current-rules-practice-procedure/federal-rules-civil-procedure) e as Regras de Arbitragem da ADR então em vigor (as "Regras da ADR"), exceto se as Regras Federais Seleccionadas ou as Regras da ADR forem alteradas por ou entrarem em conflito com esta Convenção de Arbitragem. As Regras da ADR estão disponíveis em www.adrservices.com. Se for apresentado um requerimento de arbitragem aos Serviços da ADR de acordo com este contrato e com as Regras da ADR e estes não puderem ou não quiserem realizá-la, a arbitragem será realizada pela Associação Americana de Arbitragem ("AAA") segundo as Regras Federais Selecionadas e as Regras de Arbitragem de Consumo da AAA (as "Regras AAA") em vigor na altura, salvo nos casos aqui alterados. As Regras da AAA encontram-se disponíveis em www.adr.org. Se a AAA não puder e não quiser administrar a arbitragem, a Airbnb deve reunir consigo e escolher um foro arbitral alternativo; se não se conseguir alcançar um acordo, qualquer das partes pode pedir a um tribunal que nomeie um árbitro nos termos do parágrafo 5.º do artigo 9.º U.S.C.. Neste caso, a arbitragem será realizada de acordo com as regras do foro arbitral nomeado, a menos que essas regras sejam inconsistentes com as disposições desta Convenção de Arbitragem.
Para minimizar os custos da arbitragem e torná-la mais eficiente e apropriada, todas as audiências de arbitragem exigidas cujo montante em disputa não exceda (1) milhão de dólares norte-americanos (USD) devem ser realizadas remotamente por videoconferência, exceto se de outra forma acordado pelas Partes ou mediador determinado pelo árbitro. Qualquer audiência de arbitragem exigida, que seja necessária no âmbito de uma arbitragem em que o montante em disputa exceda 1,000,000 norte-americanos USD, deverá ser realizada no Estado de São Francisco, exceto se de outra forma acordado pelas partes ou indicado pelo árbitro. Se o valor em litígio for igual ou inferior a 10 000 USD, as partes acordam em proceder apenas mediante apresentação de documentos ao árbitro, sendo que este tem poder discricionário para realizar uma audiência em resposta a um pedido razoável e proporcional de uma das partes.
As taxas de arbitragem e a sua participação na remuneração do árbitro serão reguladas pelas Regras da ADR e pela tabela de taxas dos Serviços da ADR (disponível em www.adrservices.com). Se tiver um rendimento mensal bruto inferior a 300% das diretrizes federais de pobreza, tem direito a uma isenção de taxas e custos de arbitragem, excluindo as taxas do árbitro. Pode solicitar a dispensa do pagamento de taxas, apresentando ao prestador de serviços de arbitragem uma declaração sob juramento que indique qual o seu rendimento mensal e o número de pessoas que compõem o seu agregado familiar. A Airbnb pagará a sua parte das taxas de arbitragem desde que lhe apresente os documentos necessários que provem que o seu rendimento mensal bruto é inferior em 300% das diretrizes federais de pobreza, e se o prestador de serviços de arbitragem lhe conceder uma isenção do pagamento das taxas.
Qualquer uma das Partes pode solicitar que o árbitro imponha sanções se provar que a outra parte ou os seus advogados apresentaram uma reclamação ou defesa infundada de facto ou de direito, apresentada de má-fé ou com o objetivo de assédio, ou que seja leviana. Conforme permitido pela legislação aplicável, o árbitro imporá sanções equivalentes aos honorários e custos razoáveis dos advogados da parte requerente se concluir que uma reclamação ou defesa é infundada de facto ou de direito, apresentada de má-fé ou com o objetivo de assédio alegada em violação do Fed. R. Civ. P. 11(b) (tratar o árbitro como se fosse o "o tribunal"), ou de outra forma leviana. Qualquer uma das partes pode peticionar o indeferimento de qualquer arbitragem que seja apresentada em violação de qualquer disposição da presente Convenção de Arbitragem. Qualquer uma das partes pode apresentar um pedido de reconvenção durante a arbitragem pelo facto de a outra parte ter iniciado um processo relativo a um Litígio arbitrável sem cumprir ou em infração aos requisitos da presente Convenção de Arbitragem. Ao verificar que uma parte iniciou um processo relativo a um Litígio arbitrável sem cumprir ou de outra forma infringindo os requisitos da presente Convenção de Arbitragem, o árbitro atribuirá à outra parte os seus danos reais, incluindo, mas não se limitando, a honorários e custos razoáveis de advogados.
O árbitro emitirá uma decisão escrita que incluirá os fundamentos e as conclusões essenciais em que se baseou. O julgamento da decisão arbitral pode ser requerido perante qualquer tribunal da jurisdição competente. O árbitro pode conceder qualquer tutela permitida por lei ou pelas Regras da AAA, mas as medidas declarativas ou injuntivas só podem ser concedidas numa base individual e apenas na estrita medida do necessário para proporcionar uma proteção justificada à luz da ação individual do reclamante.
Reconhece e aceita, juntamente com a Airbnb Payments, que ambas as partes renunciam ao direito a um julgamento por tribunal de júri relativamente a todos os Litígios arbitráveis.
Ambas as Partes reconhecem e aceitam que cada uma delas, individualmente, renuncia, na máxima extensão permitida por lei, ao direito de participar como autor ou participante em qualquer eventual processo de ação coletiva, arbitragem coletiva, ação geral de interesse público promovido por um advogado particular ou qualquer outro procedimento representativo ou consolidado. Salvo acordo por escrito ou conforme previsto no presente contrato, o árbitro não pode consolidar as reclamações de mais do que uma parte e não pode presidir a qualquer forma de processo coletivo ou representativo. Se houver uma decisão judicial final que determine que a lei aplicável impede a aplicação da renúncia contida neste parágrafo quanto a qualquer reclamação, causa de ação ou recurso pedido, apenas estes serão separados desta convenção de arbitragem e serão apresentados ao tribunal da jurisdição competente. Ambas as Partes reconhecem e concordam que, se uma reclamação, causa de ação ou medida pedida for separada de acordo com este parágrafo, as reclamações, causas de ação ou medidas pedidas que não estejam sujeitas a arbitragem serão suspensas até que o árbitro decida todas as reclamações, causas de ação e medidas pedidas arbitráveis.
Ambas as Partes reconhecem e concordam que os benefícios e eficiências da arbitragem podem ser perdidos quando são apresentadas 100 ou mais ações arbitrais no prazo de 180 dias que (1) envolvam as mesmas partes ou partes com partes semelhantes; (2) se baseiem em ações idênticas ou semelhantes que decorram de transações, incidentes, alegadas infrações ou eventos idênticos ou substancialmente idênticos que exijam a conhecimento de questões de direito ou de facto idênticas ou substancialmente idênticas; e (3) envolvam o mesmo advogado ou advogados coordenados das partes ("Ação Coletiva"). Nestas circunstâncias, ambas as partes concordam em renunciar ao direito de ter qualquer Litígio administrado, arbitrado ou resolvido como parte de uma Ação Coletiva (embora as Secções 15 e 15.12 destes Termos continuem a aplicar-se ao Litígio). Em caso de Litígio, o árbitro nomeado para a primeira questão apresentada no âmbito de um conjunto de pedidos identificados por qualquer das partes decidirá se esses pedidos fazem parte de uma ação coletiva. Se ainda não tiver sido nomeado árbitro, deverá este ser nomeado apenas para decidir se as reclamações identificadas por qualquer uma das partes fazem parte de uma Ação Coletiva. Esta disposição não o impede a si ou à Airbnb Payments de participar numa resolução coletiva de reclamações.
Se, por qualquer razão, sem prejuízo da Secção 15.13, uma arbitragem prosseguir como parte de uma Ação Coletiva, as partes agruparão os pedidos de arbitragem em lotes não superiores a 200. Os blocos serão determinados por ordem alfabética dos reclamantes (por apelido ou designação comercial, conforme considerado aplicável) – por exemplo, os primeiros 200 reclamantes indicados serão o primeiro bloco, os 200 reclamantes seguintes serão o segundo bloco, e assim por diante. As partes atribuirão aleatoriamente a cada bloco um número sequencial e arbitrarão os blocos, um de cada vez, por ordem sequencial. Enquanto um bloco estiver a ser arbitrado, o prestador de serviços de arbitragem suspenderá os restantes, salvo acordo das partes em contrário ou mediante instruções do prestador de serviços de arbitragem. Cada bloco deve ser concluído no prazo de 240 dias a contar da conferência pré-audiência relativa a esse bloco. Sem prejuízo do exposto supra, se o pedido de qualquer reclamante não tiver sido objeto de uma conferência pré-audiência no prazo de 2 anos após o último pedido apresentado na Ação Coletiva, esse reclamante pode optar por apresentar as reclamações invocadas no seu pedido em tribunal, sujeito às Secções 14 e 15.12 destes Termos.
As partes aceitam e concordam que, no prazo mínimo de 10 dias antes da data marcada para a audiência de arbitragem, qualquer uma delas pode apresentar uma oferta de julgamento por escrito à outra parte para permitir o julgamento em termos específicos. Se a proposta for aceite, a oferta, acompanhada da prova de aceitação, será apresentada à entidade responsável pela arbitragem, que proferirá uma decisão em conformidade. Se a oferta não for aceite antes da audiência de arbitragem ou no prazo de trinta (30) dias após a sua apresentação, consoante o que ocorrer primeiro, será considerada como tendo sido retirada e não se pode utilizar como prova na arbitragem, exceto no que diz respeito aos custos (incluindo todas as taxas pagas à entidade responsável pela arbitragem). Caso uma das partes não aceite a oferta da outra e esta não consiga obter uma decisão mais favorável, a primeira parte não recuperará os seus custos posteriores à oferta e pagará também os custos da parte que fez a oferta (incluindo todas as taxas pagas à entidade responsável pela arbitragem) a partir do momento da oferta.
Com exceção do previsto na Secção 15.12, se alguma disposição desta Convenção de Arbitragem for considerada ilegal ou inaplicável, tal disposição será excluída e as restantes disposições da Convenção de Arbitragem permanecem em pleno vigor.
Se a Airbnb Payments alterar a presente Secção 15 após a data em que você aceitou pela última vez os presentes Termos de Pagamento (ou após a data em que aceitou quaisquer alterações posteriores aos mesmos), pode rejeitar a alteração se nos enviar uma notificação por escrito no prazo máximo de trinta (30) dias a contar da data em que a mesma entra em vigor. A sua notificação tem de incluir o nome, morada postal, data da notificação, nome de utilizador da Airbnb, endereço de e-mail que utilizou para criar a conta na Airbnb, assinatura e uma declaração explícita de que não pretende aceitar a Secção 15 alterada. Tem de enviar a notificação para esta morada: 888 Brannan St, São Francisco, CA 94103, Attn: Arbitration Opt-Out ou enviar um e-mail com a notificação da sua não aceitação para [email protected]. A não aceitação de uma nova alteração, no entanto, não revoga ou altera o seu consentimento prévio a quaisquer acordos anteriores para recurso à arbitragem em caso de qualquer Litígio entre si e a Airbnb Payments (ou o seu consentimento prévio a quaisquer alterações subsequentes), que permanecerão em vigor e aplicáveis a qualquer Litígio entre si e a Airbnb Payments.
Exceto nos termos do disposto na Secção 15.16 e sujeito ao disposto na Secção 13.7, a presente Secção 15 permanece em vigor após a cessação dos Termos de Pagamento e continua a aplicar-se mesmo que você deixe de utilizar os Serviços de Pagamento ou elimine a sua conta Airbnb.
Salvo se complementados por termos e condições, políticas, orientações ou normas adicionais, os presentes Termos de Pagamento constituem a versão integral do contrato entre si e a Airbnb Payments no que diz respeito ao seu objeto, substituindo todos e quaisquer anteriores entendimentos ou acordos verbais ou escritos entre si e a Airbnb Payments no que diz respeito ao acesso e utilização dos Serviços de Pagamento. Se qualquer disposição dos presentes Termos de Pagamento for considerada inválida ou inaplicável, tal disposição será removida e não afetará a validade e a aplicabilidade das restantes disposições.
O não-exercício de qualquer direito ou a não-invocação de qualquer disposição dos presentes Termos de Pagamento por parte da Airbnb Payments não constituirá uma renúncia a tal direito ou disposição, a menos que seja reconhecido e acordado por nós por escrito. Salvo disposição expressa nos presentes Termos de Pagamentos, o acionamento por qualquer uma das partes de qualquer um dos direitos ou meios de tutela, previstos nos presentes Termos de Pagamentos, não prejudica o acionamento de outros direitos ou meios de tutela previstos nos presentes Termos de Pagamentos ou de qualquer outra forma permitidas por lei.
Não pode ceder, transferir ou delegar este contrato e os seus direitos e obrigações ora previstos sem o consentimento prévio por escrito da Airbnb Payments. A Airbnb Payments pode ceder, transferir ou delegar este acordo e quaisquer direitos e obrigações, se assim o entender, com dois (2) meses de aviso prévio, desde que tal não reduza os seus direitos ou benefícios ao abrigo dos presentes termos.
Salvo disposição em contrário, quaisquer avisos ou outras comunicações permitidas ou exigidas ao abrigo do presente contrato serão feitas por escrito e entregues pela Airbnb Payments por e-mail ou por notificação da Plataforma Airbnb e, dependendo das suas configurações de notificações, através de um serviço de mensagens (incluindo SMS e WeChat). A data de receção será considerada a data em que a Airbnb Payments transmite o aviso.
Este contrato é celebrado no idioma estipulado nos Termos e todas as comunicações efetuadas durante a relação contratual serão feitas nesse idioma.
Esta Secção 17 aplica-se se estiver a celebrar um contrato com a Airbnb Payments UK. Em caso de conflito entre esta secção 17 e qualquer outra disposição dos presentes Termos de Pagamento, aplicam-se as disposições desta secção 17.
Os Serviços de Pagamento incluem o serviço de cobrança de pagamentos disponibilizado aos Anfitriões que celebrem contratos com a Airbnb Payments UK. O serviço de cobrança de pagamentos constitui um "serviço de pagamento" regulado no âmbito dos Regulamentos de Serviços de Pagamento 2017 e, para estes efeitos, a Airbnb Payments UK trata os Anfitriões como "utilizadores do serviço de pagamento".
Quando os Anfitriões aceitam os presentes Termos de Pagamento, autorizam a Airbnb Payments UK a proceder à emissão de Pagamentos a Anfitriões através do Métodos de Pagamentos a Anfitriões escolhido. Os Anfitriões podem alterar o Método de Pagamentos a Anfitriões até um (1) dia antes da hora acordada para os Pagamentos a Anfitriões, conforme definido na Secção 3.3. Considera-se que a Airbnb Payments UK recebeu a ordem de pagamento do Anfitrião na mesma data em que a Airbnb Payments UK concordar em iniciar os Pagamentos a Anfitriões de acordo com a Secção 3.3
A Airbnb Payments UK envidará esforços no sentido de garantir que os Anfitriões sediados neste país recebam os Pagamentos a Anfitriões até ao final do dia útil seguinte à emissão do referido pagamento pela Airbnb Payments UK.
Comunicação. A Airbnb Payments notificará os Anfitriões por e-mail quando os Pagamentos a Anfitriões sejam iniciados. Também enviaremos uma notificação para o endereço de e-mail registado dos Anfitriões se os Pagamentos a Anfitriões nos forem devolvidos devido a um erro. Os Anfitriões têm a responsabilidade de garantir que disponibilizam um endereço de e-mail atual, correto e válido.
Se os Anfitriões acreditarem ou tomarem conhecimento de que Pagamentos a Anfitriões que lhes eram devidos foram ou poderão ter sido desviados sem a respetiva autorização ("Pagamento Desviado") porque a palavra-passe ou outras credenciais de início de sessão na conta Airbnb ("Credenciais") se perderam, foram roubadas ou utilizadas indevidamente, devem notificar a Airbnb Payments UK (consulte a Secção 20 para saber sobre como o fazer) sem demora injustificada.
Se os Anfitriões alegarem que não receberam Pagamentos a Anfitriões que lhes eram devidos através do Método de Pagamentos a Anfitriões escolhido (incluindo no caso de um Pagamento Desviado), a Airbnb Payments UK irá (se os Anfitriões o pedirem, sem atrasos injustificados, ao tomarem conhecimento dos Pagamentos a Anfitriões não autorizados ou incorretamente emitidos e, em qualquer caso, no prazo de 13 meses após a sua ocorrência) envidar esforços imediatos para localizar os referidos pagamentos e informá-los do resultado. Sujeito à Secção 17.2.3, a menos que possamos provar que (i) os Pagamentos a Anfitriões foram recebidos por si através do Método de Pagamento a Anfitriões escolhido, ou (ii) que efetuámos os Pagamentos a Anfitriões corretamente utilizando as informações do Método de Pagamentos a Anfitriões que forneceu, mas as informações que forneceu estavam incorretas, reembolsaremos o montante. Se nos tiver oferecido informações incorretas, não seremos responsáveis pela execução defeituosa ou não execução do pagamento, no entanto, envidaremos esforços razoáveis para recuperar os fundos do pagamento.
Você deve utilizar as Credenciais conforme disposto nos presentes Termos de Pagamento e tomar todas as medidas razoáveis para as manter em segurança. Na qualidade de Anfitrião, poderá ser considerado responsável por perdas relacionadas com qualquer Pagamento Desviado que resultem da utilização de Credenciais perdidas, roubadas ou desviadas (incluindo a perda de um telemóvel no qual tenha instalado a Aplicação) ou caso não tenha conseguido manter as suas Credenciais seguras, até um máximo de 35 libras esterlinas. Isto não se aplica se a perda, roubo ou apropriação indevida das suas Credenciais não tiver sido detetável por si antes dos Pagamentos a Anfitriões, a menos que tenha agido de forma fraudulenta ou a perda tenha sido causada por atos ou omissões dos colaboradores da Airbnb ou de um prestador de serviços. No entanto, você pode ser responsável por todas as perdas relacionadas com um Pagamento Desviado se pudermos demonstrar que agiu de forma fraudulenta ou quando, com dolo ou negligência grave, não utilizou a Plataforma Airbnb e/ou os Serviços de Pagamento de acordo com os Termos ou os presentes Termos de Pagamento (incluindo a obrigação de manter as suas Credenciais seguras). Salvo nos casos em que tenha atuado de forma fraudulenta, você não será responsável por quaisquer perdas incorridas relativamente a um Pagamento Desviado que surjam após a sua notificação da perda, roubo ou apropriação indevida das suas Credenciais ou da utilização não autorizada das suas Credenciais, nos casos em que não tenhamos fornecido, em qualquer altura, os meios adequados para essa notificação, ou em que não exijamos uma autenticação forte do cliente, quando necessário.
Quaisquer reclamações sobre os Serviços de Pagamento devem ser apresentadas à Airbnb Payments UK (consulte a Secção 20 para saber como o fazer). Se não concordar com o resultado de uma reclamação e, na qualidade de Anfitrião, tiver recebido Serviços de Pagamento regulamentados da Airbnb Payments UK, também poderá apresentar a sua reclamação ao Provedor de Justiça Financeiro. Todas as queixas ao Serviço do Provedor de Justiça Financeiro estão sujeitas às regras do Serviço do Provedor de Justiça Financeiro, incluindo relativamente aos requisitos de elegibilidade. Esta Secção 18 aplica-se se estiver a celebrar um contrato com a Airbnb Payments Luxembourg. Em caso de conflito entre a presente Secção 18 e qualquer outra disposição dos presentes Termos de Pagamento, aplicam-se as disposições da presente Secção 18.
Os Serviços de Pagamento incluem o serviço de pagamento disponibilizado aos Anfitriões que celebram contratos com a Airbnb Payments Luxembourg. Os serviços constituem os "serviços de pagamento" regulados ao abrigo da versão alterada da Lei de 10 de novembro de 2009 sobre serviços de pagamento ("Lei de 2009") e, para este efeito, a Airbnb Payments Luxembourg trata os Anfitriões como "utilizadores do serviço de pagamento", nos termos da Lei de 2009.
Quando os Anfitriões aceitam os presentes Termos de Pagamento, autorizam a Airbnb Payments Luxembourg a proceder à emissão de cada um dos Pagamentos a Anfitriões através do Método de Pagamentos a Anfitriões que escolheu. Os Anfitriões podem alterar o Método de Pagamentos a Anfitriões até um (1) dia antes da hora acordada para os Pagamentos a Anfitriões, conforme definido na Secção 3.3. Considera-se que a Airbnb Payments Luxembourg recebeu a ordem de pagamento do Anfitrião na mesma data em que a Airbnb Payments Luxembourg concordar em iniciar os Pagamentos a Anfitriões de acordo com a Secção 3.3
As Partes concordam que as disposições legais relativas à forma e ao procedimento para autorizar o início de uma ordem de pagamento ou a execução de uma operação de pagamento, bem como as relativas à anulação dessa autorização, conforme disposto nos artigos 81.º e 93.º da Lei de 2009, se aplicam em todos os momentos.
A Airbnb Payments Luxembourg procurará assegurar que os Anfitriões sediados no EEE recebam cada um dos Pagamentos a Anfitriões até ao final do dia útil seguinte ao início do processo de Pagamentos a Anfitriões.
Comunicação. A Airbnb Payments notificará os Anfitriões por e-mail quando os Pagamentos a Anfitriões sejam iniciados. Também enviaremos uma notificação para o endereço de e-mail registado dos Anfitriões se os Pagamentos a Anfitriões nos forem devolvidos devido a um erro. Os Anfitriões têm a responsabilidade de garantir que disponibilizam um endereço de e-mail atual, correto e válido.
Sem prejuízo do disposto no Artigo 1341.º do Código Civil, a Airbnb Payments terá, sempre que útil ou necessário, o direito de provar as suas alegações por qualquer meio legalmente admissível em questões comerciais, como declarações de testemunhas, declarações ajuramentadas, registos eletrónicos e quaisquer outros documentos adequados.
Se os Anfitriões considerarem ou tomarem conhecimento de que um dos Pagamentos a Anfitriões que lhes era devido foi ou pode ter sido desviado sem autorização ("Pagamento Desviado") porque a palavra-passe ou outras credenciais de início de sessão na conta Airbnb ("Credenciais") se perderam ou foram roubadas, ou no caso de uma transação de pagamento não autorizada, incorretamente iniciada ou incorretamente executada, devem notificar imediatamente a Airbnb Payments Luxembourg conforme disposto na Secção 20. Você deve notificar a Airbnb Payments imediatamente após tomar conhecimento e, o mais tardar, 13 meses após a data de débito dos Pagamentos a Anfitriões não autorizado ou incorretamente executado. No caso de uma transação de pagamento não autorizada, a Airbnb Payments procederá ao reembolso do respetivo valor até ao final do dia útil seguinte após ter constatado a transação ou, de acordo com a Secção 20, ter sido notificada da mesma. A Airbnb Payments não tem essa obrigação se tiver motivos razoáveis para suspeitar de fraude. Você será obrigado a suportar as perdas relacionadas com um Pagamento não autorizado até 50 euros quando esses Pagamentos a Anfitriões não autorizados resultarem da perda, roubo ou da apropriação indevida das suas Credenciais. Você não será obrigado a suportar as perdas se: (a) a perda, roubo ou apropriação indevida das suas Credenciais não tiver sido detetada antes de cada um dos Pagamentos a Anfitriões, exceto se tiver agido de forma fraudulenta; ou (b) a perda tiver sido causada por atos ou falta de ação da Airbnb Payments. Você será responsável por todas as perdas incorridas em relação a Pagamentos a Anfitriões efetuado pela Airbnb Payments que não tenha sido autorizado por si quando tenha agido de forma fraudulenta ou não tenha notificado a Airbnb Payments atempadamente de acordo com esta secção e a Secção 20. Após notificar a Airbnb da perda roubo ou apropriação indevida das suas Credenciais, de acordo com esta secção e a Secção 20, não terá de suportar as respetivas consequências financeiras.
Não seremos responsáveis por qualquer perda resultante de: (i) Pagamentos Desviados, se tiver agido de forma fraudulenta ou se, devido a dolo ou negligência grave, não tiver utilizado a Plataforma Airbnb e/ou os Serviços de Pagamento conforme disposto nos Termos ou nos presentes Termos de Pagamento (incluindo a obrigação de manter as Credenciais em segurança); (ii) se a Airbnb Payments lhe apresentar provas de que recebeu o valor integral dos Pagamentos a Anfitriões, pessoalmente ou através da sua entidade de serviços de pagamento, de forma atempada, ou (iii) qualquer transação de pagamento que facilitámos de acordo com informações que apresentou, quando as mesmas estavam incorretas. Nestas circunstâncias, você pode solicitar à Airbnb Payments que se esforce, utilizando os meios adequados disponíveis, por recuperar o valor do pagamento. Se a recuperação do montante do pagamento não for possível, a Airbnb Payments fornecer-lhe-á, mediante pedido por escrito, todas as informações de que disponha e que sejam relevantes para si com a finalidade de adotar medidas tendo em vista o reembolso do montante. A Airbnb Payments pode cobrar uma taxa por esta recuperação.
Se os Anfitriões alegarem que não receberam Pagamentos a Anfitriões que lhes eram devidos através do Método de Pagamentos a Anfitriões escolhido, a Airbnb Payments Luxembourg irá (mediante pedido) envidar esforços imediatos para localizar o pagamento e informá-los sobre o resultado.
Qualquer reclamação, nomeadamente relacionada com perda, roubo, extravio ou utilização não autorizada relacionada com os Serviços de Pagamento ou com transações não autorizadas ou incorretas, deverá ser feita por escrito para a Airbnb Payments Luxembourg, conforme definido na Secção 20. Se os Anfitriões não estiverem satisfeitos com o resultado de uma reclamação e tiverem recebido Serviços de Pagamento regulamentados da Airbnb Payments Luxembourg, podem apresentar os seus pedidos à autoridade de supervisão da Airbnb Payments Luxembourg, a CSSF (conforme definido na Secção 20), no prazo de um ano após terem apresentado as suas reclamações à Airbnb Payments Luxembourg. A CSSF atuará como entidade extrajudicial para a resolução de reclamações. O pedido deve ser submetido à CSSF por escrito, através de correio normal ou e-mail para o endereço relevante disponível no site da CSSF ou online no site da CSSF. O pedido deverá ser submetido em inglês, francês, alemão ou luxemburguês. O pedido deverá ser apoiado por uma declaração das razões na qual se baseia, juntamente com os seguintes documentos:
Independentemente qualquer estipulação em contrário nos presentes Termos de Pagamento, para evitar dúvidas relacionadas com os Hóspedes residentes em França, o Preço Total, prestações ou pagamentos periódicos, incluindo os Pagamentos Recorrentes, que a Airbnb Payments recolhe destes Hóspedes, são considerados adiantamentos ("acomptes") no âmbito da lei francesa.
Utilizamos vários prestadores de serviços (alguns pertencentes ao grupo Airbnb e outros que são prestadores de serviços terceiros) no contexto de acordos de subcontratação para nos ajudar a fornecer os nossos serviços de forma eficiente e qualitativa. A utilização destes prestadores de serviços exige que lhes transfiramos ou disponibilizemos alguns dados. Você concorda com tais acordos de subcontratação e dá-nos instruções para transferir ou tornar acessíveis dados (conforme definido abaixo) relativos a si e, quando relevante, relativos a pessoas ligadas a si (fornecidos em ligação com a sua conta Airbnb), tais como os seus beneficiários efetivos e representantes, a vários prestadores de serviços no contexto de acordos de subcontratação relativos a questões técnicas (incluindo TI), operacionais, processamento de pagamentos, controlo interno, diligência devida do cliente (incluindo verificações de antecedentes ou situações relacionadas com a polícia), prevenção de fraudes, avaliação de riscos, desenvolvimento de produtos, manutenção e depuração, publicidade, processamento de pedidos de indemnização de seguros, apoio ao cliente e outros serviços. Os dados a transferir ou a tornar disponíveis incluem, se for uma pessoa singular, o seu apelido, nome próprio, morada, data e local de nascimento e nacionalidade e, se for uma pessoa coletiva, a sua denominação social, sede social, forma jurídica, número de registo para as pessoas coletivas, bem como os dados supramencionados sobre as pessoas singulares para os seus beneficiários efetivos e representantes. Os dados a transferir ou a tornar disponíveis incluem também, para qualquer pessoa, os respetivos dados de contacto, como números de telefone e endereços de e-mail, bem como dados financeiros e dados de utilização relacionados com os nossos serviços (incluindo método de pagamento, transação de pagamento). Os destinatários dos dados estão localizados nos Estados Unidos, Reino Unido, Irlanda, Índia, Luxemburgo, Países Baixos, Alemanha e Espanha, bem como noutros países da Europa, Ásia-Pacífico e América do Norte e do Sul. Tais transferências de dados ocorrerão durante todo o prazo da relação comercial entre si e nós, bem como por um período adicional, conforme permitido por lei após o final da relação comercial. Você reconhece que os dados transferidos deixaram de estar protegidos pelo sigilo profissional luxemburguês após a sua transferência.
Os parágrafos que se seguem são também aplicáveis caso utilize os Serviços de Pagamento na qualidade de representante ("Representante") de uma empresa, sociedade ou outra entidade jurídica (caso em que, para efeitos dos Termos de Pagamento "o utilizador/a" e "seu/sua" se referem e aplicam à empresa, sociedade ou outra entidade jurídica em causa).
Você aceita os Termos de Pagamento e será responsável por qualquer ato ou omissão dos funcionários ou agentes externos que utilizem os Serviços de Pagamento em seu nome.
Você declara, juntamente com o seu Representante, que estão autorizados a facultar as informações descritas nas Secções 2.1 e 3.2 e que o seu Representante tem autoridade para vincular a sua empresa aos presentes Termos de Pagamento. Poderemos pedir-lhe que forneça informações ou documentação adicionais que comprovem a autoridade do Representante.
Você declara e garante-nos que: (i) a sua empresa está devidamente constituída, registada e em situação regularizada no que toca às respetivas obrigações nos termos da legislação do país em que se encontra registada e que está a proceder ao registo para poder usufruir dos Serviços de Pagamento; e (ii) tem todos os direitos, poderes e autoridade necessários para celebrar o presente contrato, cumprir as suas obrigações e conceder os direitos, licenças e autorizações do mesmo.
Se você utilizar o seu Método de Pagamento em benefício de trabalhadores ou outros terceiros autorizados no âmbito da Airbnb para Trabalho, conforme permitido pela sua conta, autoriza a Airbnb Payments a debitar as reservas pedidas pelos trabalhadores da sua empresa ou outros terceiros autorizados no seu Método de Pagamento.
No que diz respeito a qualquer Método de Pagamentos a Anfitriões associado à sua conta Airbnb, autoriza a Airbnb Payments a armazenar o Método de Pagamentos a Anfitriões, a remeter os pagamentos das reservas associadas à sua conta Airbnb através do mesmo e a tomar qualquer outra medida prevista nos Termos de Pagamento relativamente ao Método de Pagamentos a Anfitriões.
Se você tratar, armazenar ou de outro modo processar informações de cartões de pagamento em nome de outras pessoas ou de terceiros, aceita cumprir sempre os requisitos aplicáveis em matéria de privacidade e segurança de dados previstos na atual Norma de Segurança de Dados do Setor de Cartões de Pagamento no que diz respeito à utilização, acesso e armazenamento das referidas informações de cartões de crédito. These Payments Terms of Service for users outside of the UK, Europe and Australia (“Payments Terms”) are a binding legal agreement between you and Airbnb Payments that govern the Payment Services (defined below) conducted through or in connection with the Airbnb Platform. When these Payments Terms mention “Airbnb Payments,” “we,” “us,” or “our,” it refers to the Airbnb Payments company you are contracting with for Payment Services.
Airbnb Payments provides payments services to Members publishing, offering and booking Accommodations, Services, Experiences or other Host Services, including services in connection with Airbnb.org and other current and future services provided via the Airbnb Platform. These payment services are provided for the benefit of Hosts and may include (if available) the following (collectively, “Payment Services”):
In order to use the Payment Services, you must be at least 18 years old, must have an Airbnb account in good standing in accordance with the Airbnb Terms of Service (“Terms”), and must keep your payment and personal information accurate and complete.
Payment Services will be provided by the contracting entity based on your country of residence subject to any exceptions described below:

If you change your country of residence, the Airbnb company you contract with and the applicable version of the Payments Terms will be determined by your new country of residence from the date on which your country of residence changes. Please note, however, that the Airbnb Payments company with whom you contract will stay the same for all bookings made prior to your change of residence.
The Terms separately govern your use of the Airbnb Platform. Capitalized terms not defined in these Payments Terms have the meaning ascribed to them in the Terms.
By using the Payment Services, you agree to comply with these Payments Terms. Airbnb Payments may temporarily limit or suspend your access to or use of the Payment Services, or its features, to carry out maintenance measures that ensure the proper functioning of the Payment Services. Airbnb Payments may improve, enhance and modify the Payment Services and introduce new Payment Services from time to time. Airbnb Payments will provide notice to Members of any changes to the Payment Services, unless such changes do not materially increase the Members’ contractual obligations or decrease the Members’ rights under these Payments Terms.
The Payment Services may contain links to third-party websites or resources (“Third-Party Services”). Such Third-Party Services are subject to different terms of service and privacy policies, and Members should review them. Airbnb Payments is not responsible or liable for the use of such Third-Party Services. Links to any Third-Party Services are not an endorsement by Airbnb Payments of those Third-Party Services.
Airbnb Payments may enable features that allow you to authorize other Members or third parties to take certain actions that affect your Airbnb account. You may authorize a third party to use your Airbnb account if the feature is enabled for your Airbnb account. You acknowledge and agree that anyone you authorize to use your Airbnb account may use the Payment Services on your behalf and that you will be responsible for any payments made by such person.
You authorize Airbnb Payments, directly or through third parties, to make any inquiries we consider necessary to verify your identity and information you provide, and if applicable, verifying the identity of the representative(s) and beneficial owner(s). This may include (i) screening you and, if applicable, your representative(s) and beneficial owner(s) against third-party databases or other sources, (ii) requesting reports from service providers, (iii) asking you and, if applicable, your representative(s) and beneficial owner(s) to provide a form of government identification (e.g., driver’s license or passport) to check your name, place and date of birth, your address, nationality and/or other information which we deem necessary under applicable laws; or (iv) requiring you to take steps to confirm ownership of your email address, Payment Method(s) or Payout Method(s). Airbnb Payments reserves the right to terminate, suspend, or limit access to the Payment Services in the event we are unable to obtain or verify any of this information.
Your access to or use of certain Payment Services may be subject to, or require you to accept, additional terms and conditions. If there is a conflict between these Payments Terms and terms and conditions applicable to a specific Payment Service, the latter terms and conditions will take precedence with respect to your use of or access to that Payment Service, unless specified otherwise.
When you add a Payment Method to your Airbnb account, you will be asked to provide billing information such as name, billing address, and financial instrument information either to Airbnb Payments or its third-party payment processor(s). You authorize Airbnb Payments and its payment service providers to collect and store your Payment Method information.
When you add or use a Payment Method, Airbnb Payments may verify the Payment Method by (i) authorizing your Payment Method for one or two nominal amounts via a payment service provider, and asking you to confirm those amounts, or (ii) requiring you to upload a billing statement. We may, and retain the right to, initiate refunds of these amounts from your Payment Method. When you add a Payment Method during checkout, we will automatically save and add that Payment Method to your Airbnb account so it can be used for a future transaction. You may not remove the Payment Method associated with a reservation during the period commencing from the date of your booking and ending fourteen (14) days following your check-out date, nor during any additional period of time needed to resolve any outstanding Damage Report associated with such booking. When you add or use your bank account as a Payment Method (as available in the US), your bank account must be able to accept debits denominated in USD.
You allow Airbnb Payments to charge your Payment Method (including charging more than one Payment Method), either directly or indirectly, for all fees due (including any applicable taxes) in connection with your Airbnb account, including Damage Report amounts in accordance with the Terms and with Section 6. When you pay using your bank account, you authorize Airbnb Payments to debit your bank account according to the payment schedule shown at checkout. You also authorize Airbnb Payments to further debit or credit your bank account to correct any erroneous debit, make necessary adjustments to your payment, or to issue a refund back to your bank account.
If your Payment Method’s account information changes (e.g., account number, routing number, expiration date) as a result of re-issuance or otherwise, we may acquire that information from our financial services partners or your bank and attempt to automatically update your Payment Method on file.
Airbnb Payments generally charges the Total Price due after the Host accepts your booking request. However, if you pay with a push Payment Method (such as Sofort), Airbnb Payments will collect the Total Price due at the time of your booking request or after the Host accepts your booking request. Airbnb may offer alternative options for the timing and manner of payment. Any additional fees for using those alternative payment options will be displayed via the Airbnb Platform and included in the Total Price, and you agree to pay such fees by selecting the payment option. Additional terms and conditions may apply for the use of an alternative payment option. If Airbnb Payments is unable to collect the Total Price due, as scheduled, Airbnb Payments will collect the Total Price due at a later point in accordance with Section 5.3. Once the payment for your requested booking is successfully completed, you will receive a confirmation email.
The currencies available to make payments may be limited for regulatory or operational reasons based on factors such as your selected Payment Method, your country of residence, and/or your Airbnb Payments contracting entity(ies). Any such limitations will be communicated via the Airbnb Platform, and you will be prompted to select a different currency or Payment Method if your preferred currency is not available.
Note that if the country in which your Airbnb Payments contracting entity is located is different than the country of your Payment Method provider, or your selected currency is different than your Payment Method's billing currency, your payment may be processed outside of your country of residence. As a result, your Payment Method provider may impose certain fees and the amount listed on your Payment Method statement may be different from the amount shown at checkout. For example, if you make a booking using a U.S. issued card, but select Euro as your currency, your payment may be processed outside the U.S., and banks and credit card companies may impose international transaction fees and foreign exchange fees. In addition, if you select to pay with a currency that is different than your Payment Method's billing currency, your bank or credit card company may convert the payment amount to your billing currency associated with your Payment Method, based on an exchange rate and fee amount determined solely by your bank. Airbnb Payments is not responsible for any such fees and disclaims all liability in this regard. Please contact your Payment Method provider if you have any questions about these fees or any exchange rate imposed by your Payment Method provider.
If a requested booking is declined because it is not accepted by the Host, you cancel the booking request before it is accepted by the Host, or Airbnb cancels the booking, any amounts collected by Airbnb Payments and due to you pursuant to the policies described in Section 5.5, will be refunded to you, and any pre-authorization of your Payment Method will be released (if applicable) in accordance with Section 5.5.2
Airbnb Payments reserves the right to decline or limit payments that we believe (i) may violate Airbnb Payments’ risk management policies or procedures, (ii) may violate these Payments Terms or the Terms, (iii) are unauthorized, fraudulent or illegal; or (iv) expose you, Airbnb, Airbnb Payments, or others to risks unacceptable to Airbnb Payments.
Payment Methods may involve the use of third-party payment service providers. These payment service providers may charge you additional fees when processing payments in connection with the Payment Services, and Airbnb Payments is not responsible for any such fees and disclaims all liability in this regard. Airbnb Payments is not responsible for any loss suffered by you as a result of incorrect Payment Method information provided by you.
2.11.1.1
Airbnb may make available to Guests the option to request that a portion of the booking’s Total Price is due and payable at the time of booking and the remainder at a later time prior to check-in (“Pay Part Now, Part Later”). Availability of this option may depend on the Listing and/or Payment Method. You will not be charged any additional fees for using Pay Part Now, Part Later. Note that failure to pay each portion by the relevant due date may result in your booking being canceled.
2.11.1.2
If you choose Pay Part Now, Part Later, the Airbnb Platform will notify you during check out of the amount, currency and schedule of when each portion of the Total Price is due and payable. Airbnb credits, coupons, or gift cards will be applied first before the amount of each portion is calculated. On the relevant due date, Airbnb Payments will automatically charge the original Payment Method you used to make the booking.
2.11.1.3
If you make a modification to a booking made with Pay Part Now, Part Later, Airbnb will notify you of the revised dates on which portions of the Total Price will be due and payable, as applicable, and Airbnb Payments will automatically charge the original Payment Method you used to make the booking on the revised due dates. If the modification increases your Total Price, you may be required to pay for an additional portion of the new Total Price at the time of the modification.
2.11.1.4
You agree that by selecting a Pay Part Now, Part Later, you may not be able to pay for the booking with a different Payment Method or pay your portions on different dates.
2.11.1.5
If Airbnb Payments is unable to collect your payment, Airbnb Payments will notify you of such declined payment, and require you to complete payment of the relevant portion using an alternative Payment Method within 72 hours of the notice. If you fail to pay a portion of the Total Price on the due date for payment, you authorize Airbnb to cancel the booking on your behalf. The Host’s cancellation policy will determine the amount of your refund, if any, if your booking is canceled.
2.11.2.1
Airbnb may make available to Guests the option to book an accommodation and request that the Total Price is due and payable at a later time prior to check-in (“Reserve Now, Pay Later”). If your booking is eligible for Reserve Now, Pay Later, the Airbnb Platform will provide you with this option at checkout. You will not be charged any additional fees for using Reserve Now, Pay Later. Note that failure to pay the Total Price by the relevant due date may result in your booking being canceled.
2.11.2.2
If you choose Reserve Now, Pay Later, the Airbnb Platform will notify you during checkout of the amount, currency and when the payment of the Total Price is due and payable. On the relevant due date, Airbnb Payments will automatically charge the original Payment Method you used to make the booking. If you choose to change your payment method before the payment is due and payable, you can do so by going to “Payments History” and updating the original Payment Method you used for the booking.
2.11.2.3
You authorize and grant Airbnb Payments a mandate to collect all amounts due and payable from you pursuant to these Section 2.11.2 by charging the Payment Method used to make the booking or otherwise as permitted pursuant to these Payments Terms.
2.11.2.4
If you make a modification to a booking made with Reserve Now, Pay Later, and the modification increases your Total Price, you may be required to pay for an additional portion of the new Total Price at the time of the modification.
2.11.2.5
If Airbnb Payments is unable to collect your payment, Airbnb Payments will notify you of such declined payment, and require you to complete payment using an alternative Payment Method within 72 hours of the notice. If you fail to complete payment on the due date, you authorize Airbnb to cancel the booking on your behalf. The Host’s cancellation policy will determine the amount of your refund, if any, if your booking is canceled.
2.11.3.1
For certain bookings (such as for Accommodation bookings of twenty-eight (28) nights or more), Airbnb Payments may require a Guest to make recurring, incremental payments toward the Total Price owed (“Recurring Payments”). More information on Recurring Payments (including the amount and the frequency of payments) will be made available via the Airbnb Platform if applicable to a booking.
2.11.3.2
If Recurring Payments apply to a confirmed booking, then the Guest authorizes Airbnb Payments to collect the Total Price due.
2.11.3.3
Guests may stop a Recurring Payment by notifying Airbnb Payments orally or in writing at least three (3) business days before the scheduled date of the payment. Airbnb Payments may require you to give written confirmation of a stop-payment order within fourteen (14) days of an oral notification. If you fail to provide written confirmation within those fourteen (14) days, Airbnb Payments is not obligated to honor your request to stop any future Recurring Payments. If you have any questions regarding your Recurring Payments, please contact Airbnb Payments.
Guests may from time to time be offered the possibility to pay for an Accommodation on credit or other installment options, and pay for them over time ('buy now, pay later'). These Payment Methods are provided by Klarna Bank AB (or its affiliate), not Airbnb, and Klarna will become your creditor for the payment, subject to additional terms of use provided at checkout. Depending on the Payment Method, this will also create a separate relationship between you as the borrower and Klarna as the lender. Please review any applicable additional terms before using these Payment Methods.
Airbnb Payments generally collects the Total Price of a booking at the time the Guest’s booking request is accepted by the Host, unless noted otherwise.
In order to receive a Payout you must have a valid Payout Method linked to your Airbnb account. When you add a Payout Method to your Airbnb account, you may be asked to provide additional information such as name, government identification, tax ID, billing address, and financial instrument information either to Airbnb Payments or its third-party payment processor(s). Depending on the Payout Method selected additional information may be required, such as: residential address, name on the account, account type, routing number, account number, email address, payout currency, identification number and account information associated with a particular payment processor. Providing requested information is required for a Payout Method to be valid. The information Airbnb Payments requires for a valid Payout Method may change, and Airbnb Payments may request additional information at any time; failing to provide requested information may result in Airbnb Payments temporarily placing a hold, suspending, or canceling any Payout until the information is provided and, if necessary, validated. You authorize Airbnb Payments to collect and store your Payout Method information in accordance with Airbnb’s Privacy Policy. Airbnb Payments may also share your information with governmental authorities as required by applicable law.
Unless you are Host covered under Section 3.3.3 (in which case that Section applies to you), then, subject to and conditional upon successful receipt of the payments from Guest, Airbnb Payments will initiate Payouts to your selected Payout Method: (i) for Accommodations, by the end of the business day after the Guest’s scheduled check-in date; (ii) for Services and Experiences, by the end of the business day after the start of the Service or Experience; and (iii) for all other Host Services, including but not limited to Photography Services or Experiences, at the time specified via the Airbnb Platform. For Accommodation bookings of twenty-eight (28) nights or more, Airbnb Payments will initiate the first payout by the end of the business day after the Guest’s scheduled check-in date, and will initiate future payouts every 30 days after the initial payout, for the duration of the reservation.
Airbnb Payments may offer you a different Payout time or trigger for payment, which may be subject to additional terms and conditions. The time it takes to receive Payouts once released by Airbnb Payments may depend upon the Payout Method you select.
For Accommodations only, for:
subject to and conditional upon successful receipt of the associated payments from Guest, Airbnb Payments will initiate Payouts to your selected Payout Method by the end of the business day after the Guest’s scheduled check-out date. If the Accommodation booking is twenty-eight (28) nights or more, Airbnb Payments will generally initiate the first and second Payout together, 28 days after the Guest’s scheduled check-in date, and will initiate future Payouts monthly after that for the duration of the reservation.
Your Payout schedule will be displayed in your earnings dashboard.
Your Payout for a booking will be the Total Price less applicable fees like Airbnb service fees and applicable taxes, and any amounts you agree to allocate to any co-host, or the owner(s) of an Accommodation, a homeowners’ association, and/or their agent (such as a building operator or property management company). In the event of cancellation of a confirmed booking, Airbnb Payments will remit the amount you are due (if any) as provided in the Terms and applicable cancellation policy.
Airbnb Payments may temporarily place a hold, suspend, or cancel any Payout for purposes of preventing unlawful activity or fraud, risk assessment, security, or completing an investigation; or if we are unable to verify your identity, or to obtain or verify requested information. Furthermore, Airbnb Payments may temporarily place a hold on, suspend, or delay initiating or processing any Payout due to you under the Terms as a result of high volume Booking cancellations or modifications arising from a Force Majeure Event (as defined below).
Airbnb Payments will remit your Payouts in the currency applicable to your selected Payout Method. The currencies available may be limited for regulatory or operational reasons based on factors such as your selected Payout Method, your country of residence, and/or your Airbnb contracting entity(ies). Any such limitations will be communicated via the Airbnb Platform, and you will be prompted to select a different currency or Payout Method. Note that payment service providers may impose transaction, currency conversion or other fees based on the currency or Payout Method you select, and Airbnb Payments is not responsible for any such fees and disclaims all liability in this regard.
For compliance or operational reasons, Airbnb Payments may limit the amount of a Payout. If you are due an amount above that limit, Airbnb Payments may make a series of Payouts (potentially over multiple days) in order to provide your full Payout amount.
Payout Methods may involve the use of third-party payment service providers. These payment service providers may charge you additional fees when processing Payouts in connection with the Payment Services (including deducting charges from the Payout amount), and Airbnb Payments is not responsible for any such fees and disclaims all liability in this regard. Your Payout Method may also be subject to additional terms of use from such third-party payment service providers. Please review them before using your Payout Method.
Airbnb Payments may combine amounts that it collects from Guests and invest them as permitted under applicable laws. Airbnb Payments will retain any interest it earns on those investments.
Airbnb Payments is not responsible for any loss suffered by you as a result of incorrect Payout Method information provided by you.
If you provide Host Services jointly with one or more other Hosts as part of a team, business or other organization (“Host Team”), Airbnb may make available to such Hosts the option to allocate between the members of the Host Team the total Host Payout for a booking. Airbnb Payments will execute such payments at the instruction of one or more members of the Host Team and is not responsible for any losses related to errors or omissions made by the Hosts in providing such payment instructions.
3.11.2.1
Certain Hosts may be eligible to receive a Payout via a virtual credit card (“VCC”). If a Payout is being made via a VCC to a Host, Airbnb Payments will provide you with a VCC number for each reservation and the amount authorized. Each VCC will be able to be charged 24 hours prior to the Guest’s scheduled check-in time (or 24 hours prior to 3:00 pm local time - or 3:00 pm UTC if local time is unknown - if the check-in time is flexible or not specified), and will expire 180 days after the Guest’s scheduled check-in time.
3.11.2.2
As a condition precedent to Airbnb Payments’ obligation to pay you for reservations, you agree to charge each VCC no earlier than one day before check-in for the reservation and no later than 180 days following check-in, and any failure to charge the VCC shall serve as confirmation from you that no amount is due by Airbnb Payments to you (e.g., due to Guest cancellation or other adjustment), and Airbnb Payments may retain any amounts paid by the Guest to Airbnb Payments as additional consideration for Airbnb Payments’ facilitation costs. You acknowledge and agree that Airbnb Payments generally has no knowledge of events occurring during a Reservation (e.g., a Guest’s actual arrival or departure dates, or cancellations or any other adjustments to a Reservation negotiated between you and the Guest), and that consequently Airbnb Payments is entitled to rely upon and accept as accurate and dispositive of the amount due any charge you make to the VCC.
3.11.2.3
If you improperly use or overcharge a VCC, or if, after you have charged a VCC, a Guest cancels a reservation and/or is otherwise due a refund under an applicable cancelation policy, you agree to refund the VCC if requested by Airbnb Payments. You acknowledge that Airbnb Payments is entitled to recover any amounts due to Airbnb Payments by any other means permitted under these Payments Terms and/or by initiating a chargeback to you.
3.11.2.4
You will be solely responsible for collecting any payment directly from Guests for any incidentals or any upgrades requested by Guests once at your property. You agree not to honor any Guest requests that may result in Airbnb Payments refunding any portion of the Total Price without first confirming with Airbnb Payments that such requests are acceptable.
3.11.2.5
Airbnb Payments shall have the right, within one (1) year after the date that the VCC is charged with respect to any Guest reservation, to audit the VCC charge and request documentation from you that supports the amount charged. If Airbnb Payments does not exercise this right within such period, then the VCC charge shall be deemed to be correct. If you are unable to provide sufficient documentation to support a VCC charge, then Airbnb Payments shall have the right to initiate a chargeback to you and/or recover the amount by any other means permitted under these Payments Terms.
If a Guest in Germany chooses to pay for an Accommodation Reservation using a Klarna ‘buy now, pay later’ option (other than a Pay-in-3 option), these additional Host terms apply.
Each Host, including each Host Team member, hereby appoints Airbnb Payments as the Host’s payment collection agent solely for the limited purpose of accepting and processing funds from Guests purchasing Host Services on the Host’s behalf.
Each Host, including each Host Team member, agrees that payment made by a Guest through Airbnb Payments, shall be considered the same as a payment made directly to the Host, and the Host will provide the Host Service booked by the Guest in the agreed-upon manner as if the Host has received the payment directly from the Guest. Each Host agrees that Airbnb Payments may refund the Guest in accordance with the Terms. Each Host understands that Airbnb Payments’ obligation to pay the Host is subject to and conditional upon successful receipt of the associated payments from Guest. Airbnb Payments guarantees payments to Host(s) only for such amounts that have been successfully received by Airbnb Payments from Guests in accordance with these Payments Terms. In accepting appointment as the limited payment collection agent of the Host, Airbnb Payments assumes no liability for any acts or omissions of the Host.
Each Guest acknowledges and agrees that, notwithstanding the fact that Airbnb Payments is not a party to the agreement between you and the Host(s), including each Host Team member, Airbnb Payments acts as each Host’s payment collection agent for the limited purpose of accepting payments from you on behalf of the Host(s). Upon a Guest’s payment of the funds to Airbnb Payments, the Guest’s payment obligation to the Host(s) for the agreed upon amount is extinguished, and Airbnb Payments is responsible for remitting the funds successfully received by Airbnb Payments to the Host(s) in the manner described in these Payments Terms. In the event that Airbnb Payments does not complete the provision of the Payment Services and remit any such amounts, the Host(s) will have recourse only against Airbnb Payments and not the Guest directly for the failure on the provision of the Payment Services.
Airbnb Payments may charge fees for use of certain Payment Services and any applicable fees will be disclosed to you in the Terms or via the Airbnb Platform.
You authorize Airbnb Payments to collect from you amounts due pursuant to these Payments Terms and/or the Terms by either (i) charging or debiting the Payment Method associated with the relevant booking, or any other Payment Method on file that you authorize in your Airbnb account (unless you have previously removed the authorization to charge or debit such Payment Method(s)), or (ii) by withholding the amount from your future Payout. Specifically, you authorize Airbnb Payments to collect from you:
If you owe an amount at any time after a booking, such as with Pay Part Now, Part Later or Recurring Payment charges, Booking Modifications, resolution center payments, or Damage Reports (“Additional Amounts”), you authorize and grant Airbnb Payments a mandate to collect payments for such Additional Amounts by charging your Payment Method associated with the relevant booking without any further action on your part. Airbnb Payments will notify you in writing before any Additional Amounts are charged to such payment method.
If your Payment Method associated with the relevant booking is determined to be expired, invalid or otherwise not able to be charged for any reason (such as insufficient funds), you remain responsible for any uncollected amounts. You authorize Airbnb Payments to charge or debit the Payment Method related to your booking again or use any other Payment Method on file associated with your Airbnb account, if available, to collect such Additional Amounts. Your bank may charge you an overdraft or other fees for each payment failure. Any amount not collected for any reason will be subject to any remedies that may be available, including, but not limited to, referral to a collections agency, or pursuit of available causes of action or claims against you.
If Airbnb has reason to believe that you as a Host participated in fraudulent activity, such as an overpayment scam, booking fraud or other fraud, and Airbnb Payments released the payout for such stay, Airbnb Payments may recoup from you such amount by reducing, deducting or debiting the amount from any future Payouts owed to you.
In addition to any amount due as outlined above, if there are delinquent amounts or chargebacks associated with your Payment Method, you may be charged fees that are incidental to Airbnb Payments collection of these delinquent amounts and chargebacks. Such fees or charges may include collection fees, convenience fees or other third-party charges.
If Airbnb Payments is unable to collect any amounts you owe under the Terms and these Payments Terms, Airbnb Payments may engage in collection efforts to recover such amounts from you.
Airbnb Payments will deem any owed amounts overdue when: (a) for authorized charges, one hundred and twenty (120) days have elapsed after Airbnb Payments first attempts to charge or debit your Payment Method or the associated services have been provided, whichever is later; and (b) for withholdings from a Host’s future Payouts, two hundred and seventy (270) days have elapsed after the adjustment is made to the Host’s Airbnb account or the associated services have been provided, whichever is later.
Airbnb Payments will deem any overdue amounts not collected to be in default when three hundred and sixty five (365) days have elapsed: (a) for authorized charges or debits, after Airbnb Payments first attempts to charge or debit your Payment Method or the associated services have been provided, whichever is later; and (b) for withholdings from a Host’s future Payouts, after the adjustment is made to the Host’s Airbnb account or the associated services have been provided, whichever is later.
You hereby explicitly agree that all communications in relation to amounts owed will be made by electronic mail or by phone, as provided to Airbnb and/or Airbnb Payments by you. Such communications may be made by Airbnb, Airbnb Payments, or by anyone on their behalf, including but not limited to a third-party collection agent.
Airbnb Payments will take the necessary steps to rectify any payment processing errors that we become aware of. These steps may include crediting or debiting (as appropriate) the original Payout Method or Payment Method used or selected by you, so that you end up receiving or paying the correct amount. This may be performed by Airbnb Payments or a third party such as your financial institution. We may also take steps to recover funds sent to you in error (including but not limited to an event of duplicate payments made to you due to a processing error), by reducing, deducting and/or debiting the amount of such funds from any future Payouts owed to you.
To the extent you receive any funds in error, you agree to immediately return such funds to Airbnb Payments.
Any refunds or credits due to a Member pursuant to the Terms, Major Disruptive Events Policy, Rebooking and Refund Policy for Homes, and Refund Policy for Services and Experiences will be initiated and remitted by Airbnb Payments in accordance with these Payments Terms.
Subject to this Section 5.5.2, Airbnb Payments will initiate the refund process promptly. In case of a cancellation by Host, Airbnb Payments will hold the funds for up to 72 hours until the Guest is either refunded or the Guest directs Airbnb to use the funds to rebook with another Host. In certain instances, the refund process may include the option to receive credit in lieu of a cash refund; if this option is made available to you, the timing of your refund will be communicated via the Airbnb Platform. The time it takes to receive any cash refund or for any pre-authorization of your Payment Method to be released will vary based on the Payment Method and any applicable payment system (e.g., Visa, Mastercard, etc.) rules. In the event of a Force Majeure Event that may affect the processing and settlement of refunds, Airbnb Payments will initiate and process the refund as soon as is practicable.
If you are responsible for Damage Report amounts, pursuant to Section 15 of the Terms, Airbnb via Airbnb Payments may charge the Payment Method used to make the booking or any other payment method on file in your Airbnb account at the time of the Damage Report or reasonably thereafter in order to collect Damage Report amounts, up to a maximum amount as defined in Section 15 of the Terms. To facilitate this charge, when you book a Listing, you are agreeing that Airbnb via Airbnb Payments may charge the Payment Method used to book the Listing in order to collect Damage Report amounts.
You agree that Airbnb Payments may seek to recover from you under any insurance policies you maintain and that Airbnb Payments may also pursue against you any remedies it may have available, including, but not limited to, referral to a collections agency, or pursuit of causes of action or claims against you, including in relation to a Damage Report, or payment requests made by Hosts under the Host Damage Protection.
If Airbnb Payments holds funds due to you (e.g., because we are unable to issue you a Payout or refund) or you do not use a gift card or gift credit for the relevant period of time set forth by your state, country, or other governing body in its unclaimed property laws, we may process the funds due to you in accordance with our legal obligations, including by reporting and escheating (sending) such funds to the appropriate governing body as required by applicable unclaimed property laws.
You are solely responsible for compliance with any and all laws, rules, regulations, and tax obligations that may apply to your use of the Payment Services. In connection with your use of the Payment Services, you may not and you agree that you will not and will not assist or enable others to:
We are required to act in accordance with our internal policies and the laws of various jurisdictions relating to the prevention of money laundering and the implementation of sanctions including: (i) economic or financial sanctions or trade embargoes imposed, administered or enforced from time to time by the U.S. government, including those administered by the Office of Foreign Asset Control or the U.S. Department of State; (ii) by the United Nations Security Council, the European Union or His Majesty's Treasury of the United Kingdom; or (iii) by the Canadian government, including Global Affairs Canada (and any successor thereto). You will comply with any relevant financial sanctions and any relevant export control laws applicable to you and to your local jurisdiction.
Airbnb Payments shall not be liable for any delay or failure to fulfill any obligation under these Payments Terms resulting from abnormal or unforeseeable circumstances outside the reasonable control of Airbnb or Airbnb Payments, the consequences of which would have been unavoidable despite all efforts to the contrary, including, but not limited to, acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, epidemics or disease, strikes or shortages of transportation facilities, fuel, energy, labor or materials (“Force Majeure Event”).
If you choose to use the Payment Services, you do so voluntarily and at your sole risk. To the maximum extent permitted by law, the Payment Services are provided “as is”, without warranty of any kind, either express or implied.
Notwithstanding Airbnb Payments’ appointment as the limited payment collection agent of Hosts pursuant to Section 4, Airbnb Payments explicitly disclaims all liability for any act or omission of any Member or other third party. Airbnb Payments does not have any duties or obligations as agent for each Host except to the extent expressly set forth in these Payments Terms, and any additional duties or obligations as may be implied by law are, to the maximum extent permitted by applicable law, expressly excluded.
If we choose to conduct identity verification on any Member, to the extent permitted by applicable law, we disclaim warranties of any kind, either express or implied, that such checks will identify prior misconduct by a Member or guarantee that a Member will not engage in misconduct in the future.
The foregoing disclaimers apply to the maximum extent permitted by law. You may have other statutory rights or warranties which cannot lawfully be excluded. However, the duration of any statutorily required warranties shall be limited to the maximum extent (if any) permitted by law.
You acknowledge and agree that, to the maximum extent permitted by law, the entire risk arising out of your access to and use of the Payment Services remains with you. If you permit or authorize another person to use your Airbnb account in any way, you are responsible for the actions taken by that person. Neither Airbnb Payments nor any other party involved in creating, producing, or delivering the Payment Services will be liable for any incidental, special, exemplary, or consequential damages, including lost profits, loss of data or loss of goodwill, service interruption, computer damage or system failure or the cost of substitute products or services, or for any damages for personal or bodily injury or emotional distress arising out of or in connection with (i) these Payments Terms, (ii) from the use of or inability to use the Payment Services, or (iii) from any communications, interactions, or meetings with other Members or other persons with whom you communicate, interact, transact, or meet with as a result of your use of the Payment Services, whether based on warranty, contract, tort (including negligence), product liability, or any other legal theory, and whether or not Airbnb Payments has been informed of the possibility of such damage, even if a limited remedy set forth herein is found to have failed of its essential purpose. Except for our obligations to pay amounts to applicable Hosts pursuant to these Payments Terms or an approved payment request under the Host Damage Protection or Japan Host Insurance, in no event will Airbnb Payments’ aggregate liability arising out of or in connection with these Payments Terms and your use of the Payment Services including, but not limited to, from your use of or inability to use the Payment Services, exceed (i) the amounts you have paid or owe for bookings via the Airbnb Platform as a Guest in the twelve (12) month period prior to the event giving rise to the liability, or if you are a Host, the amounts paid by Airbnb Payments to you in the twelve (12) month period prior to the event giving rise to the liability, or (ii) one hundred U.S. dollars (US$100), if no such payments have been made, as applicable. The limitations of damages set forth above are fundamental elements of the basis of the bargain between Airbnb Payments and you. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you. If you reside outside of the U.S., this does not affect Airbnb Payments’ liability for death or personal injury arising from its negligence, nor for fraudulent misrepresentation, misrepresentation as to a fundamental matter, or any other liability which cannot be excluded or limited under applicable law.
To the maximum extent permitted by applicable law, you agree to release, defend (at Airbnb Payments’ option), indemnify, and hold Airbnb Payments and its affiliates and subsidiaries, and their officers, directors, employees, and agents, harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with (i) your breach of these Payments Terms; (ii) your improper use of the Payment Services; (iii) your failure, or our failure at your direction, to accurately report, collect or remit taxes; or (iv) your breach of any laws, regulations, or third-party rights.
Except as otherwise required by applicable law, Airbnb Payments may modify these Payments Terms at any time. If we make material changes to these Payments Terms, we will post the revised Payments Terms on the Airbnb Platform and update the “Last Updated” date at the top of these Payments Terms. If you are affected by the modification, we will also provide you with notice of the modifications at least thirty (30) days before the date they become effective. If you are contracting with Airbnb Payments UK, you will receive at least two (2) months advance notice. If you do not terminate your agreement before the date the revised Payments Terms become effective, your continued use of the Payment Services will constitute acceptance of any changes to the revised Payments Terms.
This agreement between you and Airbnb Payments is effective (i) if you are a Guest, from when you make your first booking, or (ii) if you are a Host, from when a Guest first books a Listing made available by you and you use the Payment Services, and remains in effect until either you or we terminate this agreement in accordance with Section 13.3.
You may terminate this agreement at any time by sending us an email or by deleting your Airbnb account. Terminating this agreement will also serve as notice to cancel your Airbnb account pursuant to the Terms. Without limiting our rights specified below, Airbnb Payments may terminate this agreement for convenience at any time by giving you thirty (30) days' notice via email to your registered email address (or ninety (90) days’ prior notice for Members contracting with Airbnb Payments UK). Airbnb Payments may also terminate this agreement immediately without notice if (i) you have materially breached your obligations under this agreement; (ii) you have provided inaccurate, fraudulent, outdated, or incomplete information; (iii) you have violated applicable laws, regulations, or third-party rights; or (iv) Airbnb Payments believes in good faith that such action is reasonably necessary to protect other Members, Airbnb, Airbnb Payments, or third parties.
Airbnb Payments may limit or temporarily or permanently suspend your use of or access to the Payment Services (i) to comply with applicable law, or the order or request of a court, law enforcement, or other administrative agency or governmental body, (ii) if you have breached these Payments Terms, the Terms, applicable laws, regulations or third-party rights, (iii) if you have provided inaccurate, fraudulent, outdated, or incomplete information regarding a Payment Method or Payout Method, (iv) for any amounts you owe under these Payments Term that are overdue or in default, or (v) if Airbnb Payments believes in good faith that such action is reasonably necessary to protect the personal safety or property of Airbnb, its Members, Airbnb Payments, or third parties, or to prevent fraud or other illegal activity. Further, for unsuccessful payment due to card expiration, insufficient funds, or otherwise, we may temporarily suspend your access to the Payment Services until we can charge a valid Payment Method
If Airbnb Payments takes any of the measures described in Section 13.3 and 13.4 you may appeal such a decision by contacting customer service.
If you cancel your Airbnb account as a Host or Airbnb Payments takes any of the measures described above, Airbnb Payments may provide a full refund to any Guests with confirmed booking(s), and you will not be entitled to any compensation for pending or confirmed bookings that were canceled. If you cancel your Airbnb account as a Guest, Airbnb Payments will initiate a refund for any confirmed booking(s) based on the Listing’s cancellation policy. If your access to or use of the Payment Services has been suspended or limited or this agreement has been terminated by us, you may not register a new Airbnb account or attempt to access and use the Payment Services through an Airbnb account of another Member.
Sections 5 through 21 of these Payments Terms shall survive any termination or expiration of this agreement.
If you are contracting with Airbnb Payments US, these Payments Terms will be interpreted in accordance with the laws of the State of California and the United States of America, without regard to conflict-of-law provisions. Legal proceedings (other than small claims actions) that are excluded from the Arbitration Agreement in Section 15 must be brought in state or federal court in San Francisco, California, unless we both agree to some other location. You and we both consent to venue and personal jurisdiction in San Francisco, California.
If you are contracting with Airbnb Payments UK, these Payments Terms will be interpreted in accordance with English law. If you are acting as an individual consumer and if mandatory statutory consumer protection regulations in your country of residence contain provisions that are more beneficial for you, such provisions shall apply irrespective of the choice of English law. As an individual consumer, you may bring any judicial proceedings relating to these Payments Terms before the competent court of your place of residence or a competent court in England. If Airbnb wishes to enforce any of its rights against you as a consumer, we may do so only in the courts of the jurisdiction in which you are a resident. If you are acting as a business, you agree to submit to the exclusive jurisdiction of the English courts.
If you are contracting with Airbnb Payments India, these Payments Terms will be interpreted in accordance with the laws of India. Any dispute arising from or in connection with these Payments Terms must be submitted to the International Chamber of Commerce (“ICC”) for arbitration in New Delhi, which shall be the seat and venue of arbitration. Such arbitration shall be conducted in accordance with the arbitration rules of the ICC in effect at the time of applying for arbitration, provided that this section shall not be construed to limit any rights which Airbnb Payments may have to apply to any court of competent jurisdiction for an order requiring you to perform or be prohibited from performing certain acts and other provisional relief permitted under the laws of India or any other laws that may apply to you. In the event one or more of the parties to the dispute are non-resident, the parties agree to exclude (for the avoidance of any doubt) the applicability of the provisions of Part I (save and except Section 9, Section 27, Section 37(1)(a) and Section 37(3) thereof) of the Indian Arbitration and Conciliation Act 1996 to any arbitration under this section. The arbitration proceedings shall be conducted in English. The arbitral award rendered is final and binding upon both parties. Each party shall bear its own costs in relation to the arbitration.
If you are contracting with Airbnb Brazil, these Payments Terms will be interpreted in accordance with the laws of Brazil. If you are acting as a consumer, judicial proceedings that you are able to bring against us arising from or in connection with these Payments Terms may only be brought in a court located in the city of Sao Paulo, State of Sao Paulo, Brazil or in a court with jurisdiction in your place of residence. If you are acting as a business, you agree to submit to the exclusive jurisdiction of a court located in the city of Sao Paulo, State of Sao Paulo, Brazil.
If you are contracting with Airbnb Payments Canada:
Except as set out in Sections 14.5.2 and 14.5.3, these Payments Terms will be interpreted in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflicts of law principles. Except for matters that are subject to arbitration in accordance with section 19.3 below, you agree to submit to exclusive jurisdiction of the courts of competent jurisdiction in Toronto, Ontario.
If you are a Quebec consumer or a Quebec sole proprietor that is considered a consumer under the Quebec consumer protection legislation, these Payments Terms will be interpreted in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, and you agree to submit to exclusive jurisdiction of the Quebec courts.
Notwithstanding Section 14.5.1, you may choose that any dispute arising from or in connection with these Payments Terms relating to your use of the Payment Services as a Guest will be interpreted in accordance with English law.
PLEASE READ THE FOLLOWING PARAGRAPHS CAREFULLY BECAUSE THEY PROVIDE THAT YOU AND AIRBNB PAYMENTS AGREE TO RESOLVE ALL DISPUTES BETWEEN US THROUGH BINDING INDIVIDUAL ARBITRATION AND INCLUDE A CLASS ACTION WAIVER AND JURY TRIAL WAIVER. This Arbitration Agreement supersedes all prior versions.
This Arbitration Agreement only applies to you if you are contracting with Airbnb Payment US. If you are not contracting with Airbnb Payments US, and you nevertheless attempt to bring any legal claim against Airbnb Payments in the United States, this Arbitration Agreement will apply for determination of the threshold issue of whether this Section 15 applies to you, and all other threshold determinations, including residency, arbitrability, venue, and applicable law.
Airbnb Payments is committed to participating in a consumer-friendly dispute resolution process. To that end, these Payments Terms provide for a two-part process for individuals to whom this Section 15 applies: (1) an informal negotiation directly with Airbnb’s customer service team (described in Section 15.3), and if necessary (2) a binding arbitration in accordance with the terms of this Arbitration Agreement. You and Airbnb Payments each retain the right to seek resolution of the dispute in small claims court as an alternative to arbitration
At least 30 days prior to initiating an arbitration, you and Airbnb Payments each agree to send the other party an individualized notice of the dispute in writing (“Pre-Dispute Notice”) and attempt in good faith to negotiate an informal resolution of an individual claim. You must send your Pre-Dispute Notice of dispute to Airbnb Payments by mailing it to Airbnb Payments’ agent for service: CSC Lawyers Incorporating Service, 2710 Gateway Oaks Drive, Suite 150N, Sacramento, California 95833. Airbnb Payments will send its Pre-Dispute Notice to the email address associated with your Airbnb account. A Pre-Dispute Notice must include: the date, your name, mailing address, your Airbnb username, the email address you used to set up your Airbnb account, your signature, a brief description of the dispute, and the relief sought. If the parties are unable to resolve the dispute within the 30-day period, only then may either party commence arbitration by filing a written demand for arbitration with the arbitration provider designated pursuant to Section 15.6, below. A claimant’s Pre-Dispute Notice requirement is a prerequisite to any arbitration, and a copy of the Pre-Dispute Notice and evidence that it was sent as required by this Section must be attached to any arbitration demand.
You and Airbnb Payments mutually agree that any dispute, claim or controversy arising out of or relating to these Payments Terms or the applicability, breach, termination, validity, enforcement or interpretation thereof, or any use of the Payment Services (collectively, “Disputes”) will be settled by binding individual arbitration on an individual basis (the “Arbitration Agreement”). If there is a dispute about whether this Arbitration Agreement can be enforced or applies to our Dispute, you and Airbnb Payments agree that the arbitrator will decide that issue. For the avoidance of doubt, you and Airbnb agree that any question regarding arbitrability and the formation, enforceability, validity, scope, or interpretation of all or part of this Section 15, including any dispute over compliance with the Pre-Dispute Notice requirement and a party’s responsibility to pay arbitration fees, shall be resolved by an arbitrator.
You and Airbnb Payments each agree that the following causes of action and/or claims for relief are exceptions to the Arbitration Agreement and will be brought in a judicial proceeding in a court of competent jurisdiction (as defined by Section 15): (i) any claim or cause of action seeking emergency injunctive relief based on exigent circumstances (e.g., imminent danger or commission of a crime, hacking, cyber-attack); (ii) a request for the remedy of public injunctive relief; (iii) any claim or cause of action for vexatious litigation; or (iv) any individual claim of sexual assault or sexual harassment arising from your use of the Airbnb Platform or Host Services. You and Airbnb Payments agree that any request for the remedy of public injunctive relief will proceed after the arbitration of all arbitrable claims, remedies, or causes of action, and will be stayed pending the outcome of the arbitration pursuant to section 3 of the Federal Arbitration Act.
This Arbitration Agreement evidences a transaction in interstate commerce and the Federal Arbitration Act governs all substantive and procedural interpretation and enforcement of this Arbitration Agreement, and not state law. The arbitration will be administered by ADR Services, Inc. (“ADR”) (www.adrservices.com) in accordance with Rules 1, 6–7, 8–9, and 11–12, 45, 54, and 56 of the Federal Rules of Civil Procedure (“Selected Federal Rules") (https://www.uscourts.gov/rules-policies/current-rules-practice-procedure/federal-rules-civil-procedure) and ADR’s Arbitration Rules then in effect (the “ADR Rules”), except as the Selected Federal Rules or ADR Rules are modified by or conflict with this Arbitration Agreement. The ADR Rules are available at www.adrservices.com. If an arbitration demand is submitted to ADR Services in accordance with this agreement and the ADR Rules, and ADR Services cannot or will not administer the arbitration, the arbitration will be administered by the American Arbitration Association (“AAA”) in accordance with the Selected Federal Rules and the AAA’s Consumer Arbitration Rules (the “AAA Rules”) then in effect, except as modified here. The AAA Rules are available at www.adr.org. If the AAA cannot and will not administer the arbitration, you and Airbnb Payments shall confer and select an alternative arbitral forum, and if we are unable to agree, either you or Airbnb Payments may ask a court to appoint an arbitrator pursuant to 9 U.S.C. § 5. In that event, the arbitration will be conducted in accordance with the rules of the appointed arbitral forum, unless those rules are inconsistent with the provisions of this Arbitration Agreement.
In order to make the arbitration most cost-effective, efficient, and convenient to you, any required arbitration hearing in an arbitration wherein the amount in controversy does not exceed $1,000,000 shall be conducted remotely via video conference except as otherwise agreed by the parties or instructed by the arbitrator. Any required arbitration hearing in an arbitration wherein the amount in controversy exceeds $1,000,000 shall be conducted in San Francisco County except as otherwise agreed by the parties or instructed by the arbitrator. If the amount in controversy is $10,000 or less, the parties agree to proceed solely on the submission of documents to the arbitrator, provided that the arbitrator has discretion to decide to hold a hearing in response to the reasonable and proportionate request from a party.
Your arbitration fees and your share of arbitrator compensation shall be governed by the ADR Rules. and the ADR Services fee schedule (available at www.adrservices.com). If you have a gross monthly income of less than 300% of the federal poverty guidelines, you are entitled to a waiver of arbitration fees and costs, exclusive of arbitrator fees. You may request a fee waiver by providing the arbitration provider with a declaration under oath stating your monthly income and the number of persons in your household. If a fee waiver is granted by the arbitration provider and you provide Airbnb Payments with documents necessary to prove that your gross monthly income is less than 300% of the federal poverty guidelines, Airbnb Payments will pay your share of any arbitrator fees.
Either party may make a request that the arbitrator impose sanctions upon proving that the other party or its attorney(s) has asserted a claim or defense that is groundless in fact or law, brought in bad faith or for the purpose of harassment, or is otherwise frivolous., As allowed by applicable law and the AAA Rules the arbitrator shall impose sanctions equal to the requesting party’s reasonable attorneys’ fees and costs upon finding that a claim or defense is groundless in fact or law, brought in bad faith or for the purpose of harassment, asserted in violation of Fed. R. Civ. P. 11(b) (treating the arbitrator as “the court”), or is otherwise frivolous. Either party may seek dismissal of any arbitration filed in violation of any provision of this Arbitration Agreement. Either party may assert in arbitration a counterclaim for the other party’s initiation of proceedings concerning an arbitrable Dispute without complying with or otherwise in violation of the requirements of this Arbitration Agreement. Upon finding that a party has initiated proceedings concerning an arbitrable Dispute without complying with or otherwise in violation of the requirements of this Arbitration Agreement, the arbitrator shall award the other party its actual damages, including but not limited to reasonable attorneys’ fees and costs.
The arbitrator will issue a written decision which shall include the essential findings and conclusions upon which the arbitrator based the award. Judgment on the arbitration award may be entered in any court with proper jurisdiction. The arbitrator may award any relief allowed by law or the AAA Rules, but declaratory or injunctive relief may be awarded only on an individual basis and only to the extent necessary to provide relief warranted by the claimant’s individual claim.
You and Airbnb Payments acknowledge and agree that both parties are each waiving the right to a trial by jury as to all arbitrable Disputes.
You and Airbnb Payments acknowledge and agree that, to the fullest extent permitted by law, we are each waiving the right to participate as a plaintiff or class member in any purported class action lawsuit, class-wide arbitration, private attorney general action, or any other representative or consolidated proceeding. Unless we agree in writing or as provided in this agreement, the arbitrator may not consolidate more than one party’s claims and may not otherwise preside over any form of any class or representative proceeding. If there is a final judicial determination that applicable law precludes enforcement of the waiver contained in this paragraph as to any claim, cause of action or requested remedy, then that claim, cause of action or requested remedy, and only that claim, cause of action or requested remedy, will be severed from this agreement to arbitrate and will be brought in a court of competent jurisdiction. In the event that a claim, cause of action or requested remedy is severed pursuant to this paragraph, then you and we agree that the claims, causes of action or requested remedies that are not subject to arbitration will be stayed until all arbitrable claims, causes of action and requested remedies are resolved by the arbitrator.
You and Airbnb Payments acknowledge and agree that the relative benefits and efficiencies of arbitration may be lost when 100 or more arbitration claims are filed within 180 days which (1) involve the same or similarly situated parties; (2) are based on the same or similar claims which arise from the same or substantially identical transactions, incidents, alleged violations or events requiring the determination of the same or substantially identical questions of law or fact; and (3) involve the same or coordinated counsel for the parties (“Mass Action”). Accordingly, you and Airbnb Payments agree to waive the right to have any Dispute administered, arbitrated, or resolved as part of a Mass Action (though Sections 15 and 15.12 of these Terms will continue to apply to the Dispute). In case of a dispute, the appointed arbitrator for the first matter instituted within a set of claims identified by either party shall decide whether those claims are part of a Mass Action. If no arbitrator has yet been appointed, an arbitrator shall be appointed solely to determine whether claims identified by either party are part of a Mass Action. Nothing in this provision prevents you or Airbnb Payments from participating in a mass settlement of claims.
If for any reason, notwithstanding Section 15.13, an arbitration proceeds as part of a Mass Action, the parties shall group the arbitration demands into batches of no more than 200. The batches shall be determined by listing the claimants’ alphabetically (by last name or business name, as applicable)—for example, the first 200 claimants listed will be the first batch, the next 200 claimants listed will be the second batch, and so forth. The parties shall randomly assign each batch a sequential number and arbitrate the batches one at a time, in sequential order. While one batch is being arbitrated, the arbitration provider shall hold the remainder in abeyance unless otherwise agreed by the parties or instructed by the arbitration provider. Each batch shall be resolved within 240 days of the pre-hearing conference for that batch. Notwithstanding the forgoing, if any claimant’s demand has not been the subject of a pre-hearing conference within 2 years of the latest-filed demand in the Mass Action, such claimant may elect to pursue the claims asserted in the claimant’s demand in court subject to Sections 14 and 15.12 of these Terms.
At least 10 days before the date set for the arbitration hearing, you or Airbnb Payments may serve a written offer of judgment on the other party to allow judgment on specified terms. If the offer is accepted, the offer with proof of acceptance shall be submitted to the arbitration provider, who shall issue an award accordingly. If the offer is not accepted prior to the arbitration hearing or within 30 days after it is made, whichever occurs first, it shall be deemed withdrawn and cannot be given as evidence in the arbitration, other than with respect to costs (including all fees paid to the arbitration provider). If an offer made by one party is not accepted by the other party, and the other party fails to obtain a more favorable award, the other party shall not recover their post-offer costs and shall pay the offering party’s costs (including all fees paid to the arbitration provider) from the time of the offer.
Except as provided in Section 15.12, in the event that any portion of this Arbitration Agreement is deemed illegal or unenforceable, such provision shall be severed and the remainder of the Arbitration Agreement will be given full force and effect.
If Airbnb Payments amends this Section 15 after the date you last accepted these Payments Terms (or accepted any subsequent changes to these Payments Terms), you may reject the change by sending us written notice no later than thirty (30) days of the date the change is effective. Your notice must include your name, mailing address, the date of the notice, your Airbnb username, the email address you used to set up your Airbnb account, your signature, and an unequivocal statement that you want to opt out of the amended Section 15. You must either mail your notice to this address: 888 Brannan St, San Francisco, CA 94103, Attn: Arbitration Opt-Out, or email the opt-out notice to [email protected]. Rejecting a new change, however, does not revoke or alter your prior consent to any earlier agreements to arbitrate any Dispute between you and Airbnb Payments (or your prior consent to any subsequent changes thereto), which will remain in effect and enforceable as to any Dispute between you and Airbnb Payments.
Except as provided in Section 15.16 and subject to Section 13.7, this Section 15 will survive any termination of these Payments Terms and will continue to apply even if you stop using the Payment Services or terminate your Airbnb account.
Except as they may be supplemented by additional terms and conditions, policies, guidelines, or standards, these Payments Terms constitute the entire agreement between Airbnb Payments and you regarding the subject matter hereof, and supersede any and all prior oral or written understandings or agreements between Airbnb Payments and you regarding the Payment Services. If any provision of these Payments Terms is held to be invalid or unenforceable, such provision will be struck and will not affect the validity and enforceability of the remaining provisions.
Airbnb Payments’ failure to enforce any right or provision in these Payments Terms will not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing. Except as expressly set forth in these Payments Terms, the exercise by either party of any of its remedies under these Payments Terms will be without prejudice to its other remedies under these Payments Terms or otherwise permitted under law.
You may not assign, transfer, or delegate this agreement or your rights and obligations hereunder without Airbnb Payments’ prior written consent. Airbnb Payments may without restriction assign, transfer, or delegate this agreement and any rights and obligations, at its sole discretion, with thirty (30) days’ prior notice (or two (2) months’ prior notice for Members contracting with Airbnb Payments UK).
Unless specified otherwise, any notices or other communications permitted or required under this agreement, will be in writing and given by Airbnb Payments via email or Airbnb Platform notification, and depending on your notification setting, messaging service (including SMS and WeChat). The date of receipt will be deemed the date on which Airbnb Payments transmits the notice.
The following paragraphs will apply if you are contracting with Airbnb Payments UK. To the extent that there is any conflict between this Section 17 and any other provisions of these Payments Terms, the provisions of this Section 17 shall apply.
The Payment Services include the payment collection service provided to Hosts contracting with Airbnb Payments UK. The payment collection service constitutes a “payment service” regulated under the Payment Services Regulations and for these purposes Airbnb Payments UK treats Hosts as the “payment service user.”
By agreeing to these Payments Terms you as a Host have consented to Airbnb Payments UK’s payment of each Payout to your chosen Payout Method. Hosts may change a Payout Method up to one (1) day before the time agreed for the Payout as set out in Section 3.3. Airbnb Payments UK will be deemed to have received the Host's payment order to the Host on the same date Airbnb Payments UK agrees to initiate the Payout in accordance with Section 3.3
Airbnb Payments UK will endeavor to ensure that Hosts based in the UK will receive each Payout by the end of the business day following Airbnb Payments UK’s initiation of the Payout.
Communication. Airbnb Payments will provide the Host notice via email when we initiate each Payout. We will also provide notice to a Host’s registered email address if the Payout is returned to us because of an error. It is your responsibility as a Host to ensure that you provide us with a current, accurate, and valid email address.
If you as a Host believe or become aware that a Payout properly due to you has been or may be diverted without your authorization (“Diverted Payout”) because your password or other credentials to log into your Airbnb account (“Credentials”) have been lost or stolen or misappropriated, you should notify Airbnb Payments UK (see Section 21 for details on how) without undue delay on becoming aware of the loss, theft, or misappropriation of your Credentials or of the unauthorized use of your Credentials or access to your Airbnb account.
If you as Host claim not to have received a Payout properly due to you via your chosen Payout Method (including where there has been a Diverted Payout), Airbnb Payments UK will (if requested by you without undue delay, on becoming aware of the unauthorised or incorrectly executed Payout and in any event within 13 months of it happening) make immediate efforts to trace the payment and will notify you of the outcome. Subject to Section 17.2.3, unless we can prove that (i) the Payout was received by you via your chosen Payout Method, or (ii) we made the Payout correctly using the Payout Method information you provided but the information you provided was incorrect, we will refund the amount. Where you have given us incorrect information we will not be liable for the defective or non-execution of the Payout, however, we will make reasonable efforts to recover the Payout funds.
You must use your Credentials in accordance with these Payments Terms and take all reasonable steps to keep your Credentials safe. As a Host you may be liable for losses relating to any Diverted Payout arising from the use of lost, stolen, or misappropriated Credentials including the loss of a mobile phone on which you have installed the Application or where you have failed to keep your Credentials safe, up to a maximum of £35. This will not apply if the loss, theft or misappropriation of your Credentials was not detectable by you prior to the Payout, unless you acted fraudulently or the loss was caused by acts or omissions of Airbnb personnel or a service provider. You may, however, be liable for all losses relating to a Diverted Payout if we can show that you acted fraudulently or where, with intent or gross negligence, you failed to use the Airbnb Platform and/or Payment Services in accordance with the Terms or these Payments Terms (including the obligation to keep your Credentials safe). Except where you have acted fraudulently, you will not be liable for any losses incurred in respect of a Diverted Payout arising after notification by you of the loss, theft, or misappropriation of your Credentials or of the unauthorized use of your Credentials, where we have failed at any time to provide appropriate means for such notification, or where we do not require strong customer authentication, where required.
Any complaints about the Payment Services should be made to Airbnb Payments UK (see Section 21 for details on how). If you are not happy with the outcome of a complaint and you as a Host have received regulated Payment Services from Airbnb Payments, UK, you may also be able to refer your complaint to the Financial Ombudsman. All complaints to the Financial Ombudsman Service are subject to the rules of the Financial Ombudsman Service, including in relation to eligibility requirements. The UK Financial Ombudsman Service offers a free complaints resolution service to individuals, micro-enterprises, small charities, and trustees of small trusts. You may obtain further information regarding the Financial Ombudsman Services and contact details at: http://www.financial-ombudsman.
If Mexico is your country of residence, (i) upon successful receipt of payment from the Guest following a Host's acceptance of the Guest’s booking request, Airbnb Payments generally holds such funds due to the Host in temporary custody until it is released to the Host in accordance with Section 3.3.1, and (ii) the payment to the Host will be effective only upon the start of the Host's Services and in accordance with Section 3.3.1. Airbnb may be required to withhold taxes per applicable local laws, and such taxes will be due upon Airbnb Payment’s release of the Host Payout.
The Host acknowledges that Airbnb Payments is acting as a payments collection agent solely for the limited purpose of accepting and processing funds from Guests purchasing Host Services and paying any applicable taxes due in Mexico, including VAT, on the Host’s behalf.
The following paragraphs will apply if you are contracting with Airbnb Brazil:
Section 2, “Guest Terms”, shall be amended by adding the following subsection: “You acknowledge that if your country of residence is Brazil and you are paying by credit card, you may pay for your booking in multiple installments as long as your credit card supports installments and is issued in Brazil. The number of installments may vary, but will be presented to you before you complete your booking transaction. You acknowledge that the Total Price may be increased when you choose to pay for your booking in installments as a result of expenses related to the use of credit card and/or other forms of installment plans (“Installment Fee”). You agree that you are solely responsible for the payment of the Installment Fee, and Airbnb Brazil is only responsible for collecting and transferring those amounts to the applicable third-party payment service provider. You authorize the applicable third-party payment service provider to automatically charge the original Payment Method you used to make the booking.. Your use of the installment feature may be subject to additional terms and conditions imposed by the applicable third-party payment service provider. If your booking is canceled for any reason, the Installment Fee will be refunded to the Payment Method you used to make the booking. If you make a modification to a booking payable in installments, and the Booking Modification lowers your Total Price, you will not be refunded any portion of the Installment Fee. Refunds will be initiated and remitted by Airbnb Payments in accordance with these Payments Terms.”
Depending on the country of residence of guests and hosts, payments due to hosts and applicable fees like Airbnb service fees may require the execution of foreign exchange agreements or other related measures, as per applicable legislation.
If you are a resident in Brazil and make a booking with a Host residing outside of Brazil using local currency, by using the Payment Services you acknowledge and agree that Airbnb Brazil acts as a payment collection agent of the Host residing outside of Brazil. Airbnb Brazil is also the entity with whom you are contracting for the use of the Airbnb Platform, as set forth in the Terms.
You authorize Airbnb Brazil, directly or through third parties, to make any inquiries we consider necessary to verify your identity. This may include (i) screening you against third-party databases or other sources, (ii) requesting reports from service providers, (iii) asking you to provide a form of government identification (e.g., driver’s license or passport), tax ID, your date of birth, your address, and other information; or (iv) requiring you to take steps to confirm ownership of your email address, Payment Method(s) or Payout Method(s). Airbnb Brazil reserves the right to terminate, suspend, or limit access to the Payment Services in the event we are unable to obtain or verify any of this information.
When processing payments from a Member, Airbnb Brazil (and/or third parties contracted by you or by Airbnb Brazil on your behalf) may retain and/or report to the competent authorities (when applicable) information relating to the Member and/or the respective transaction to comply with applicable legislation and certain regulatory controls, and prevention of money laundering activities.
For transactions above $10,000, Guests hereby appoint Airbnb Brazil as their attorney-in-fact to enter into foreign exchange transactions with institutions to remit or receive any funds from Guests’ purchases of Host Services. Guests also authorize Airbnb Brazil to delegate, in whole or in part, the powers granted herein.
For Guests and Hosts contracting with Airbnb Brazil, all references in this Payments Terms to Airbnb, Airbnb Payments or Airbnb Platform shall be deemed to refer to Airbnb Brazil.
The following paragraphs will apply if you are contracting with Airbnb Payments Canada:
Airbnb Payments Canada will safeguard all funds held on behalf of Hosts in connection with the provision of Payment Services (“CA Safeguarded Funds”) in accordance with applicable Canadian laws and regulations. CA Safeguarded Funds do not include funds not successfully received from Guests in accordance with these Payments Terms. The CA Safeguarded Funds are held in trust in one or more pooled safeguarding accounts at eligible financial institutions for all applicable Hosts unless Airbnb Payments Canada uses other means permitted under applicable law to safeguard those funds. The CA Safeguarded Funds remain in the safeguarding accounts until the time at which we (i) initiate your relevant Payout, or (ii) use the funds to satisfy your obligations in accordance with these Payments Terms. These CA Safeguarded Funds are held separate from Airbnb Payments Canada’s corporate funds, and Airbnb Payments Canada will neither use these funds for its operating expenses or any other corporate purposes nor will it voluntarily make these funds available to its creditors in the event of bankruptcy.
If you are a consumer residing in Ontario or Quebec, or you are a Quebec sole proprietor that is considered a consumer under Quebec consumer protection legislation then, notwithstanding any other provision in these Payments Terms, including section 13.1 (Modifications), this change provision applies to you. Airbnb Payments Canada reserves the right to change or modify these Payments Terms with respect to any provisions that apply to the Payment Services (including, changing the Payment Services, the Guest terms, Host terms, general terms, Airbnb Payment Canada’s responsibilities or obligations under the Payments Terms, your responsibilities under the Payments Terms, prohibited activities, disclaimers and limitation of liability) from time to time, including if required to comply with applicable law. If Airbnb Payments Canada makes such changes to these Payments Terms, in addition to posting the amended Payments Terms as specified in Section 13.1, Airbnb Payments Canada will also provide you with notice of the changes at least thirty (30) days before the date they become effective in accordance with applicable law. Upon receiving notice of the changes, you may refuse the changes and cancel these Payments Terms in the manner and within the time specified in such notice. If you are a consumer residing in Quebec or you are a Quebec sole proprietor that is considered a consumer under Quebec consumer protection legislation, you may also refuse the changes and cancel these Payments Terms within thirty (30) days after the effective date of the changes, if the change entail an increase in your obligation or a reduction of Airbnb Payment Canada’s obligations. If you do not notify Airbnb Payment Canada within that time, the changes will take effect as indicated in the notice. In that case, you will be deemed to agree to the changes which will become part of these Payments Terms and enforceable against you. If you cancel these Payments Terms, your account will be closed and you will no longer have access to the Payment Services.
DOES NOT APPLY TO QUEBEC CONSUMERS AND SOLE PROPRIETORS THAT ARE CONSIDERED CONSUMERS UNDER QUEBEC CONSUMER PROTECTION LEGISLATION. Any dispute, controversy or claim arising out of related to these Payments Terms, including the validity, existence, binding effect, interpretation, performance, breach or termination, and including tort claims, that cannot be resolved by the parties through good faith discussions may be referred to and finally determined, to the exclusion of the courts, by arbitration, by a single arbitrator administered by ICDR Canada in accordance with the Canadian Arbitration Rules. The fee of the arbitrator shall be shared equally by the parties. The seat of the arbitration shall be in Toronto, Ontario and the language of the arbitration shall be English. The arbitrator shall apply the substantive laws of Ontario. The proceedings of the arbitration shall be confidential, the award of the arbitrator shall be final and binding, and there shall be no right to appeal it on the basis of any factual or legal errors, judgment on which may be entered in any court having jurisdiction.
The parties agree that notwithstanding the above, either of them may bring a claim against the other in the Small Claims Court of the province in which you reside where the total amount at issue is no greater than CAD$10,000.
The limitation of liability provision below applies in Canada to the extent permitted by applicable law except that, with respect to Quebec consumers or Quebec sole proprietors that are considered consumers under consumer protection legislation in the province of Quebec, Canada, this section will not apply to allow Airbnb Payments Canada to disclaim liability for circumstances arising as a result of Airbnb Payments Canada’s own actions or those of anyone authorized to act on its behalf.
You acknowledge and agree that, to the maximum extent permitted by law, the entire risk arising out of your access to and use of the Payment Services remains with you. If you permit or authorize another person to use your Airbnb account in any way, you are responsible for the actions taken by that person. Neither Airbnb Payments Canada nor any other party involved in creating, producing, or delivering the Payment Services will be liable for any incidental, special, exemplary, or consequential damages, including lost profits, loss of data or loss of goodwill, service interruption, computer damage or system failure or the cost of substitute products or services, or for any damages for personal or bodily injury or emotional distress arising out of or in connection with (i) these Payments Terms, (ii) from the use of or inability to use the Payment Services, or (iii) from any communications, interactions, or meetings with other Members or other persons with whom you communicate, interact, transact, or meet with as a result of your use of the Payment Services, whether based on warranty, contract, tort (including negligence), product liability, or any other legal theory, and whether or not Airbnb Payments Canada has been informed of the possibility of such damage, even if a limited remedy set forth herein is found to have failed of its essential purpose. Except for our obligations to pay amounts to applicable Hosts pursuant to these Payments Terms or an approved payment request under the Host Damage Protection, in no event will Airbnb Payments Canada’s aggregate liability arising out of or in connection with these Payments Terms and your use of the Payment Services including, but not limited to, from your use of or inability to use the Payment Services, exceed (i) the amounts you have paid or owe for bookings via the Airbnb Platform as a Guest in the twelve (12) month period prior to the event giving rise to the liability, or if you are a Host, the amounts paid by Airbnb Payments Canada to you in the twelve (12) month period prior to the event giving rise to the liability, or (ii) one hundred U.S. dollars (US$100) or the Canadian equivalent, if no such payments have been made, as applicable. The limitations of damages set forth above are fundamental elements of the basis of the bargain between Airbnb Payments Canada and you. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you. This does not affect Airbnb Payments Canada’s liability for death or personal injury arising from its negligence, nor for fraudulent misrepresentation, misrepresentation as to a fundamental matter, or any other liability which cannot be excluded or limited under applicable law.
You acknowledge that we outsource various aspects of the Payment Services to affiliates and other service providers located outside of Canada. For example, we outsource the processing of your payments made with a credit card or debit card to Airbnb Payments UK who will process these payments on our behalf in the UK.
You agree that in the event a service provider cannot or will not process any transaction referred to it by us, by reason that the service provider may suffer legal and/or reputational risks, or that the service provider may, by doing so, violate any law, regulation, rule or internal policy applicable to it if it completes such transaction, then notwithstanding any other provision of these Payments Terms, such transaction will not be completed and we will have no liability in respect of any such incomplete transaction.
You hereby confirm that you have requested that these Payments Terms and all related documents be drafted in English, that you have been provided with a French language version of these Payments Terms and that you have agreed to be bound by the English language version of these Payments Terms. The following paragraphs also apply if you are using the Payment Services as a representative (“Representative”) acting on behalf a business, company or other legal entity (in such event, for purposes of the Payments Terms, “you” and “your” will refer and apply to that business, company or other legal entity).
You accept the Payment Terms and you will be responsible for any act or omission of employees or third-party agents using the Payment Service on your behalf.
You and your Representative individually affirm that you are authorized to provide the information described in Section 2.1 and Section 3.2 and your Representative has the authority to bind you to these Payments Terms. We may require you to provide additional information or documentation demonstrating your Representative’s authority.
You represent and warrant to us that: (i) you are duly organized, validly existing and in good standing under the laws of the country in which your business is registered and that you are registering for receiving the Payment Services; and (ii) you have all requisite right, power, and authority to enter into this agreement, perform your obligations, and grant the rights, licenses, and authorizations in this agreement.
If you are using your Payment Method for the benefit of your employees or other authorized third-party in connection with Airbnb for Work, as permitted by your account, you authorize Airbnb Payments to charge your Payment Method for bookings requested by employees at your company or other permitted third-party.
For any Payout Method linked to your Airbnb account, you authorize Airbnb Payments to store the Payout Method, remit payments using the Payout Method for bookings associated with your Airbnb account and take any other action as permitted in the Payments Terms in respect of the Payout Method.
If you handle, store or otherwise process payment card information on behalf of anyone or any third-party, you agree to comply on an ongoing basis with applicable data privacy and security requirements under the current Payment Card Industry Data Security Standard with regards to the use, access, and storage of such credit card information. If your country of residence or establishment is within Australia, these Payments Terms for Australian Users (“Payments Terms”) are subject to the Australian Consumer Law. Our services come with guarantees that cannot be excluded under the Australian Consumer Law and other Australian laws. These Payments Terms (including clauses 10.1, 10.2, 11 and 12) apply to the maximum extent permitted by Australian law, including the Australian Consumer Law.
If you attempt to bring any legal claim against Airbnb Payments in the United States, the arbitration agreement and class actions waiver in Section 15 apply to you. Please read them carefully.
The Airbnb Terms of Service (“Terms”) govern your use of the Airbnb Platform. Capitalized terms not defined in these Payments Terms have the meaning ascribed to them in the Terms.

However, it is important to note that there are other supplemental policies and terms linked from our Additional Legal Terms page, which apply to your use of the Airbnb Platform, and are incorporated by reference, and also form part of the binding legal agreement between you and Airbnb.
Our terms and policies are organized based on the topic(s) to which they relate so as to make it easy for you to find the terms or policy relevant to your query or event.
When these Payments Terms mention “Airbnb Payments,” “we,” “us,” or “our,” it refers to:
Airbnb Payments UK Ltd. (“Airbnb Payments UK”), except when you book a Host Service, in which case you are contracting with Airbnb Payments Australia Pty Ltd (“Airbnb Payments Australia”).
Airbnb Payments provides payments services to Members publishing, offering and booking Accommodations, Services, Experiences or other Host Services, including services in connection with Airbnb.org and other current and future services provided via the Airbnb Platform. These payment services are provided for the benefit of Hosts and may include (if available) the following (collectively, “Payment Services”):
Airbnb Payments provides regulated Payment Services only to Hosts as the Host’s limited payment collection agent by accepting and processing funds from Guests purchasing Host Services on the Host’s behalf.
In order to use the Payment Services, you must be at least 18 years old, must have an Airbnb account in good standing in accordance with the Terms, and must keep your payment and personal information accurate and complete and provide us with identity and other information as requested by us.
If you change your country of residence, the Airbnb company you contract with and the applicable version of the Payments Terms will be determined by your new country of residence from the date on which your country of residence changes. By continuing to use the Payment Services after your change of country of residence, you agree to such change of contracting party and terms. Please note, however, that the Airbnb Payments company with whom you contract will stay the same for all bookings made prior to your change of residence.
By using the Payment Services, you agree to comply with these Payments Terms. Airbnb Payments may temporarily limit or suspend your access to or use of the Payment Services, or its features, to carry out maintenance measures that ensure the proper functioning of the Payment Services.
The Payment Services may contain links to third-party websites or resources (“Third-Party Services”). Such Third-Party Services are subject to different terms of service and privacy policies, and Members should review them. Airbnb Payments is not responsible or liable for the use of such Third-Party Services. Links to any Third-Party Services are not an endorsement by Airbnb Payments of those Third-Party Services.
Airbnb Payments may enable features that allow you to authorize other Members or third parties to take certain actions that affect your Airbnb account. You may authorize a third party to use your Airbnb account if the feature is enabled for your Airbnb account. You acknowledge and agree that anyone you authorize to use your Airbnb account may use the Payment Services on your behalf and that you will be responsible for any payments made by such person.
You authorize Airbnb Payments, directly or through third parties, to make any inquiries we consider necessary to verify your identity and information you provide, and if applicable, verifying the identity of the representative(s) and beneficial owner(s). This may include (i) screening you and, if applicable, your representative(s) and beneficial owner(s) against third-party databases or other sources, (ii) requesting reports from service providers, (iii) asking you and, if applicable, your representative(s) and beneficial owner(s) to provide a form of government identification (e.g., driver’s license or passport) to check your name, place and date of birth, your address, nationality and/or other information which we deem necessary under applicable laws. If you are providing information for identification and verification about your representative(s) and/or beneficial owner(s) on their behalf, by providing such information, you are confirming that you have the authority and requisite rights to provide their information (including consent, where applicable) to Airbnb Payments for Airbnb Payments to carry out the purposes set out in this Section 1.4; or (iv) requiring you to take steps to confirm ownership of your email address, Payment Method(s) or Payout Method(s). Airbnb Payments reserves the right to terminate, suspend, or limit access to the Payment Services in the event we are unable to obtain or verify any of this information.
Your access to or use of certain Payment Services may be subject to you first having to agree to or to accept (expressly or by conduct) additional terms and conditions, including those of third party providers of Payment Services. If there is a conflict between these Payments Terms and terms and conditions applicable to a specific Payment Service, the terms and conditions applicable to the specific Payment Service will take precedence with respect to your use of or access to that Payment Service, unless specified otherwise in the terms and conditions applicable to the specific Payment Service.
When you add a Payment Method to your Airbnb account, you will be asked to provide billing information such as name, billing address, and financial instrument information either to Airbnb Payments or its third-party payment processor(s). You authorize Airbnb Payments and its payment processor(s) to collect and store your Payment Method information in accordance with Airbnb’s privacy policy.
When you add or use a Payment Method, Airbnb Payments may verify the Payment Method by (i) authorizing your Payment Method for one or two nominal amounts via a payment service provider, and asking you to confirm those amounts, or (ii) requiring you to upload a billing statement. We may, and retain the right to, initiate refunds of these amounts from your Payment Method. When you add a Payment Method during checkout, we will automatically save and add that Payment Method to your Airbnb account so it can be used for a future transaction. You may not remove the Payment Method associated with a reservation, during the period commencing from the date of your booking and ending fourteen (14) days following your check-out date, nor during any additional period of time needed to resolve any outstanding Damage Report associated with such booking.
You allow Airbnb Payments to charge your Payment Method (including charging more than one Payment Method), either directly or indirectly, for all fees and other amounts due (including any applicable taxes) in connection with your Airbnb account, including Damage Report amounts in accordance with the Terms and with Sections 5 and 6.
If your Payment Method’s account information changes (e.g., account number, routing number, expiration date or CVV or CVC number) as a result of re-issuance or otherwise, we may acquire that information from our financial services partners or your bank and attempt to automatically update your Payment Method on file.
Airbnb Payments generally charges the Total Price due after the Host accepts your booking request. However, if you pay with a push Payment Method (such as Sofort), Airbnb Payments will collect the Total Price due at the time of your booking request or after the Host accepts your booking request. Airbnb may offer alternative options for the timing and manner of payment. Any additional fees for using those alternative payment options will be displayed via the Airbnb Platform and included in the Total Price, and you agree to pay such fees by selecting the payment option. Additional terms and conditions may apply for the use of an alternative payment option. If Airbnb Payments is unable to collect the Total Price due, as scheduled, Airbnb Payments will collect the Total Price due at a later point in accordance with Section 5.3. Once the payment for your requested booking is successfully completed, you will receive a confirmation email.
You are able to select your currency in your settings. The currencies available to make payments may be limited for regulatory or operational reasons based on factors such as your selected Payment Method, your country of residence and/or your Airbnb Payments contracting entity(ies). Any such limitations will be communicated via the Airbnb Platform, and you will be prompted to select a different currency or Payment Method if your preferred currency is not available.
Note that if the country in which your Airbnb Payments contracting entity is located is different from the country of your Payment Method provider or the preferred currency in your settings is different than your Payment Method's billing currency, your payment may be processed outside of your country of residence. As a result, your Payment Method provider may impose certain fees and the amount listed on your Payment Method statement may be different from the amount shown at checkout. For example, if you make a booking using an Australian issued card, but the preferred currency in your settings is set to US dollars, your payment may be processed outside Australia, and banks and credit card companies may impose international transaction fees and foreign exchange fees. In addition, if the preferred currency in your settings is different from your Payment Method's billing currency, your bank or credit card company may convert the payment amount to your billing currency associated with your Payment Method, based on an exchange rate and fee amount determined solely by your bank. Airbnb Payments is not responsible for any such fees and disclaims all liability in this regard. Please contact your Payment Method provider if you have any questions about these fees or any exchange rate imposed by your Payment Method provider.
If a requested booking is declined because it is not accepted by the Host, you cancel the booking request before it is accepted by the Host, or Airbnb cancels the booking, any amounts collected by Airbnb Payments and due to you pursuant to the policies described in Section 5.5 will be refunded to you, and any pre-authorization of your Payment Method will be released (if applicable) in accordance with Section 5.5.2.
Airbnb Payments reserves the right to decline or limit payments that we reasonably believe (i) may violate Airbnb Payments’ risk management policies or procedures, (ii) may violate these Payments Terms or the Terms, (iii) are unauthorized, fraudulent or illegal; or (iv) expose you, Airbnb, Airbnb Payments, or others to risks reasonably unacceptable to Airbnb Payments.
Payment Methods may involve the use of third-party payment service providers. These payment service providers may charge you additional fees when processing payments in connection with the Payment Services, and Airbnb Payments is not responsible for any such fees and disclaims all liability in this regard. Your Payment Method may also be subject to additional terms of use. Please review them before using your Payment Method.
Airbnb Payments is not responsible for any loss suffered by you as a result of incorrect Payment Method information provided by you. Airbnb Payments does not provide any regulated Payment Services to you.
2.11.1.1
Airbnb may make available to Guests the option to request that a portion of the booking’s Total Price is due and payable at the time of booking and the remainder at a later time prior to check-in (“Pay Part Now, Part Later”). Availability of this option may depend on the Listing and/or Payment Method. You will not be charged any additional fees for using Pay Part Now, Part Later. Note that failure to pay each portion by the relevant due date may result in your booking being canceled.
2.11.1.2
If you choose Pay Part Now, Part Later, the Airbnb Platform will notify you during checkout of the amount, currency and schedule of when each portion of the Total Price is due and payable. Airbnb credits, coupons, or gift cards will be applied first before the amount of each portion is calculated. On the relevant due date, Airbnb Payments will automatically charge the original Payment Method you used to make the booking.
2.11.1.3
If you make a modification to a booking made with Pay Part Now, Part Later, Airbnb will notify you of the revised dates on which portions of the Total Price will be due and payable, as applicable, and Airbnb Payments will automatically charge the original Payment Method you used to make the booking on the revised due dates. If the modification increases your Total Price, you may be required to pay for an additional portion of the new Total Price at the time of the modification.
2.11.1.4
You agree that by selecting Pay Part Now, Part Later, you may not be able to pay for the booking with a different Payment Method or pay your portions on different dates.
2.11.1.5
If Airbnb Payments is unable to collect your payment, Airbnb Payments will notify you of such declined payment, and require you to complete payment of the relevant portion using an alternative Payment Method within 72 hours of the notice. If you fail to pay a portion of the Total Price on the due date for payment, you authorize Airbnb to cancel the booking on your behalf. The amount of your refund, if any, will be determined by the Host’s cancellation policy if your booking is canceled.
2.11.2.1
Airbnb may make available to Guests the option to book an accommodation and request that the Total Price is due and payable at a later time prior to check-in (“Reserve Now, Pay Later”). If your booking is eligible for Reserve Now, Pay Later, the Airbnb Platform will provide you with this option at checkout. You will not be charged any additional fees for using Reserve Now, Pay Later. Note that failure to pay the Total Price by the relevant due date may result in your booking being canceled.
2.11.2.2
If you choose Reserve Now, Pay Later, the Airbnb Platform will notify you during checkout of the amount, currency and when the payment of the Total Price is due and payable. On the relevant due date, Airbnb Payments will automatically charge the original Payment Method you used to make the booking. If you wish to change your payment method before the payment is due and payable, you can do so by going to “Payments History” and updating the original Payment Method you used for the booking.
2.11.2.3
You authorize and grant Airbnb Payments a mandate to collect all amounts due and payable from you under this Section 2.11.2 by charging the Payment Method used to make the booking or otherwise as permitted pursuant to these Payments Terms.
2.11.2.4
If you make a modification to a booking made with Reserve Now, Pay Later, and the modification increases your Total Price, you may be required to pay for an additional portion of the new Total Price at the time of the modification.
2.11.2.5
If Airbnb Payments is unable to collect your payment, Airbnb Payments will notify you of such declined payment, and require you to complete payment using an alternative Payment Method within 72 hours of the notice. If you fail to complete payment on the due date, you authorize Airbnb to cancel the booking on your behalf. The amount of your refund, if any, will be determined by the Host’s cancellation policy if your booking is canceled.
2.11.3.1
For certain bookings (such as for Accommodation bookings of twenty-eight (28) nights or more), Airbnb Payments may require a Guest to make recurring, incremental payments toward the Total Price owed (“Recurring Payments”). More information on Recurring Payments (including the amount and the frequency of payments) will be made available via the Airbnb Platform if applicable to a booking.
2.11.3.2
If Recurring Payments apply to a confirmed booking, then the Guest authorizes Airbnb Payments to collect the Total Price due.
2.11.3.3
Guests may stop a Recurring Payment by notifying Airbnb Payments orally or in writing at least three (3) business days before the scheduled date of the payment. Airbnb Payments may require you to give written confirmation of a stop-payment order within fourteen (14) days of an oral notification. If you fail to provide written confirmation within those fourteen (14) days, Airbnb Payments is not obligated to honor your request to stop any future Recurring Payments. If you have any questions regarding your Recurring Payments, please contact Airbnb Payments.
Guests may from time to time be offered the possibility to pay for an Accommodation on credit or other installment options, and pay for them over time ('buy now, pay later'). These Payment Methods are provided by Klarna Australia Pty Ltd (or its affiliate), not Airbnb, and Klarna will become your creditor for the payment, subject to additional terms of use provided at checkout. Depending on the Payment Method, this may also create a separate relationship between you as the borrower and Klarna as the lender. Please review any applicable additional terms before using these Payment Methods.
Airbnb Payments generally collects the Total Price of a booking at the time the Guest’s booking request is accepted by the Host, unless noted otherwise.
In order to receive a Payout you must have a valid Payout Method linked to your Airbnb account. When you add a Payout Method to your Airbnb account, you may be asked to provide additional information, which may include name, government identification, tax ID, billing address, and financial instrument information either to Airbnb Payments or its third-party payment processor(s). Depending on the Payout Method selected additional information may be required, such as: residential address, name on the account, account type, routing number, account number, email address, payout currency, identification number and account information associated with a particular payment processor. Providing requested information is required for a Payout Method to be valid. The information Airbnb Payments requires for a valid Payout Method may change, and Airbnb Payments may request additional information at any time; failing to provide requested information may result in Airbnb Payments temporarily placing a hold, suspending, or canceling any Payout until the information is provided and, if necessary, validated.
You authorize Airbnb Payments to collect and store your Payout Method information in accordance with Airbnb’s Privacy Policy. Airbnb Payments may also share your information with governmental authorities as required by applicable law.
Unless you are a Host covered under Section 3.3.3 (in which case that Section applies to you), then, subject to and conditional upon successful receipt of the associated payments from Guests, Airbnb Payments will initiate Payouts to your selected Payout Method: (i) for Accommodations, by the end of the business day after the Guest’s scheduled check-in date; (ii) for Services and Experiences, by the end of the business day after the start of the Service or Experience; and (iii) for all other Host Services, including but not limited to Photography Services or Experiences, at the time specified via the Airbnb Platform. For Accommodation bookings of twenty-eight (28) nights or more, Airbnb Payments will initiate the first payout by the end of the business day after the Guest’s scheduled check-in date, and will initiate future payouts monthly after the initial payout, for the duration of the reservation.
Airbnb Payments may offer you a different Payout time or trigger for payment via the Airbnb Platform. The time it takes to receive Payouts once released by Airbnb Payments may depend upon the Payout Method you select.
For Accommodations only, for:
subject to and conditional upon successful receipt of the associated payments from Guest, Airbnb Payments will initiate Payouts to your selected Payout Method by the end of the business day after the Guest’s scheduled check-out date. If the Accommodation booking is twenty-eight (28) nights or more, Airbnb Payments will generally initiate the first and second Payout together, 28 days after the Guest’s scheduled check-in date, and will initiate future Payouts monthly after that for the duration of the reservation.
Your Payout schedule will be displayed in your earnings dashboard.
Your Payout for a booking will be the Total Price less applicable fees like Airbnb service fees and applicable taxes and any amounts you agree to allocate to any co-host, or the owner(s) of an Accommodation, a homeowners’ association, and/or their agent (such as a building operator or property management company). In the event of cancellation of a confirmed booking, Airbnb Payments will remit the amount you are due (if any) as provided in the Terms and applicable cancellation policy.
Airbnb Payments may temporarily place a hold, suspend, or cancel any Payout for the purposes of preventing unlawful activity or fraud, risk assessment, security, or completing an investigation; or if we are unable to verify your identity or where applicable the identity of your representative(s) or beneficial owner(s), or to obtain or verify requested information. Furthermore, Airbnb Payments may temporarily place a hold on, suspend, or delay initiating or processing any Payout due to you under the Terms as a result of high volume booking cancellations or modifications arising from a Force Majeure Event (as defined below).
Airbnb Payments will remit your Payouts in the currency applicable to your selected Payment Method. The currencies available may be limited for regulatory or operational reasons based on factors such as your selected Payout Method, your country of residence, and/or your Airbnb contracting entity(ies). Any such limitations will be communicated via the Airbnb Platform, and you will be prompted to select a different currency or Payout Method. Note that payment service providers may impose transaction, currency conversion or other fees based on the currency or Payout Method you select, and Airbnb Payments is not responsible for any such fees and disclaims all liability in this regard.
For compliance or operational reasons, Airbnb Payments may limit the amount of a Payout. If you are due an amount above that limit, Airbnb Payments may make a series of Payouts (potentially over multiple days) in order to provide your full Payout amount.
Payout Methods may involve the use of third-party payment service providers. These payment service providers may charge you additional fees when processing Payouts in connection with the Payment Services (including deducting charges from the Payout amount), and Airbnb Payments is not responsible for any such fees and disclaims all liability in this regard. Your Payout Method may also be subject to additional terms of use from such third-party payment service providers. Please review them before using your Payout Method.
Airbnb Payments may combine amounts that it collects from Guests and invest them as permitted under applicable laws. Airbnb Payments will retain any interest it earns on those investments.
Subject to Section 17, Airbnb Payments is not responsible for any loss suffered by you as a result of incorrect Payout Method information provided by you.
If you provide Host Services jointly with one or more other Hosts as part of a team, business or other organization (“Host Team”), Airbnb may make available to such Hosts the option to allocate between the members of the Host Team the total Host Payout for a booking. Airbnb Payments will execute such payments at the instruction of one or more members of the Host Team, and Hosts are responsible for the accuracy of their instructions.
If a Guest in Germany chooses to pay for an Accommodation Reservation using a Klarna "buy now, pay later" option (other than a Pay-in-3 option), these additional Host terms apply.
Each Host, including each Host Team member, hereby appoints Airbnb Payments as the Host’s payment collection agent solely for the limited purpose of accepting and processing funds from Guests purchasing Host Services on the Host’s behalf.
Each Host, including each Host Team member, agrees that payment made by a Guest through Airbnb Payments, shall be considered the same as a payment made directly to the Host, and the Host will provide the Host Service booked by the Guest in the agreed-upon manner as if the Host has received the payment directly from the Guest. Each Host agrees that Airbnb Payments may refund the Guest in accordance with the Terms. Each Host understands that Airbnb Payments’ obligation to pay the Host is subject to and conditional upon successful receipt of the associated payments from Guests. Airbnb Payments guarantees payments to Host(s) only for such amounts that have been successfully received by Airbnb Payments from Guests in accordance with these Payments Terms. In accepting appointment as the limited payment collection agent of the Host, Airbnb Payments assumes no liability for any acts or omissions of the Host, except for acts or omissions the Host is directed to engage in by Airbnb Payments.
Each Guest acknowledges and agrees that, notwithstanding the fact that Airbnb Payments is not a party to the agreement between you and the Host(s), including each Host Team member, Airbnb Payments acts as each Host’s payment collection agent for the limited purpose of accepting payments from you on behalf of the Host(s). Upon a Guest’s payment of the funds to Airbnb Payments, the Guest’s payment obligation to the Host(s) for the agreed upon amount is extinguished, and Airbnb Payments is responsible for remitting the funds successfully received by Airbnb Payments to the Host(s) in the manner described in these Payments Terms. In the event that Airbnb Payments does not remit any such amounts, the Host(s) will have recourse only against Airbnb Payments and not the Guest directly.
At no point in time is Airbnb Payments holding funds on behalf of the Guest or providing the Guest a payment service.
Airbnb Payments may charge fees for use of certain Payment Services and any applicable fees will be disclosed to you in the Terms or via the Airbnb Platform prior to being charged.
You authorize Airbnb Payments to collect from you amounts due pursuant to these Payments Terms and/or the Terms by either (i) charging the Payment Method associated with the relevant booking, or any other Payment Method on file that you authorize in your Airbnb account (unless you have previously removed the authorization to charge such Payment Method(s)), or (ii) by withholding the amount from your future Payout. Specifically, you authorize Airbnb Payments to collect from you:
If you owe an amount at any time after a booking, such as with Pay Part Now, Part Later or Recurring Payment charges, Booking Modifications, Resolution Center payments or Damage Reports (“Additional Amounts”), you authorize and grant Airbnb Payments a mandate to collect payments for such Additional Amounts by charging your Payment Method associated with the relevant booking without any further action on your part. Airbnb Payments will notify you in writing before any Additional Amounts are charged to such payment method.
If your Payment Method associated with the relevant booking is expired, invalid or otherwise not able to be charged for any reason (such as insufficient funds), you remain responsible for any uncollected amounts and Airbnb Payments may charge the Payment Method related to your booking again or use any other Payment Method on file associated with your Airbnb account, if available, to collect such Additional Amounts. Any amount not collected for any reason will be subject to any remedies that may be available, including, but not limited to, referral to a collections agency, or pursuit of available causes of action or claims against you.
If Airbnb has reason to believe that you as a Host participated in fraudulent activity, such as an overpayment scam, booking fraud or other fraud, and Airbnb Payments released the payout for such stay, Airbnb Payments may recoup from you such amount by reducing, setting off or debiting the amount from any future Payouts owed to you.
In addition to any amount due as outlined above, if there are amounts which you owe us but are unpaid or chargebacks associated with your Payment Method, you may be charged fees or costs for reasonable steps taken by Airbnb and/or Airbnb Payments to collect, recover or process these amounts and chargebacks (“Collection Fees”). The Collection Fees will be limited to: (a) reasonable costs directly incurred by Airbnb Payments and/or Airbnb (such as costs associated with the time our personnel spend collecting, recovering or processing the relevant amounts); and (b) collection fees, convenience fees or other fees or costs that are charged to Airbnb Payments and/or Airbnb by third parties.
If Airbnb Payments is unable to collect any amounts you owe, as a Guest or as a Host, under the Terms and these Payments Terms, Airbnb Payments may engage in collection efforts to recover such amounts from you.
Airbnb Payments will deem any owed amounts overdue when: (a) for authorized charges, one hundred and twenty (120) days have elapsed after Airbnb Payments first attempts to charge your Payment Method or the associated services have been provided, whichever is later; and (b) for withholdings from a Host’s future Payouts, two hundred and seventy (270) days have elapsed after the adjustment is made to the Host’s Airbnb account or the associated services have been provided, whichever is later.
Airbnb Payments will deem any overdue amounts not collected to be in default when three hundred and sixty five (365) days have elapsed: (a) for authorized charges to your Payment Method with respect to a Guest transaction, after Airbnb Payments first attempts to charge your Payment Method or the associated services have been provided, whichever is later; and (b) for withholdings from a Host’s future Payouts, after the adjustment is made to the Host’s Airbnb account or the associated services have been provided, whichever is later.
You hereby explicitly agree that all communications in relation to amounts owed will be made by electronic mail or by phone, as provided to Airbnb and/or Airbnb Payments by you. Such communications may be made by Airbnb, Airbnb Payments, or by anyone on their behalf, including but not limited to a third-party collection agent.
Airbnb Payments will take the necessary steps to rectify any payment processing errors that we become aware of. These steps may include crediting or debiting (as appropriate) the original Payout Method or Payment Method used or selected by you, so that you end up receiving or paying the correct amount. This may be performed by Airbnb Payments or a third party such as your financial institution. We may also take steps to recover funds sent to you in error (including but not limited to an event of duplicate payments made to you due to a processing error). For Hosts, this may include, by reducing, setting off and/or debiting the amount of such funds from any future Payouts owed to you.
To the extent you receive any funds in error, you agree to promptly return such funds to Airbnb Payments after you become aware that you have received such funds in error.
Any refunds or credits due to a Member pursuant to the Terms, Major Disruptive Events Policy, Rebooking and Refund Policy for Homes, and Refund Policy for Services and Experiences, will be initiated and remitted by Airbnb Payments in accordance with these Payments Terms.
Subject to this Section 5.5.2, Airbnb Payments will initiate the refund process promptly. In the case of a cancellation by a Host, Airbnb Payments will hold the funds for up to 72 hours until the Guest is either refunded or the funds are used to rebook with another Host. In certain instances, the refund process may include the option to receive credit in lieu of a cash refund; if this option is made available to you, the timing of your refund will be communicated via the Airbnb Platform. The time it takes to receive any cash refund or for any pre-authorization of your Payment Method to be released will vary based on the Payment Method and any applicable payment system (e.g., Visa, Mastercard, etc.) rules. In the event of a Force Majeure Event that may affect the processing and settlement of refunds, Airbnb Payments will initiate and process the refund as soon as is practicable.
If you are responsible for Damage Report amounts, pursuant to Section 14 of the Terms, Airbnb via Airbnb Payments may, on reasonable notice to you, charge the Payment Method used to make the booking or any other Payment Method associated with your Airbnb account at the time of the Damage Report or within a reasonable period thereafter in order to collect the Damage Report amounts, up to a maximum amount as defined in Section 14 of the Terms. To facilitate this charge, when you book a Listing, you are agreeing that Airbnb via Airbnb Payments may charge the Payment Method used to book the Listing in order to collect Damage Report amounts.
To the maximum extent permitted by law, you agree that Airbnb Payments may seek to recover from you under any insurance policies you maintain and that Airbnb Payments may also pursue against you any remedies it may have available, including, but not limited to, referral to a collections agency, or pursuit of causes of action or claims against you, including in relation to a Damage Report, or payment requests made by Hosts under the Host Damage Protection.
If Airbnb Payments holds funds due to you (e.g., because we are unable to issue you a Payout or refund) or you do not use a gift card or gift credit for the relevant period of time set forth by your state, country, or other governing body in its unclaimed property laws, we may process the funds due to you in accordance with our legal obligations, including by reporting and escheating (sending) such funds to the appropriate governing body as required by applicable unclaimed property laws.
You are solely responsible for compliance with any and all laws, rules, regulations, and tax obligations that may apply to your use of the Payment Services. In connection with your use of the Payment Services, you may not and you agree that you will not and will not assist or enable others to:
We are required to act in accordance with our internal policies and the laws of various jurisdictions relating to the prevention of money laundering and the implementation of sanctions including: (i) economic or financial sanctions or trade embargoes imposed, administered or enforced from time to time by the U.S. government, including those administered by the Office of Foreign Asset Control or the U.S. Department of State; or (ii) by the United Nations Security Council, the European Union or His Majesty’s Treasury of the United Kingdom. You will comply with any relevant financial sanctions and any relevant export control laws applicable to you and to your local jurisdiction.
As between Airbnb and a Member, neither shall be liable to the other for any delay or failure to perform resulting from causes outside their reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, epidemics or disease, strikes or shortages of transportation facilities, fuel, energy, labor or materials (“Force Majeure Event”). For the avoidance of doubt, this clause does not: (i) apply to a Reservation, which is subject to the Host’s cancellation policy and the Major Disruptive Events Policy; or (ii) operate to extend deadlines applicable to a Resolution Centre Request, a Host Damage Protection claim, an Aircover for guests claim, a Travel Issue under the Rebooking and Refund Policy for Homes or a Services or Experiences Issue under the Refund Policy for Services and Experiences, or other requests, claims or reporting under similar policies that are incorporated by reference into these Terms.
If you choose to use the Payment Services, you do so voluntarily and at your sole risk.
Notwithstanding Airbnb Payments’ appointment as the limited payment collection agent of Hosts pursuant to Section 4 and subject to Section 11, Airbnb Payments explicitly disclaims all liability for any act or omission by you, any Member or other third party. Airbnb Payments does not have any duties or obligations as agent for each Host except to the extent expressly set forth in these Payments Terms, and any additional duties or obligations as may be implied by law are, to the maximum extent permitted by applicable law, expressly excluded.
If we choose or are required to conduct identity verification on any Member, to the extent permitted by applicable law, we disclaim warranties of any kind, either express or implied, that such checks will identify prior misconduct by a Member or guarantee that a Member will not engage in misconduct in the future. We are not responsible for prior misconduct by a Member where such misconduct was unknown by us.
The foregoing disclaimers apply to the maximum extent permitted by law. You may have other statutory rights or warranties which cannot lawfully be excluded. However, the duration of any statutorily required warranties shall be limited to the maximum extent (if any) permitted by law.
You acknowledge and agree that, to the maximum extent permitted by law, the risk arising out of your access to and use of the Payment Services remains with you. If you permit or authorize another person to use your Airbnb account in any way, you are responsible for the actions taken by that person. To the maximum extent permitted by law, no party, including Airbnb’s affiliates and personnel, or any other party involved in or delivering the Payment Services will be liable for any incidental, special, exemplary, or consequential damages. Incidental, special, exemplary or consequential damages, include, to the maximum extent permitted by law, lost profits, loss of data or loss of goodwill, service interruption, computer damage or system failure or the cost of substitute products or services. Neither is Airbnb Payments liable nor any other party liable, to the extent permitted by law, for any damages for personal or bodily injury or emotional distress arising out of or in connection with (i) these Payments Terms, (ii) from the use of or inability to use the Payment Services, or (iii) from any communications, interactions, or meetings with other Members or other persons with whom you communicate, interact, transact, or meet with as a result of your use of the Payment Services, whether based on warranty, contract, tort (including negligence), product liability, or any other legal theory, and whether or not Airbnb Payments has been informed of the possibility of such damage, even if a limited remedy set forth herein is found to have failed of its essential purpose.
Except for: (i) Airbnb’s obligation to pay amounts to applicable Hosts pursuant to these Payments Terms; (ii) Airbnb’s obligation to make payments under the Airbnb Host Damage Protection, which contains its own limitation of liability; and/or (iii) Airbnb Payments’ wilful breach of these Terms, to the maximum extent permitted by law, in no event shall Airbnb Payments’ aggregate liability arising out of or in connection with these Payments Terms and your use of the Payment Services including, but not limited to, from your use of or inability to use the Payment Services, exceed (A) to Guests, three (3) times the amount you paid for the relevant Reservation(s) giving rise to the liability, or (B) to Hosts, three (3) times the amount paid to you for the relevant Reservation(s) giving rise to the liability. The limitations of damages set forth above are fundamental elements of the basis of the bargain between Airbnb Payments and you.
Except in the case of a Member’s wilful breach of these Terms, to the maximum extent permitted by law, in no event shall a Member’s liability to Airbnb or any other party involved in creating, producing, or delivering the Airbnb Platform or any Content for any claim or dispute arising out of or in connection with these Payments Terms, interaction with any Member, or your use of or inability to use the Airbnb Platform, any Content, or any Host Service exceed: (A) in the case of Guests, three (3) times the amount you paid for the relevant Reservation(s) giving rise to the liability, or (B) in the case of Hosts, three (3) times the amount paid to you for the relevant Reservation(s) giving rise to the liability.
To the maximum extent permitted by applicable law, you agree to release, defend (at Airbnb Payments’ option), indemnify, and hold Airbnb (including Airbnb Payments, other affiliates and subsidiaries, and their officers, directors, employees, and agents) harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of (i) your breach of these Payments Terms (including any supplemental or additional terms that apply to a product or feature) or our Additional Legal Terms, Policies, or Standards; (ii) your improper use of the Payment Services; (iii) your failure, or our failure at your direction, to accurately report, collect or remit Taxes; or (iv) your breach of any laws, regulations, or third-party rights, such as intellectual property or privacy rights. The indemnification obligation only applies if and to the extent that the claims, liabilities, damages, losses, and expenses have been adequately caused by your negligence or breach of a contractual obligation.
Airbnb Payments may modify these Payments Terms at any time. If we make material changes to these Payments Terms, we will post the revised Payments Terms on the Airbnb Platform and update the “Last Updated” date at the top of these Payments Terms. If you are affected by the modification, we will also provide you with notice of the modifications at least two (2) months before the date they become effective. If you do not terminate your agreement before the date the revised Payments Terms become effective, your continued use of the Payment Services will constitute acceptance of any changes to the revised Payments Terms.
This agreement between you and Airbnb Payments is effective (i) if you are a Guest, from when you make your first booking; or (ii) if you are a Host, from when a Guest first books a Listing made available by you and you use the Payment Services and remains in effect until either you or we terminate this agreement in accordance with Section 13.3.
You may terminate this agreement at any time by sending us an email or by deleting your Airbnb account. Without limiting our rights specified below, Airbnb Payments may terminate this agreement for convenience at any time by giving you thirty (30) days' notice via email to your registered email address (or ninety (90) days' prior notice for Members contracting with Airbnb Payments UK). Airbnb Payments may also terminate this agreement immediately without notice if (i) you have materially breached your obligations under this agreement; (ii) you have provided inaccurate, fraudulent, outdated, or incomplete information; (iii) you have violated applicable laws, regulations, or third-party rights; or (iv) Airbnb Payments believes in good faith that such action is reasonably necessary to protect other Members, Airbnb, Airbnb Payments, or third parties. In case of non-material breaches or where otherwise reasonable, you will be given reasonable notice of any actions that Airbnb proposes to take and an opportunity to remedy the non-material breach (if it is capable of remedy) unless such notification would (i) prevent or impede the detection or prevention of fraud or other illegal activities, (ii) harm the legitimate interests of other Members or third parties, or (iii) contravene applicable laws. Terminating this agreement will also serve as notice to cancel your Airbnb account pursuant to the Terms.
Airbnb Payments may limit or temporarily or permanently suspend your use of or access to the Payment Services (i) to comply with applicable law, or the order or request of a court, law enforcement, or other administrative agency or governmental body, (ii) if you have materially breached these Payments Terms, the Terms, applicable laws, regulations or third-party rights, (iii) if you have provided inaccurate, fraudulent, outdated, or incomplete information regarding a Payment Method or Payout Method, (iv) for any amounts you owe under these Payments Term that are overdue or in default, or (v) if Airbnb Payments believes in good faith that such action is reasonably necessary to protect the personal safety or property of Airbnb, its Members, Airbnb Payments, or third parties, or to prevent fraud or other illegal activity. Further, for unsuccessful payment due to card expiration, insufficient funds, or otherwise, we may temporarily suspend your access to the Payment Services until we can charge a valid Payment Method.
If Airbnb Payments takes any of the measures described in Section 13.3 you may appeal such a decision by contacting customer service.
If you cancel your Airbnb account as a Host or Airbnb Payments takes any of the measures described above, Airbnb Payments may provide a full refund to any Guests with confirmed booking(s), and you will not be entitled to any compensation for pending or confirmed bookings that were cancelled. If you cancel your Airbnb account as a Guest, Airbnb Payments will initiate a refund for any confirmed booking(s) based on the Listing’s cancellation policy. If your access to or use of the Payment Services has been suspended or limited or this agreement has been terminated by us, you may not register a new Airbnb account or attempt to access and use the Payment Services through an Airbnb account of another Member.
Sections 1.2, 2.2, 2.3, 2.4, 2.5, 2.6, 2.7, 2.8, 2.9, 2.10, 2.11, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17 and 19, survive expiry or termination, together with any other terms that, by reasonable implication or to give them efficacy are, or are intended, to be performed in whole or in part after the expiry or termination of this agreement.
If you are contracting with Airbnb Payments UK, these Payments Terms will be interpreted in accordance with English law. If you are acting as a consumer and if mandatory statutory consumer protection regulations in your country of residence contain provisions that are more beneficial for you, such provisions shall apply irrespective of the choice of English law. As a consumer, you may only bring proceedings relating to these Payments Terms before the competent court of your place of residence or a court in England. If Airbnb wishes to enforce any of its rights against you as a consumer, we may do so only in the courts of the jurisdiction in which you are a resident. If you are acting as a business, you agree to submit to the exclusive jurisdiction of the English courts.
If you are contracting with Airbnb Payments Australia, these Payments Terms will be governed by the laws of the State of New South Wales, Australia. The parties agree to submit to the non-exclusive jurisdiction of the courts of that State and courts of appeal of that State in respect of any proceedings arising out of or in connection with this agreement.
PLEASE READ THE FOLLOWING PARAGRAPHS CAREFULLY BECAUSE THEY PROVIDE THAT YOU AND AIRBNB PAYMENTS AGREE TO RESOLVE ALL DISPUTES BETWEEN US THROUGH BINDING INDIVIDUAL ARBITRATION AND INCLUDE A CLASS ACTION WAIVER AND JURY TRIAL WAIVER. This Arbitration Agreement supersedes all prior versions.
This Arbitration Agreement only applies to you if you are contracting with Airbnb Payment US. If you are not contracting with Airbnb Payments US, and you nevertheless attempt to bring any legal claim against Airbnb Payments in the United States, this Arbitration Agreement will apply for determination of the threshold issue of whether this Section 15 applies to you, and all other threshold determinations, including residency, arbitrability, venue, and applicable law.
Airbnb Payments is committed to participating in a consumer-friendly dispute resolution process. To that end, these Payments Terms provide for a two-part process for individuals to whom this Section 15 applies: (1) an informal negotiation directly with Airbnb’s customer service team (described in Section 15.3), and if necessary (2) a binding arbitration in accordance with the terms of this Arbitration Agreement. You and Airbnb Payments each retain the right to seek resolution of the dispute in small claims court as an alternative to arbitration.
At least 30 days prior to initiating an arbitration, you and Airbnb Payments each agree to send the other party an individualized notice of the dispute in writing (“Pre-Dispute Notice”) and attempt in good faith to negotiate an informal resolution of an individual claim. You must send your Pre-Dispute Notice to Airbnb Payments by mailing it to Airbnb Payments’ agent for service: CSC Lawyers Incorporating Service, 2710 Gateway Oaks Drive, Suite 150N, Sacramento, California 95833. Airbnb Payments will send its Pre-Dispute Notice to the email address associated with your Airbnb account. A notice of dispute must include: the date, your name, mailing address, your Airbnb username, the email address you used to set up your Airbnb account, your signature, a brief description of the dispute, and the relief sought. If the parties are unable to resolve the dispute within the 30-day period, only then may either party commence arbitration by filing a written demand for arbitration with the arbitration provider designated pursuant to Section 15.6, below. A claimant’s Pre-Dispute Notice requirement is a prerequisite to any arbitration, and a copy of the Pre-Dispute Notice and evidence that it was sent as required by this Section must be attached to any arbitration demand.
You and Airbnb Payments mutually agree that any dispute, claim or controversy arising out of or relating to these Payments Terms or the applicability, breach, termination, validity, enforcement or interpretation thereof, or any use of the Payment Services (collectively, "Disputes") will be settled by binding arbitration on an individual basis (the "Arbitration Agreement"). If there is a dispute about whether this Arbitration Agreement can be enforced or applies to our Dispute, you and Airbnb Payments agree that the arbitrator will decide that issue. For the avoidance of doubt, you and Airbnb agree that any question regarding arbitrability and the formation, enforceability, validity, scope, or interpretation of all or part of this Section 15, including any dispute over compliance with the Pre-Dispute Notice requirement and a party’s responsibility to pay arbitration fees, shall be resolved by an arbitrator.
You and Airbnb Payments each agree that the following causes of action and/or claims for relief are exceptions to the Arbitration Agreement and will be brought in and will be brought in a judicial proceeding in state or federal court in San Francisco, California, unless we both agree to some other location: (i) any claim or cause of action seeking emergency injunctive relief based on exigent circumstances (e.g., imminent danger or commission of a crime, hacking, cyber-attack); (ii) a request for the remedy of public injunctive relief; (iii) any claim or cause of action for vexatious litigation; or (iv) any individual claim of sexual assault or sexual harassment arising from your use of the Airbnb Platform or Host Services. You and Airbnb Payments agree that any request for the remedy of public injunctive relief will proceed after the arbitration of all arbitrable claims, remedies, or causes of action, and will be stayed pending the outcome of the arbitration pursuant to section 3 of the Federal Arbitration Act.
This Arbitration Agreement evidences a transaction in interstate commerce and the Federal Arbitration Act governs all substantive and procedural interpretation and enforcement of this Arbitration Agreement, and not state law. The arbitration will be administered by ADR Services, Inc. (“ADR”) (www.adrservices.com) in accordance with Rules 1, 6–7, 8–9, and 11–12, 45, 54, and 56 of the Federal Rules of Civil Procedure (“Selected Federal Rules") (https://www.uscourts.gov/rules-policies/current-rules-practice-procedure/federal-rules-civil-procedure) and ADR’s Arbitration Rules then in effect (the “ADR Rules”), except as the Selected Federal Rules or ADR Rules are modified by or conflict with this Arbitration Agreement. The ADR Rules are available at www.adrservices.com. If an arbitration demand is submitted to ADR Services in accordance with this agreement and the ADR Rules, and ADR Services cannot or will not administer the arbitration, the arbitration will be administered by the American Arbitration Association (“AAA”) in accordance with the Selected Federal Rules and the AAA’s Consumer Arbitration Rules (the “AAA Rules”) then in effect, except as modified here. The AAA Rules are available at www.adr.org. If the AAA cannot and will not administer the arbitration, you and Airbnb Payments shall confer and select an alternative arbitral forum, and if we are unable to agree, either you or Airbnb Payments may ask a court to appoint an arbitrator pursuant to 9 U.S.C. § 5. In that event, the arbitration will be conducted in accordance with the rules of the appointed arbitral forum, unless those rules are inconsistent with the provisions of this Arbitration Agreement.
In order to make the arbitration most cost-effective, efficient, and convenient to you, any required arbitration hearing in an arbitration wherein the amount in controversy does not exceed US $1,000,000, shall be conducted remotely via video conference except as otherwise agreed by the parties or instructed by the arbitrator. Any required arbitration hearing in an arbitration wherein the amount in controversy exceeds US $1,000,000 shall be conducted in San Francisco County except as otherwise agreed by the parties or instructed by the arbitrator. If the amount in controversy is US $10,000 or less, the parties agree to proceed solely on the submission of documents to the arbitrator, provided that the arbitrator has discretion to decide to hold a hearing in response to the reasonable and proportionate request from a party.
Your arbitration fees and your share of arbitrator compensation shall be governed by the ADR Rules and the ADR Services fee schedule (available at www.adrservices.com). If you have a gross monthly income of less than 300% of the federal poverty guidelines, you are entitled to a waiver of arbitration fees and costs, exclusive of arbitrator fees. You may request a fee waiver by providing the arbitration provider with a declaration under oath stating your monthly income and the number of persons in your household. If a fee waiver is granted by the arbitration provider and you provide Airbnb Payments with documents necessary to prove that your gross monthly income is less than 300% of the federal poverty guidelines, Airbnb Payments will pay your share of any arbitrator fees.
Either party may make a request that the arbitrator impose sanctions upon proving that the other party or its attorney(s) has asserted a claim, or defense that is groundless in fact or law, brought in bad faith or for the purpose of harassment, or is otherwise frivolous. As allowed by applicable law and the AAA Rules the arbitrator shall impose sanctions equal to the requesting party’s reasonable attorneys’ fees and costs upon finding that a claim or defense is groundless in fact or law, brought in bad faith or for the purpose of harassment, asserted in violation of Fed. R. Civ. P. 11(b) (treating the arbitrator as “the court”), or is otherwise frivolous. Either party may seek dismissal of any arbitration filed in violation of any provision of this Arbitration Agreement. Either party may assert in arbitration a counterclaim for the other party’s initiation of proceedings concerning an arbitrable Dispute without complying with or otherwise in violation of the requirements of this Arbitration Agreement. Upon finding that a party has initiated proceedings concerning an arbitrable Dispute without complying with or otherwise in violation of the requirements of this Arbitration Agreement, the arbitrator shall award the other party its actual damages, including but not limited to reasonable attorneys’ fees and costs.
The arbitrator will issue a written decision which shall include the essential findings and conclusions upon which the arbitrator based the award. Judgment on the arbitration award may be entered in any court with proper jurisdiction. The arbitrator may award any relief allowed by law or the AAA Rules, but declaratory or injunctive relief may be awarded only on an individual basis and only to the extent necessary to provide relief warranted by the claimant’s individual claim.
You and Airbnb Payments acknowledge and agree that both parties are each waiving the right to a trial by jury as to all arbitrable Disputes.
You and Airbnb Payments acknowledge and agree that, to the fullest extent permitted by law, we are each waiving the right to participate as a plaintiff or class member in any purported class action lawsuit, class- wide arbitration, private attorney general action, or any other representative or consolidated proceeding. Unless we agree in writing or as provided in this agreement, the arbitrator may not consolidate more than one party’s claims and may not otherwise preside over any form of any class or representative proceeding. If there is a final judicial determination that applicable law precludes enforcement of the waiver contained in this paragraph as to any claim, cause of action or requested remedy, then that claim, cause of action or requested remedy, and only that claim, cause of action or requested remedy, will be severed from this agreement to arbitrate and will be brought in a court of competent jurisdiction. In the event that a claim, cause of action or requested remedy is severed pursuant to this paragraph, then you and we agree that the claims, causes of action or requested remedies that are not subject to arbitration will be stayed until all arbitrable claims, causes of action and requested remedies are resolved by the arbitrator.
You and Airbnb Payments acknowledge and agree that the relative benefits and efficiencies of arbitration may be lost when 100 or more arbitration claims are filed within 180 days which (1) involve the same or similarly situated parties; (2) are based on the same or similar claims which arise from the same or substantially identical transactions, incidents, alleged violations or events requiring the determination of the same or substantially identical questions of law or fact; and (3) involve the same or coordinated counsel for the parties (“Mass Action”). Accordingly, you and Airbnb Payments agree to waive the right to have any Dispute administered, arbitrated, or resolved as part of a Mass Action (though Sections 15 and 15.12 will continue to apply to the Dispute). In case of a dispute, the appointed arbitrator for the first matter instituted within a set of claims identified by either party shall decide whether those claims are part of a Mass Action. If no arbitrator has yet been appointed, an arbitrator shall be appointed solely to determine whether claims identified by either party are part of a Mass Action. Nothing in this provision prevents you or Airbnb Payments from participating in a mass settlement of claims.
If for any reason, notwithstanding Section 15.13, an arbitration proceeds as part of a Mass Action, the parties shall group the arbitration demands into batches of no more than 200. The batches shall be determined by listing the claimants’ alphabetically (by last name or business name, as applicable)—for example, the first 200 claimants listed will be the first batch, the next 200 claimants listed will be the second batch, and so forth. The parties shall randomly assign each batch a sequential number and arbitrate the batches one at a time, in sequential order. While one batch is being arbitrated, the arbitration provider shall hold the remainder in abeyance unless otherwise agreed by the parties or instructed by the arbitration provider. Each batch shall be resolved within 240 days of the pre-hearing conference for that batch. Notwithstanding the forgoing, if any claimant’s demand has not been the subject of a pre-hearing conference within 2 years of the latest-filed demand in the Mass Action, such claimant may elect to pursue the claims asserted in the claimant’s demand in court subject to Sections 14 and 15.12.
At least 10 days before the date set for the arbitration hearing, you or Airbnb Payments may serve a written offer of judgment on the other party to allow judgment on specified terms. If the offer is accepted, the offer with proof of acceptance shall be submitted to the arbitration provider, who shall issue an award accordingly. If the offer is not accepted prior to the arbitration hearing or within 30 days after it is made, whichever occurs first, it shall be deemed withdrawn and cannot be given as evidence in the arbitration, other than with respect to costs (including all fees paid to the arbitration provider). If an offer made by one party is not accepted by the other party, and the other party fails to obtain a more favorable award, the other party shall not recover their post-offer costs and shall pay the offering party’s costs (including all fees paid to the arbitration provider) from the time of the offer.
Except as provided in Section 15.12, in the event that any portion of this Arbitration Agreement is deemed illegal or unenforceable, such provision shall be severed and the remainder of the Arbitration Agreement will be given full force and effect.
If Airbnb Payments amends this Section 15 after the date you last accepted these Payments Terms (or accepted any subsequent changes to these Payments Terms), you may reject the change by sending us written notice no later than thirty (30) days of the date the change is effective. Your notice must include your name, mailing address, the date of the notice, your Airbnb username, the email address you used to set up your Airbnb account, your signature, and an unequivocal statement that you want to opt out of the amended Section 15. You must either mail your notice to this address: 888 Brannan St, San Francisco, CA 94103, Attn: Arbitration Opt-Out, or email the opt-out notice to [email protected]. Rejecting a new change, however, does not revoke or alter your prior consent to any earlier agreements to arbitrate any Dispute between you and Airbnb Payments (or your prior consent to any subsequent changes thereto), which will remain in effect and enforceable as to any Dispute between you and Airbnb Payments.
Except as provided in Section 15.12 and subject to Section 13.7, this Section 15 will survive any termination of these Payments Terms and will continue to apply even if you stop using the Payment Services or terminate your Airbnb account.
Except as they may be supplemented by additional terms and conditions, policies, guidelines, or standards, these Payments Terms constitute the entire agreement between Airbnb Payments and you regarding the subject matter hereof, and supersede any and all prior oral or written understandings or agreements between Airbnb Payments and you regarding the Payment Services. This clause does not exclude a party’s liability for prior false, misleading or deceptive statements or misrepresentations, whether oral or written. If any provision of these Payments Terms is held to be invalid or unenforceable, such provision will be struck and will not affect the validity and enforceability of the remaining provisions.
Subject to any limitation expressly stated in these Payments Terms or the Terms, or any document, policy or standard incorporated into them, Airbnb Payments’ or a Member’s failure to enforce any right or provision in these Payments Terms will not constitute a waiver of such right or provision unless acknowledged and agreed between the relevant parties in writing. Except as expressly set forth in these Payments Terms, the exercise by Airbnb Payments or a Member of any of its remedies under these Payments Terms will be without prejudice to its other remedies under these Payments Terms or otherwise permitted under law.
You may not assign, transfer, or delegate this agreement or your rights and obligations hereunder without Airbnb Payments’ prior written consent (not to be unreasonably withheld or delayed). Airbnb Payments may assign, transfer, or delegate this agreement and any rights and obligations, at its sole discretion, with thirty (30) days’ prior notice (or two (2) months’ prior notice (for Members contracting with Airbnb Payments UK) provided that this would not reduce your rights or benefits under these terms.
Unless specified otherwise, any notices or other communications permitted or required under this agreement, will be in writing and given by Airbnb Payments via email or Airbnb Platform notification, and depending on your notification setting, messaging service (including SMS and WeChat). The date of receipt will be deemed the date on which Airbnb Payments transmits the notice.
This Section 17 will apply if you are contracting with Airbnb Payments UK. To the extent that there is any conflict between this Section 17 and any other provision of these Payments Terms, the provisions of this Section 17 shall apply
The Payment Services include the payment collection service provided to Hosts contracting with Airbnb Payments UK. The payment collection service constitutes a “payment service” regulated under the Payment Services Regulations and for these purposes Airbnb Payments UK treats Hosts as the “payment service user.”
By agreeing to these Payments Terms you as a Host have consented to Airbnb Payments UK’s payment of each Payout to your chosen Payout Method. Hosts may change a Payout Method up to one (1) day before the time agreed for the Payout as set out in Section 3.3. Airbnb Payments UK will be deemed to have received the Host's payment order to the Host on the same date Airbnb Payments UK agrees to initiate the Payout in accordance with Section 3.3.
Airbnb Payments UK will endeavor to ensure that Hosts based in the UK will receive each Payout by the end of the business day following Airbnb Payments UK’s initiation of the Payout.
Airbnb Payments will provide the Host notice via email when we initiate each Payout. We will also provide notice to a Host’s registered email address if the Payout is returned to us because of an error. It is your responsibility as a Host to ensure that you provide us with a current, accurate, and valid email address.
If you as a Host believe or become aware that a Payout properly due to you has been or may be diverted without your authorization (“Diverted Payout”) because your password or other credentials to log into your Airbnb account (“Credentials”) have been lost, stolen, or misappropriated, you should notify Airbnb Payments UK without undue delay. As a Host you may be liable for losses relating to any Diverted Payout arising from the use of lost, stolen, or misappropriated Credentials (including the loss of a mobile phone on which you have installed the Application) or where you have failed to keep your Credentials safe, up to a maximum of £35. Provided that you notify us of any Diverted Payout without delay and at the very latest within 13 months of the date of the payment, you may be entitled to a refund of that payment.
If you as Host claim not to have received a Payout properly due to you via your chosen Payout Method (including where there has been a Diverted Payout), Airbnb Payments UK will (if requested by you without undue delay, on becoming aware of the unauthorized or incorrectly executed Payout and in any event within 13 months of it happening) make immediate efforts to trace the payment and will notify you of the outcome. Subject to Section 17.2.3, unless we can prove that (i) the Payout was received by you via your chosen Payout Method, or (ii) we made the Payout correctly using the Payout Method information you provided but the information you provided was incorrect, we will refund the amount. Where you have given us incorrect information, we will not be liable for the defective or non-execution of the Payout, however, we will make reasonable efforts to recover the Payout funds.
You must use your Credentials in accordance with these Payments Terms, and take all reasonable steps to keep your Credentials safe. As a Host you may be liable for losses suffered by Airbnb Payments UK in attempting to trace and recover a Diverted Payout (up to a maximum of £35) arising from the use of lost, stolen, or misappropriated Credentials including where due to the loss of a mobile phone on which you have installed the Application or where you have failed to keep your Credentials safe. You will not be liable for losses suffered by Airbnb Payments UK in attempting to trace and recover a Diverted Payout where the loss, theft or misappropriation of your Credentials was not detectable by you prior to the Diverted Payout (unless you acted fraudulently in connected with the Diverted Payout), or where the loss suffered by Airbnb Payments UK was caused by acts or omissions of Airbnb personnel or a service provider. You may however be liable to Airbnb Payments UK for all losses relating to attempted tracing and recovery of a Diverted Payout if we can produce reasonable evidence that you acted fraudulently or where you failed to use the Airbnb Platform and/or Payment Services in accordance with the Terms or these Payments Terms (including the obligation to keep your Credentials safe). Except where you have acted fraudulently, you will not be liable to Airbnb Payments UK for any losses incurred in respect of the attempted tracing and recovery of a Diverted Payout arising after notification by you of the loss, theft, or misappropriation of your Credentials or of the unauthorized use of your Credentials, where we have failed at any time to provide appropriate means for such notification, or where we do not require strong customer authentication, where required.
Any complaints about the Payment Services should be made to Airbnb Payments UK. If you are not happy with the outcome of a complaint and you as a Host have received regulated Payment Services from Airbnb Payments UK, you may also be able to refer your complaint to the Financial Ombudsman. All complaints to the Financial Ombudsman Service are subject to the rules of the Financial Ombudsman Service, including in relation to eligibility requirements. The UK Financial Ombudsman Service offers a free complaints resolution service. You may obtain further information regarding the Financial Ombudsman Services and contact details at: http://www.financial-ombufsman.org.uk.
The following paragraphs also apply if you are using the Payment Services as a representative (“Representative”) acting on behalf a business, company or other legal entity (in such event, for purposes of the Payments Terms, “you” and “your” will refer and apply to that business, company or other legal entity).
You accept the Payments Terms and you will be responsible for any act or omission of employees or third-party agents using the Payment Service on your behalf.
You and your Representative individually affirm that you are authorized to provide the information described in Section 2.1 and Section 3.2 and your Representative has the authority to bind you to these Payments Terms. We may require you to provide additional information or documentation demonstrating your Representative’s authority.
You represent and warrant to us that: (i) you are duly organized, validly existing and in good standing under the laws of the country in which your business is registered and that you are registering for receiving the Payment Services; and (ii) you have all requisite right, power, and authority to enter into this agreement, perform your obligations, and grant the rights, licenses, and authorizations in this agreement.
If you are using your Payment Method for the benefit of your employees or other authorized third-party in connection with Airbnb for Work, as permitted by your account, you authorize Airbnb Payments to charge your Payment Method for bookings requested by employees at your company or other permitted third-party.
For any Payout Method linked to your Airbnb account, you authorize Airbnb Payments to store the Payout Method, remit payments using the Payout Method for bookings associated with your Airbnb account and take any other action as permitted in the Payments Terms in respect of the Payout Method.
If you handle, store or otherwise process payment card information on behalf of anyone or any third-party, you agree to comply on an ongoing basis with applicable data privacy and security requirements under the current Payment Card Industry Data Security Standard with regards to the use, access, and storage of such credit card information.
